A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH APPROVING THE APPROPRIATION OF
$5, 387 .80 FOR A MULTI-AGENCY GANG TASK FORCE FOR
WHICH FUNDS HAVE BEEN AWARDED.
WHEREAS, the Miami Beach Police Department is desirous of
increasing law enforcement activities so as to investigate the
organized violent narcotic/organized robbery groups in South
Florida; and,
WHEREAS, such increase in law enforcement activities is
expected to result in reducing violent street crime; and,
WHEREAS, the State of Florida, Department of Law Enforcement,
through its High Intensity Drug Trafficking Area, hereafter
referred to as the STOP /Sidearm Project has made available funds
for such activities; and,
WHEREAS, the Miami Beach Police Department has applied for
such funds to assist in increasing such law enforcement activities;
and,
WHEREAS, the Miami_ Beach Police Department has been awarded
$5, 387 . 80 in High Intensity Drug Trafficking Area, referred to as
the STOP /Sidearm Project.
NOW THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA that the City Commission hereby
approves the appropriation of $5, 387 . 80 in High Intensity Drug
Trafficking Area, hereafter referred to as the STOP /Sidearm
Project.

APPROPRIATION OF LAW ENFORCEMENT GRANT FUNDS — HIGH
SUBJECT: INTENSITY DRUG TRAFFICKING AREA (HIDTA) REFERRED TO AS
THE STOP/SIDEARM PROJECT
ADMINISTRATION RECOMMENDATION
The Administration recommends that the City Commission approve the
appropriation of $5, 387.80 for the Stop/Sidearm Project.
BACKGROUND
The Miami Beach Police Department has agreed to participate in a
Task Force with the State of Florida, Department of Law Enforcement
to investigate the organized violent narcotic/organized robbery
groups in South Florida. This program will be referred to as the
Stop/Sidearm Project. The objectives include the following:
-- To target local gangs and address gang-related crimes.
-- To reduce related street and property crimes.
The term of this agreement is for the period October 1, 1992
through September 30, 1994 which may be extended as allowed by the
Office of National Drug Control Policy.
Additionally, the City of Miami Beach is required to abide by the
special conditions as set forth by the U.S. Department of Justice
as well as modifications outlined in the award of the $5, 387 .80.
This amount will cover personnel overtime, travel, equipment and
investigative funds incurred by the City of Miami Beach Police
Department during this operation. The Administrative Officer of
the Grant for the Police Department will adhere to the conditions
as enumerated in the Grant, including, but not limited to,
equipment purchases, quarterly reporting, expenditures and
modifications.
CONCLUSION
The Administration recommends that the City Commission approve the
appropriation of $5, 387 .80 for the Stop/Sidearm Project.

TERMS OF ACCEPTANCE
This agreement is made between the State of Florida, Department of Law Enforcement hereinafter
referred to as the "FDLE" and the Miami Beach Police Department hereinafter referred to as MBPD.
Whereas, MBPD has agreed to participate in a Task Force with FDLE to investigate the organized,
violent narcotic/organized robbery groups in South Florida, and
Whereas, such investigative activities are more fully described in FDLE'S application for federal
assistance, High Intensity Drug Trafficking Area, hereafter referred to as the STOP/Sidearm Project, see
attachment A, and
Whereas, FDLE received an award (number GE-3-M06) of$664,388.00 from the Office of National Drug
Control Policy, see attachment B for the STOP/Sidearm Project, and
Whereas, FDLE has agreed to reimburse MBPD for its investigative efforts during the term of the
agreement in a amount not to exceed $5,387.80 for personnel overtime, travel, equipment and
investigative funds, as identified in the STOP/Sidearm Project.
Now, therefore, FDLE and MBPD do mutually agree as follows: The term of this agreement is for the
period October 1, 1992 through September 30, 1994, but may be extended as allowed by the Office of
National Drug Control Policy.
Department of Justice.
MBPD agrees to comply with the provisions of the Office of Management and Budget (OMB) Circular A-
128 regarding audit requirements as and to the extent these requirements may be applicable to MBPD
under this agreement.
As authorized by the terms of Award Number GE-3-M06, attachment B, reimbursement may be made for
investigative efforts undertaken by MBPD from October 1, 1992 on.
MBPD shall provide investigative personnel as specified in the STOP/Sidearm Project who shall
participate in investigative activities as directed by the Task Force coordinator.
MBPD shall submit claims for reimbursement to FDLE using forms and guidelines, see attachment C, as
established by FDLE. Claims for reimbursement must be submitted in detail sufficient for a proper pre
audit and post audit thereof with accompanying support documentation as delineated on the forms.
MBPD agrees to comply with the provisions of Section 216.349(2), Florida Statutes and the audit or
attestation statement obligations provided therein.
Claims for reimbursement of travel expenses shall be limited to the amounts permitted in Section
112.061, Florida Statutes.
In accordance with U.S. Department of Justice, 28 CFR Part 65, funds received through Award GE-3-
M06 will not be used for:
* Land acquisition
* Supplementation of state of local funds that would otherwise be available
Civil Justice matters except to the extent that such Civil Justice matters bear
directly and substantially upon criminal justice matters or are the inextricably
intertwined with criminal justice matters.

Terms of Acceptance
Funds received through award GE-3-MO6 will not be used for the purpose of lobbying the Florida
legislature or any state agency.
Records of claims for reimbursement submitted to the FDLE shall be maintained by MBPD for a four
year period or until audited. The Attorney General and the Comptroller of the United States, the Florida
Comptroller and Auditor General, as well as FDLE representatives shall have access, for the purpose
of audit and examination, to any books, documents, and records of MBPD as pertaining to this
agreement.
In accordance with the Justice Assistance Act, MBPD shall ensure that 'no person on the grounds of
race, color, religion, national origin, or sex be excluded from participation in, be denied the benefits of,
or be subjected to discrimination under or denied employment in connection with any program or
activity funded in whole or in part with funds made available under this title.' Recipients of funds
under the Act are also subject to provision of Title VI of the Civil Rights Act of 1964; Section 504
of the Rehabilitation Act of 1973, as amended; Title IX of the Education Amendments of 1972; the
Age Discrimination Act Of 1975; and the Department of Justice Non-Discrimination Regulations 28 CFR
Part 42, Subparts C, D, E, and G.
Confidentiality of Information shall be in accordance with Section 612 or Title I of the omnibus Crime
Control, The Safe Streets Act of 1968 (as amended and implemented by 28 CFR Part 20), and Chapter
119, Florida Statutes.
This agreement shall be unilaterally canceled by FDLE for refusal to allow public access to all
documents, papers, letters or other material subject to the provisions of Chapter 119, Florida Statutes,
and made or received in conjunction with the agreement.
