A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, AUTHORIZING THE CITY MANAGER OR HIS
DESIGNEE TO SUBMIT GRANT APPLlCAOONS FOR
THE FOLLOWING FUNDS: 1) THE FLORIDA
DEPARTMENT OF COMMUNITY AFFAIRS, FOR
OPERATIONS LIBERTY SHIELD FUNDS; 2) THE FLORID
DEPARTMENT OF COMMUNITY AFFAIRS, DIVISION OF
EMERGENCY MANAGEMENT FOR COMMUNITY
EMERGENCY RESPONSE TEAM (CERT) TRAINING; 3)
FLORIDA DEPARTMENT OF LAW ENFORCEMENT,
BYRNE GRANT FUNDS FOR E-TlCKEnNG INITIATIVE;
4)OFFICE OF THE GOVERNOR, DRUG-FREE
COMMUNITIES PROGRAM FOR DRUG ERADICATION
PROGRAMS; 5) MIAMI-DADE COUNTY OFFICE OF ADA
COORDINATION FOR ELIGIBLE CITY ADA PROJECTS;
WHILE LEVERAGING PREVIOUSLY APPROPRIATED
GRANT FUNDS AS NEEDED; FURTHER
APPROPRIATING THE GRANTS IF APPROVED AND
ACCEPTED BY THE CITY AND AUTHORIZING THE
EXECUTION. OF ALL NECESSARY DOCUMENTS
RELATED TO THESE APPLICATIONS.
WHEREAS, the Administration requests retroactive approval to
submit a grant application in the amount of $50,679.96 to the Florida
Department of Community Affairs through funds made available from the
United States Department of Justice Operation Liberty Shield
Reimbursement Program; and
WHEREAS, the program reimburses local law enforcement
agencies for overtime costs associated with the heighten security
measures implemented during the March 17, 2003 through April 16, 2003
and the May 20, 2003 through May 30, 2003 federal code orange alerts,
and'
,
WHEREAS, the City of Miami Beach Police Department seeks
reimbursement of funds for eligible costs incurred during this period, and;
WHEREAS, matching funds are not required for this program, and;
WHEREAS, the Administration requests retroactive approval to
apply to the Florida Department of Community Affairs, Division of
Emergency Management for grant funds in the amount of $9,633.75 made
available through the 2003-2004 Community Emergency Response Team
Program (CERT), and;
WHEREAS, the Community Emergency Response Team Program
(CERT) program provides a structured opportunity for citizens to augment
local emergency responsibilities, and;
WHEREAS, the funds would be used to off-set City costs
associated with providing CERT training that is currently coordinated by
the Neighborhood Services Department, and;
WHEREAS, no matching funds are required of this programs, and;
WHEREAS, Administration requests retroactive approval to submit
a grant application in the amount of $32,852 to the Florida Department of
Law Enforcement, BYRNE grant program, and;
WHEREAS, the program purpose is to promote the States' efforts
to prevent and control rome, violence and drug abuse and to improve
criminal justice systems, and;
WHEREAS, the City's request for funds will be used for
development, infrastructure, and hardware and software procurement to
support an electronic uniform citation system, and;
WHEREAS, this initiative will reduce the amount of time that a
police officer takes to issue a citation, thus, allowing for more
neighborhood services such as patrol, quality of life initiatives, and
resource networking and coordination, and;
WHEREAS, the required match of $8,213 will come from funds
made available through the Police Department Law Enforcement Trust
Funds, and;
WHEREAS, the Administration requests approval to submit a grant
application in the amount of $44,837, to the Governor's Office, for grant
funds appropriated in FY 2003-2004 Florida's Drug-Free Communities
program; and
WHEREAS, the Florida Drug Free Communities program was
created to provide funding for Drug Prevention Programs, which focuses
on reducing under-age drinking, has proven to be successful. In renewing
the program, the City plans to extend our enforcement I prevention efforts
to the North Beach communities, and;
WHEREAS, the Administration requests approval to submit a grant
application in the amount of $61,254.08, made available through Parking
Fines Monies administered by the Miami-Dade County Office of ADA
Coordination, and;
WHEREAS, the Parking Fines Money are to be used to fund
programs that improve accessibility and equal opportunity to qualified
physically disabled persons and to provide funds to conduct public
awareness programs concerning physically disabled persons, and;
WHEREAS, the City proposes to use the grant funds for Citywide
curb ramps, sign language interpretive services, staff TTY orientation and
mobility training, advertisements for the County's emergency evacuation
program for people with disabilities and City of Miami Beach ADA
grievance policy advertisements as well other relevant ADA-related
advertisements and projects, and;
WHEREAS, the required match in the amount of $61,254.08 has
been made available through City funds and General Obligation Bond
funds as previously appropriated,
NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND
CITY COMMISSION OF THE CITY OF MIAMI BEACH authorize the City
Manager or his designee to apply and accept/support the following grant
applications: 1) The Florida Department Of Community Affairs, For
Operations Liberty Shield Funds; 2) The Florid Department Of Community
Affairs, Division Of Emergency Management For Community Emergency
Response Team (Cert) Training; 3) Florida Department Of Law
Enforcement, Byrne Grant Funds For E-Ticketing Initiative; 4)Office Of
The Governor, Drug-Free Communities Program For Drug Eradication
Programs; 5) Miami-Dade County Office Of ADA Coordination For Eligible
City ADA Projects; While Leveraging Previously Appropriated Funds As
Needed; Further Appropriating The Grants If Approved And Accepted By
The City And Authorizing The Execution Of All Necessary Documents
Related To These Applications.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
1.) Retroactive approval to apply for !:Irant funds administered by the Florida
Department of Community Affairs made available throu!:lh the United States
Department of Justice Operation Liberty Shield Reimbursement !:Irant fund
