influence over said board decisions; and
WHEREAS, consistent with the state code of ethics and in
an effort to avoid all appearances of impropriety, the employment
and appointment of Miami Beach City Commissioners ' relatives to
positions in City government must be absolutely prohibited within
the City of Miami Beach.
NOW THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA that upon final resolution by
the Florida Supreme Court in the case of City of Miami Beach v.
Galbut, Supreme Court Case No. 80, 780, the City Attorney' s office
shall prepare legislation to be embodied within the City Code
establishing an anti-nepotism policy of the City of Miami Beach by
prohibiting the appointment or employment, promotion, or
advancement in or to a position within the City of Miami Beach by
a member of the City Commission of a relative* of a City
Commissioner.

*The definition of "relative" shall coincide with Florida Statute
Section 112 . 3135 (1) (c) in which said term, with respect to a public
official , means an individual who is related to the public
official, as father, mother, son, daughter, brother, sister, uncle,
aunt, first cousin, nephew, niece, husband, wife, father-in-law,
mother-in-law, son-in-law, daughter-in-law, brother-in-law, sister-
in-law, step-father, step-mother, step-son, step-daughter, step-
brother, step-sister, half-brother, or half-sister.

SUBJECT: ANTI-NEPOTISM: ABSOLUTE PROHIBITION ON MEMBER OF CITY
COMMISSION APPOINTING OR EMPLOYING RELATIVES OF CITY
COMMISSIONERS TO POSITIONS IN CITY GOVERNMENT
At the request of City Commissioner Susan Gottlieb and
Commissioner Neisen Kasdin, the attached resolution has been
prepared embodying an anti-nepotism policy of the City of Miami
Beach, resulting in the absolute prohibition of City Commissioners'
appointing or employing relatives of City Commissioners to
positions in City government. Presently, in City of Miami Beach v.
Galbut the Florida Supreme Court is considering this issue as a
result of the Third District Court of Appeal 's decision in which
the appellate court upheld the right of a City Commissioner's
relative to sit on a municipal board so long as the related city
commissioner abstained from the subject vote. In light of the fact
that the State Commission on Ethics and State Attorney General 's
Office have opined in favor of such an absolute prohibition, this
legislation is intended to extend the effectiveness of said prior
opinions by proscribing these appointments within the City of Miami
Beach. In this regard, the citizens of Miami Beach may be assured
that every step has been taken in order to avoid even the potential
for influence over City boards and committees, avoiding at all cost
such appearances of impropriety.
