Resolution 2019-31059 RESOLUTION NO. 20 1 9 3 1 0 5 9 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY. OF MIAMI BEACH, FLORIDA, URGING THE SCHOOL BOARD OF MIAMI- DADE COUNTY, FLORIDA TO NEGOTIATE AND ENTER INTO A JOINT USE AGREEMENT WITH THE CITY TO ALLOW USE OF THE BASKETBALL COURTS AT SOUTH POINTE PARK ELEMENTARY SCHOOL FOR THE MUTUAL BENEFIT OF THE STUDENTS OF MIAMI-DADE COUNTY PUBLIC SCHOOLS AND RESIDENTS OF THE CITY OF MIAMI BEACH. WHEREAS, the School Board of Miami-Dade County (the "Board") and the City of Miami Beach (the"City") are mutually interested in and concerned with providing and making available recreational programs, activities and facilities for the use and benefit of the students of Miami-Dade County Public Schools and residents of the City; and WHEREAS, the Board owns and has under its jurisdiction certain real property known as South Pointe Elementary School, located at 1050 4th Street, Miami Beach, Florida 33139, and the City has approached the Board with a request to use the school basketball courts for the City's recreational programs; and WHEREAS, the school basketball courts would be used by the City to fulfill a need for additional recreational and athletic facilities in the south of fifth community, and by the Board for the School's recreational and educational programs; and WHEREAS, in order to fulfill the goal of providing additional recreational amenities to residents, it is necessary for the City to partner with the Board; and WHEREAS, the City has requested to use the courts from 8:00 a.m. to sundown, on Saturdays and Sundays and on weeknights, subject to scheduling; and WHEREAS, in exchange, the City is willing to fund new chain link fencing, and is prepared to complete additional recreational improvements to the basketball courts, at the City's sole cost and expense; and WHEREAS, at the October 16, 2019 City Commission meeting, the Mayor and City Commissioners expressed a desire to enter into a joint use agreement with the Board to allow the respective use of the school basketball courts for recreational purposes; and WHEREAS, the City is willing to explore enhanced lighting and cameras in the respective area to address the Board's security concerns; and WHEREAS, the Board insists the City staff the basketball courts while they are under the custody of the City. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby urge the School Board of Miami-Dade County, Florida to negotiate and enter into a joint use agreement with the City to allow use of the basketball courts at South Pointe Park Elementary School for the mutual benefit of the students of Miami-Dade County Public Schools and residents of the City of Miami Beach. ANALYSIS Neighbors and parents have approached my office about expediting the City's partnership with the Miami-Dade County Public Schools system to open up South Pointe Elementary School's basketball courts up to the community. I ask for the City Commission to take prioritize the issue so our residents and children can enjoy these courts during the evenings and weekends. If the courts are to be used by the public,the City should also discuss how we can enhance the courts for players of all skill levels.
