A RESOLUTION OF THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
AUTHORIZING THE FILING OF AN APPLICATION FOR A
GRANT AND IF FUNDED, AUTHORIZING THE BUDGETING
AND EXPENDITURE OF FUNDS UNDER THE STATE OF
FLORIDA, FLORIDA INLAND NAVIGATION DISTRICT, FOR
FUNDING OF EQUIPMENT FOR THE CITY OF MIAMI BEACH
POLICE DEPARTMENT MARINE PATROL.
WHEREAS, the City of Miami Beach Police Department operates a
Marine Patrol Unit for the benefit of the citizens of the City of
Miami Beach; and,
WHEREAS, the City of Miami Beach Police Department Marine
Patrol requires specialized law enforcement and safety equipment
and is unable to acquire this equipment with general revenue
funding; and,
WHEREAS, the State of Florida, Florida Inland Navigation
District (F. I.N.D. ) has funds available for this equipment; and,
WHEREAS, the total estimated funds necessary for thisproject
is $44 , 366 . 00 and the Florida Inland Navigation District' s
financial assistance is required.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
Section 1. The City of Miami Beach Police Department through
the Office of the City Manager, is authorized and directed on
behalf of the City Commission to make application to the State of
Florida, Florida Inland Navigation District for the funding for the
purchase of specialized law enforcement and safety equipment. If
funded, the City of Miami Beach Police Department, through the
Office of the City Manager, is authorized and directed to budget
and expend the grant funds.
Section 2 . The City Commission endorses the application in
the amount of $44 , 366. 00 and there is no cash match required for
this project from the City of Miami Beach.
Section 3 . The City of Miami Beach Police Department
certifies that it will accept the terms and conditions set forth in
the Project Agreement for any assistance awarded under the proposal
for grant funds.
Section 4 . The City of Miami Beach Police Department is in
complete accord with the proposal and will carry out the program in
the manner described in the proposal and any plans and specifi-
cations thereto unless prior approval for any change has been
received.
Section 5. The City of Miami Beach Police Department will not
discriminate against any person on the basis of race, color or
national origin in the use of any property of facility acquired or
developed pursuant to this proposal, and shall comply with the
terms and intent of the Title VII of the Civil Rights Act of 1964 ,
P.L. 88-352 (1964) and design and construct all facilities to
comply fully with statutes relating to accessibility by handicapped
persons as well as other federal, state and local laws, rules and
requirements.

maintainadequate financial records on the proposed project to
substantiate claims for reimbursement.

ADMINISTRATION RECOMMENDATION
The Administration hereby recommends that the City Commission
authorize the filing of an application for a Grant under the
Florida Inland Navigation District Waterways Assistance Program for
the purchase of specialized law enforcement and safety equipment
for the Miami Beach Police Department.
BACKGROUND
The Florida Inland Navigation District Waterways Assistance Program
has funding available to local governments who are impacted by
waterways under their jurisdiction.
This Grant would fund $44,366.00 toward the purchase of specialized
law enforcement and safety equipment for the Police Department's
Marine Patrol Unit. The equipment consists of navigational
equipment, rescue/recovery equipment including scuba tanks, wet
suits, etc. , any law enforcement equipment, including speed
detection devices.
There is no cash match required by the City.
ANALYSIS
The Grant funds would greatly assist the Police Department's Marine
Patrol Unit in fulfilling its mission. Funding for this equipment
is not available through general revenue sources.
CONCLUSION
This project will benefit the City through the funding and purchase
of $44, 366.00 worth of specialized equipment the City would other-
wise not be in a position to acquire.

