A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA,AUTHORIZING THE ADMINISTRATION TO
USE IDENTIFIED FUNDS, IN THE AMOUNT NOT TO EXCEED $111,000,
FOR THE PURPOSE OF PRINTING AND INSTALLING STOREFRONT
COVERS CITYWIDE IN FURTHERANCE OF THE CITY OF MIAMI BEACH
VACANT STOREFRONT COVER PROGRAM; AND FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY RELATED
AGREEMENTS.
WHEREAS, on May 9, 2012, the Mayor and City Commission enacted Ordinance
No. 2012-3767, creating section 138-140 of the City Code, to encourage and regulate the
screening of vacant storefront windows and doors of ground floor business
establishments with aesthetically compatible and attractive material and to allow
temporary signs to be included in this material; and
WHEREAS, in adopting the regulations, the City Commission found that vacant
storefronts create an appearance of blighted economic conditions that are contrary to the
healthy and robust character desired in the commercial business districts; and
WHEREAS, on April 13, 2016,the Mayor and City Commission enacted Ordinance
No. 2016-4006, mandating the covering of vacant storefronts, rather than leaving this
decision to the store owner, and providing for an enforcement mechanism and penalties
for violations; and
WHEREAS, recognizing the need to immediately address vacant storefronts along
important business corridors, on October 17, 2018, the Mayor and City Commission
adopted Resolution No. 2018-30531, authorizing the Administration to utilize identified
funds, totaling $36,000, for the purchase of storefront window coverings in the North
Beach area; and
WHEREAS, on October 9, 2018, the Mayor's Blue Ribbon 41st Street Committee
adopted a motion to appropriate $40,000 of its FY 2019 identified funds for use in
conjunction with an initiative with Design and Architecture Senior High (DASH) students
to develop graphic designs for use in storefront covers along the 41st Street corridor; and
WHEREAS, on May 8, 2019, the Mayor and City Commission adopted Resolution
No. 2019-30810, approving the use of five specific artistic designs created by DASH
students for use in the City's vacant storefront covers; and
WHEREAS, on September 25, 2019, the Mayor and City Commission adopted
Resolution No. 2019-31004, approving a budget enhancement, in the amount of$35,000
for FY 2020, to address vacant storefronts in the South Beach area; and
WHEREAS, Section 138-140 of the City Code places sole responsibility for
installing storefront covers on the property owner, however, the Administration desires to
act quickly to address vacant storefronts and use available funds to install the DASH
designs throughout the City in preparation for the holiday season and 2020 Super Bowl;
and
WHEREAS, the funding for this Program, a combined amount of $111,000, has
been budgeted in connection with the printing and installation costs associated with the
Storefront Cover Program and does not require identification of new funding sources; and
WHEREAS, the City Commission has expressed that the covering of vacant
storefronts continues to be an issue of increased importance, therefore, the
Administration recommends use of the foregoing identified funds to subsidize both the
printing and installation of storefront covers in certain prominent commercial areas
throughout the City; and
WHEREAS, the Administration recommends proceeding with the Program until
this identified funding source has been depleted and, unless alternative funding sources
can be identified to continue subsidizing the Program, the vacant storefront property
owners would continue to assume responsibility for the printing and installation costs of
storefront covers.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the Administration to use identified funds, in the amount
not to exceed $111,000,for printing and installing storefront covers citywide in furtherance
of the City of Miami Beach Vacant Storefront Cover Program; and further authorize the
City Manager to execute any related agreements.

RECOMMENDATION
Authorize the Administration to utilize previously-identified funds to print and install storefront
covers in vacant storefronts citywide.
BACKGROUND/HISTORY
On May 9, 2012, pursuant to Ordinance No. 2012-3767, the City Commission declared that it
was in the interest of the public health, safety, and welfare to establish policies and regulations
relating to vacant storefront windows and doors. In adopting the regulations, the City
Commission found that vacant storefronts create an appearance of blighted economic
conditions that are contrary to the healthy and robust character desired in the commercial
business districts; and
On April 13, 2016, pursuant to Ordinance No. 2016-4006, the City Commission mandated that
the covering of vacant storefronts by private property owners was no longer voluntary, and the
City Commission enacted an enforcement mechanism and penalties to hold property owners
accountable for compliance.
ANALYSIS
Recognizing the need to immediately address vacant storefronts along important business
corridors, on October 17, 2018, pursuant to Resolution No. 2018-30531, the City Commission
authorized the Administration to utilize identified funds totaling $36,000 for the purchase of
storefront window coverings in North Beach.
On October 9, 2018, the Mayor's Blue Ribbon 41st Street Committee adopted a motion to

Whereas the applicable ordinance, Section 138-140 of the City Code, places sole
responsibility for installing storefront covers on the property owner, the Administration desires to
act quickly in addressing vacant storefronts and use available funds to install the DASH designs
throughout the City as we prepare for the holidays, Super Bowl, and beyond.
FINANCIAL INFORMATION
The combined total of funds to be spent is $111,000. The Program's funding has been
budgeted for and does not require identification of new funds. Staff is seeking authorization to
spend funds previously allocated to the Storefront Cover Program.
CONCLUSION
Given that the City Commission has expressed that the covering of vacant storefronts continues
to be an issue of increased importance, the Administration recommends that the City use the
foregoing identified funds to subsidize the costs of both printing and installation of storefront
covers throughout the City. The Administration further recommends that, after depletion of the
initial funding outlined above, unless alternative funding sources can be identified to continue
subsidizing the Program, the storefront property owners should assume responsibility for the
printing and installation costs of storefront covers.
