AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING CHAPTER 50 OF THE CITY OF MIAMI
BEACH CODE ENTITLED "FIRE PREVENTION AND PROTECTION", BY
AMENDING SECTION 50-3 THEREOF, ENTITLED "PLANS EXAMINATION,
INSPECTIONS, PERMITS" BY DELETING SUBSECTIONS 50-3(a) THROUGH
(n) IN TOTO AND REPLACING SAME WITH SUBSECTIONS 50-3(a)
THROUGH (v), AND BY AMENDING APPENDIX A THERETO, ENTITLED
"FEE SCHEDULE"; BY PROVIDING FOR AN INCREASE IN PERMIT AND
INSPECTION FEES FOR FIRE PERMITS AND FOR OTHER FIRE
DEPARTMENT ACTIVITIES FOR SUBSECTIONS 50-3(a) THROUGH (v);
PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN
EFFECTIVE DATE.
WHEREAS, the City of Miami Beach has not increased permit fees since September 16, 1992,
and the cost associated with running the fire plan review section of the Fire Department has increased
significantly since that time; and
WHEREAS, the City's consultant, JRD & Associates, Inc., has analyzed the City's permit fees
and compared them to similar fees charged by other municipalities and has recommended a 15%
increase across the board and, where necessary, additional increases to make fees comparable with
other municipalities; and
WHEREAS, on July 16, 2002, the City's Finance and Citywide Projects Committee directed the
City Administration to draft an amendment to the fire permit fee ordinance, increasing fees by 15% in
order to recover some of the costs associated with running the fire plan review section of the Fire
Department; and
WHEREAS, the City Administration recommends that the City Commission approve the proposed
Ordinance, which would amend Section 50-3 of Chapter 50 of the City of Miami Beach Code, entitled
"Plans Examination, inspections, permits" by deleting subsections 50-3(a) through (n) in toto and
replacing same with subsections 50-3(a) through (v), and amending Appendix A entitled "Fee Schedule"
consistent therewith to provide for an increase in fees for Fiscal Year 2003-2004.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. AMENDMENT OF Section 50-3 of ChaDter 50
That Subsections 50-3(a)-(n) of the Code of the City of Miami Beach are hereby deleted in toto
and replaced with the following language and subsections 50-3(a)-(v):

and imposed and shall apply to buildinq and fire permits and other activities undertaken bv that
Department.
(b) Double fees. When work for which a permit is required is commenced prior to the obtaininq of a
permit. the permit applicant shall be required to pay a double permit fee as specified in this article. The
payment of the required fee shall not relieve any person. firm or corporation from fullv complyina with all
of the applicable requlations and codes. nor shall it relieve them from beina subiect to any of the penalties
therein. The double fee requirement shall be applicable as noted herein. For a second offense of doinq
work without a permit. the permit applicant shall be required to pay twice the double permit fee. For each
subsequent offense. the permit applicant shall be required to pay twice the double permit fee.

(c) Reinsaection fee. When extra inspection trips are necessary due to an incorrect address qiven on
a call for inspection. prior reiection of work due to faultv construction. work not beinq readv for inspection
at the time specified. failure to call for final or other inspections. or required corrections not beinq made or
completed at the time specified bv the contractor. a fee as specified in Appendix A for the second re-
inspection mav be charaed to the permit holder in the trade concerned. Pavment of the reinspection fee
shall be required before anv permits will be issued to the person owinq the fee. Further inspection mav be
refused until pavment of reinspection fees has been made.
(d) Lost a/ans fee. When permitted plans for fire protection svstems are lost bv the applicant~)~
owner~). contractor's). or anv other representative of the proiect. a recertification fee will be required to
review. stamp and approve a new set of plans as a field copv. Such fee shall be based on 25 percent of
the oriqinal fire permit fee as specified in Appendix A.
(e) Revised alans arocessina fee. The charqe for plans processinq of revisions to plans re-processed
and permitted shall be based on total actual time spent on review bv plans examiners multiplied bv plans
review fee hourlv rate as specified in Appendix A.
(f) Lost aermit card fee. If the permit inspection card is lost after the permit has been issued. a
replacement fee as specified in Appendix A shall be charqed. This fee is charaed to cover the cost of
researchinq inspection approvals and re-siqninq the card.
(q) Saecia/ insaection fee. A fee equal to actual staff time and related costs shall be assessed for
special inspections that are outside the normal scope of fire department work. A minimum fee as
specified in Appendix A shall be charqed. Requests submitted bv developers. attornevs. realtors or
contractors to inspect a buildinq to determine existinq violations shall be considered special inspections.
(h) Insaection fee hourlv rate. The inspection fee hourlv rate. as specified in Appendix A. is
determined at the beqinnina of each fiscal vear based on the Department's total proiected expenditures.
indirect costs and the resources assiqned to the inspection proqram.
in Plans review fee hourlv rate. The plan review fee hourlv rate. as specified in Appendix A. is
determined at the beqinninq of each fiscal vear based on the Department's total proiected expenditures.