PROJECT NARRATIVE
DESCRIPTION OF PROPOSED PROJECT
OVERVIEW
This project will assist the Miami Beach Police Department in
purchasing state-of-the-art equipment, specifically designed to aid
and assist the City of Miami Beach Police Department in Marine Law
Enforcement and Safety. The equipment will be utilized by Miami
Beach Police Marine Patrol officers in the Atlantic Ocean, Biscayne
Bay, waterways and canals that fall within the jurisdictional
boundaries of our city and will be available to assist other
departments through our Mutual Aid and Assistance Agreements.
One of the major impacts of this project will be the assistance
rendered to the Florida Marine Patrol (FMP) . Our assistance will
be in the areas of Education and Enforcement of the Manatee
Protection Act, Boating Accident Investigations, Boating Safety to
include free non-enforcement Safety Inspections, Crime Scene
Investigations - above and below the water, Criminal
Investigations, including Boat Thefts, Motor Thefts, etc. ,
hurricane preparedness and evacuation and any other type of
assistance needed.
PROBLEM STATEMENT
According to 1991 statistics from the Florida Marine Patrol (FMP) ,
our state had 687 , 042 registered pleasure boats in operation,
excluding most sailboats and out-of-state boaters. Of these, Dade
County registered 50, 683 boats - 49, 360 pleasure craft and 1, 323
commercial vessels. The director of the FMP has stated "we are
going to have to realize the waterways, just like our highways, are
becoming congested. " This flood of vessels can lead to deadly
consequences, especially with many boaters lacking experience or
consuming alcohol or both.
In 1991, Florida led the nation in boating accident fatalities at
a rate of twice the national average. Our marine patrol officers
must constantly deal with the grisly consequences of unsafe
boating. In 1991, three (3) persons were killed in a boating
accident that occurred within our jurisdiction. The accident
occurred late at night and alcohol consumption was a causal factor.
The FMP believes that the number of boating accidents can be
greatly reduced through education and mandatory licensing of vessel
operators. Since mandatory licensing is a complex and
controversial issue, requiring legislation, public hearings, and
rule development, it will be a long time before its implementation
will yield any significant results. In the meantime, it is
apparent that timely and relevant boating education, either formal
classroom instruction or "on the spot" education from boating law
enforcement officers, will have the greatest, immediate impact in
reducing the boating accident and fatality statistics.
The City of Miami Beach is an island city located in Eastern Dade
County. It is comprised of a land area of 7 . 1 square miles, has a
water area of 10. 0 square miles and a waterfront area (coastline)
of 63 . 26 miles. The city is bordered on the east by the Atlantic
Ocean, on the west by Biscayne Bay, on the north by the City of
Surfside and Haulover cut and on the south by Government cut. The
city is inundated with canals, waterways, and creeks. Hundreds and
hundreds of pleasure and commercial vessels traverse through the
city each day.
In 1991, the Department of National Resources (DNR) adopted rules
16N-22 . 002 , 16N-22 . 003 , and 16N-22 . 004, F.A.C. Essentially, these
rules provide for the Protection of Manatees and their habitats.
We fully support and applaud the efforts to preserve this resource,
however, there is going to be a definite impact on the City of
Miami Beach. These rules, among other things, restrict the speed
of boats traversing the Intracoastal Waterway.
The enactment of these rules has had a definite impact on the City
of Miami Beach. Primary, the North/South traffic in Northern
Biscayne Bay from the Intracoastal Waterway to the Meloy Channel,
which follows the Western shoreline of the City of Miami Beach.
Meloy Channel was not designed to handle the amount or type of
traffic, that will divert in order to take advantage of the 30 MPH
speed limit.
The Meloy Channel is a winding, narrow, poorly-marked channel,
which is not lighted, and it is very close to the shoreline. The
Channel has no buffer, therefore, vessels travelling at speeds of
30 MPH or more would create an acute safety hazard.
The rule enactment also created a substantial increase in the noise
level along the Channel. Given the closed proximity of the channel
to the shoreline, combined with the fact that the area along the
shoreline is entirely residential, the area residents have
complained vigorously about the increase in traffic and the
accompanying noise levels.
The areas designated for skiing, south of the 79th Street Causeway,
the basin north of the Sunset Islands, and the waters around the
Flagler Memorial , all of which fall within our jurisdiction. The
City is currently receiving complaints from residents in these
areas about the noise and the congestion of boat traffic.