prOQram in the amount of $50,679.96
The State of Florida Department of Community Affairs serves as the grant administrator
for funds made available through the United States Department of Justice, Operation
Liberty Shield Reimbursement program. This program reimburses local law
enforcement agencies for overtime costs associated with the heighten security
measures implemented during the March 17, 2003 through April 16, 2003 and the May
20,2003 through May 30,2003 federal code orange alerts. Law enforcement agencies
who met minimum requirements were eligible for some reimbursement costs; as such,
the City of Miami Beach submitted a request for funds in the amount of $50,679.96 for
eligible expenses incurred during the federal orange alerts.
2.) Retroactive approval to applv to the Florida Department of Community
Affairs, Division of Emerqencv ManaQement for Qrant funds in the amount of
$9,633.75 made available throuQh the 2003-2004 Community Emerqencv
Response Team Proqram
The Community Emergency Response Team (CERT) program provides a structured
opportunity for citizens to augment local emergency response activities. Program funds
will be used to train people to be prepared for emergency situations that may arise in
their communities. CERT members give critical support to first responders in
emergency situations. The funds would be used to off-set City costs associated with
providing CERT training that is currently coordinated by the Neighborhood Service
Department. No match is required.
3.) Retroactive approval to submit a qrant application in the amount of $32.852
to the Florida Department of Law Enforcement. BYRNE Grant prOQram, FY
2003-2004 Qrant funds. leveraQinQ $8.213 of Police Departmental Law
Enforcement Trust Funds
The program purpose is to promote the States' efforts to prevent and control crime,
violence and drug abuse and to improve criminal justice systems. Units of local
government must use the Byrne Program funds to implement projects that offer a high
probability of improving the functioning of the criminal justice system, aggressively and
effectively responding to violent crime, or reducing drug trafficking and abuse.
The City's request for funds will be used for the development, infrastructure, and
hardware and software procurement to support an electronic uniform citation system.
The City of Miami Beach is in the process of implementing an E-Ticketing initiative. This
initiative will reduce the amount of time that a police officer takes to issue a citation,
thus, allowing for more neighborhood services such as patrol, quality of life initiatives,
and resource networking and coordination.
4.) Approval to submit a Qrant application in the amount of $44.837, to the
Governors Office. for Qrant funds appropriated in FY 2003-2004 Florida's
DruQ-Free Communities proQram; this prOQram does not require matchinQ
funds.
The Florida Drug Free Communities program was created to provide funding for Drug
Prevention Programs. The Drug-Free Communities program strives for the use of best
practices that have been proven effective.
In requesting these funds, that City is seeking a renewal of our 2002-2003 Drug-Free
Communities program. Our program, which focuses on reducing under-age drinking,
has proven to be successful. In renewing the program, the City plans to extend our
enforcement I prevention efforts to the North Beach communities.
5.) Approval to submit a Qrant application in the amount of $61,254.08, to Miami
Dade County for Parkina Fines Monies to provide funds to improve
accessibility and equal opportunity to Qualified physically disabled persons
and to provide funds for eliQible City ADA proiects.
The City of Miami Beach entered into an Interlocal Agreement with Miami-Dade County
on April 18, 2001 for the distribution of funds collected for the misuse of specially
marked parking spaces for people with disabilities. The agreement is based on Section
316.1967, Florida Statues, and Section 30-447 of the Code of Miami-Dade County,
which authorizes the charging of fines for misuse of specially marked parking spaces
for people with disabilities. Eligible City projects, if mandated by federal, state, or local
law must be matched in at least an equal amount by other funding. Other City projects
or programs may be funded up to 100% by disabled permit parking fine monies.
The City proposes to use the grant funds for Citywide curb ramps, sign language

Beach ADA grievance policy advertisements as well other relevant ADA-related

The grant will be matched with City and GO Bond Funds, as necessary. Funds are

programs concerning physically disabled persons. The grant was discussed at the
Barrier Free Environment Committee on June 23 and July 28, 2003.

Enclosed are three copies ofthe Amendment of the Subrecipient Agreement for the 2000 1-1
Supportive Housing Program project between Miami-Dade County Government and your agency
for the outreach project. The project number is FL 14B000005. The Technkal Submission for
this project was amended by your staff and submitted to the United States Department of Housing
and Urban Development by our staff. In the document, the budget was amended, and the City of
Miami Beach agreed to provide match funds in the amount of$61,547.65. Thus, the language in
the Subrecipient Agreement on page 2, Section I (C) titled Budget, paragraph two, sentence
number one was amended to reflect the new match funds commitment.
Please execute all copies ofthe amended Subrecipient Agreement and return them to our office,
attention Barbara Golphin, no later than Wednesday, November 5,2003. One fully executed
amended Sub recipient Agreement will be returned to you for your files.
The County requires that the City Manager execute the amended Sub recipient Agreement on
behalf of the City. In addition, your corporate seal must be affixed to the signature page of the
document.