{i) Plans re-review fee. When extra plans reviews are due to the failure to correct a code violation
specifically and continuously noted in each reiection. a fee shall be charqed as specified in Appendix A.
Each time after the third such review that plans are reiected for the same code violation. a fee of four
times the cost associated with the specific plans review shall be charqed. The cost is calculated based on
the actual time spent bv plans examiners multiplied by the plans review fee hourlv rate. as specified in
Appendix A.
(k) Temaorarv Certificate of Occuaancv insaection fee. Whenever the contractor requests a
temporary certificate of occupancy that requires a fire inspection approval. a fee shall be charqed as
specified in Appendix A.
(I) Refunds. time limitations. cancellations. The fees charqed pursuant to this Code. may be
refunded by the Fire Official subiect to the followinq:
(1) No refunds shall be made on requests involvinq:
(a) Permit fees of $75.00 or less: or
(b) Permits revoked by the Fire or Buildinq Officials: or
(c) Permits cancelled bv court order: or
(d) Permits which have expired: or

(e) Permits under which work has commenced as evidenced bv any recorded insoection havina
been made bv the Deoartment.
(2) A full refund shall be aranted to a oermit holder who takes out a oermit coverina work outside the
iurisdictional insoection area.
(3) A full refund less $75.00 or 30 oercent of the oermit fee. whichever amount is areater. rounded
down to the nearest dollar shall be aranted to a oermit holder who reauests a refund in writina.
orovided:
(a) That the oermit holder makes a written reauest orior to the oermit exoiration date: and.
(b) That a validated coov of the oermit be submitted with such reauest: and.
(c) That no work. as evidenced bv any recorded insoection. has commenced under such oermit.
(4) Where there is a chanae of contractor involvina a oermit for which a fee of more than $50.00 was
oaid:

recorded insoection. has been made by the Deoartment. a credit of 50 oercent of the oriainal
oermit fee coverina the same oroiect and involvina the same olans shall be aiven. orovided that a
comolete reaoolication is made within 180 days of the exoiration date of the oriainal oermit and
orovided that no refund has been made accordina to this section. The reaoolication must be
submitted with the olans and the aoolicant's validated cooy of the oriainal oermit. The amount of
this fee shall be. at least. eaual to or hiaher than the minimum fee for the trade concerned.
(m) New buildina and/or additions:

(2) For areenhouses and nonresidential buildinas used for aaricultural ourooses. and
screened enclosures and trailer additions when located on the oremises so used. the fee shall be

SECTION 3. REPEALER
All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed.
SECTION 4. SEVERABILITY
If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any
court of competent jurisdiction, then said holding shall in no way affect the validity or the remaining
portions of this ordinance.
SECTION 5. CODIFICATION
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby Ordained
the provisions of this Ordinance shall become and be made part of the Code of the City of Miami Beach,
Florida. The sections of this Ordinance may be renumbered or relettered to accomplish such intentions
and the word "ordinance" may be changed to "section", "article", or other appropriate word.
SECTION 6. EFFECTIVE DATE.
This Ordinance shall take effect on

The City Administration recommends that the City Commission approve the ordinance,
which amends Chapter 50 of the City Code entitled "Fire Prevention and Protection" by
amending Section 50-3 thereof entitled "Plans Examination, Inspections, Permits", and by
amending Appendix A thereto entitled "Fee Schedule".
ANALYSIS
On September 16, 1992, Ordinance No. 92-2796 was adopted, which amended Chapter 8
of the City of Miami Beach Code Section 8-3 entitled "Schedule of Permit Fees" providing
for an increase of 30% in permit fees. Since the adoption of the said ordinance, for almost
11 years, there have been no increases in permit fees. Since the permit fees have not
been increased, the fees currently charged also have not been adjusted for inflation and do
not reflect the increased personnel cost, and therefore, the full cost of services provided
are not being recovered.
The Consumer Price Index (CPI) has increased 32% between September of 1992 and
March 2003. Separately, the City contracted with JRD & Associates, who has analyzed the
fire permit fees and compared them to similar fees charged by other municipalities, and
has recommended a 15% across the board increase, and where necessary, recommended
additional increases to make fees comparable with other municipalities. A 15% increase
will yield approximately $28,000 for each fiscal year, which is still less than the cost of the
plan review services.
On July 16, 2003, the City's Finance and Citywide Projects Committee discussed the Fire
Department fees and agreed that fees should be increased by fifteen percent. The
Committee voted to amend the fire permit fee ordinance by: 1) increasing fees in order to
recover some of the cost associated with providing the Fire Department services; and 2)
maintain fees in line with what other comparable municipalities are charging for like

services.
In addition to the increase of existing fees, the following fees have been created to recover
some of the cost associated with the new construction permitting services.
The Fire Department conducts plan review, inspection, and testing of new fire alarm
systems. However, fees have not been charged for the work performed by the Fire
Department. The current fee charged for a fire alarm system is to fund the electrical
plan review and electrical inspection, which accounts for approximately ten percent of
the work.
The Fire fee will be as follows:
o $30.00 Fire Alarm Panel
o $3.00 per device (strobe, pull station, speaker, etc.)
o Acceptance Test:
· 1-2 Floors $50.00
· 3-5 Floors $75.00
· 6 or More $150.00
When a contractor requests a Temporary Certificate of Occupancy (TCO), the fire
inspector must conduct an inspection in addition to the final inspection. Currently, the
Fire Department does not charge for this extra inspection. The Building Department
collects a fee equal to 50% of the final Certificate of Occupancy fee, which averages
$250.00. The proposed Fire Department fee would be $50.00, which is substantially
less than the TCO fee charged by the Building Department.
The Administration has drafted an amendment ordinance to the fire permit fees taking all