The City of Miami Beach Police Department which is responsible for
patrolling the Channel for enforcement and inspection services, is
overburdened. The Miami Beach Police Department does not have the
available resources to adequately patrol this area.
The Rigid Hull Inflatable (RHI) purchased by the City last year
cannot be kept in a "ready" state as it must be stored on a
trailer. The acquisition of the davits will enable the Department
to maintain the RHI in a ready state.
The Department has five (5) certified police divers who will
utilize this equipment.
PROJECT GOAL AND OBJECTIVES
The goal of this project is to promote boating safety through
direct contact with boaters on the waterways.
This goal will be accomplished through the following project
objectives:
1. Provide an enhanced public education of boating safety
through personal contacts and vessel safety inspections
offered at the public boat ramp located next to the
marine units office.
2 . Assist disabled or distressed boats.
3 . Provide routine patrol of the public waterways, including
enforcement of manatee speed zones.
4 . Seek out and remove or report obstructions and hazards to
navigation and safe boating.
5 . Investigate marine related accidents and incidents.
6. Assist other governmental agencies in marine related
matters.
7 . Perform underwater rescue, search, and recovery missions
as required or requested by appropriate authority.
8 . Assist in underwater crime scene investigation as
necessary.
PROJECT PLAN ACTIVITIES
Upon receiving the funding approval from F. I.N.D. , the City of
Miami Beach Police Department will undertake the following project
activities and accomplish them in accordance with their designated
funding year quarter:

REASON WHY F.I.N.D. SHOULD SUPPORT THIS PROJECT
This proposed project is consistent with the purpose of Chapter
16T-2 of the Florida Administrative Code (FAC) by addressing two
problems associated with the use of the waterways in South Florida,
namely boating safety education and law enforcement.
The Florida legislature has authorized financial assistance,
support, and cooperation to eligible local governments in the
planning and carrying out of projects directly related to the
waterways. In our opinion, this proposed project meets the
criteria established under section 16T-2 . 008 of the FAC.
Furthermore, our city is a legally constituted local government,
and there is sufficient funding from Dade County ad valorem tax
collections to make funding allocations available for this project.
In addition, F. I.N.D. established a precedent for providing funding
assistance for similar boat and equipment projects when they
awarded grants to the South Indian River County Fire District
(1988) the City of Ft. Lauderdale (1989) and the City of North
Miami Beach (1991) .
Without F. I.N.D. ' s financial support, our planned project
activities will be delayed by many years. Our City and Police
Department is not budgeted for a capital outlay project of this
type, and past attempts to obtain a boat and equipment through
other means have been unsuccessful. With F. I.N.D. ' s support, we
will be able to proceed as planned, and provide a valuable service
to the boating public.
STATEMENT OF DIRECT RELATIONSHIP OF THE PROJECT
TO THE WATERWAY
This boating safety and enforcement project is directly related to
the safe operation of vessels on the waterways of this state.
At a recently conducted IPTM course on Techniques of Boating Law
Enforcement, Captain Alan Richard, FMP Boating Safety Division,
stated that "the ultimate goal of boating law enforcement is to
increase deterrence and decrease accidents, injuries, and death. "
He further stated that "the only way to have increased deterrence
is to increase the risk of getting caught violating the law. "
The enhance services on the waterways will have a positive,
deterrent effect on boaters who may commit boating safety and
operation violations. The net effect will be a safer boating
environment, especially on the congested ICW, decreased property
damage from wake impact against docks, piers, seawalls, and other
boats, and reduction of litter that is thrown into the water from
environmentally inconsiderate boaters.

In addition, the Marine Patrol Unit, with its rescue and recovery
equipment and specially trained staff, will be able to provide
immediate and possibly life-saving assistance to boaters and their
passengers should an emergency occur on the waterway within our or
a nearby jurisdiction.
STATEMENT OF PROJECT BENEFITS TO PUBLIC NAVIGATION
IN THE DISTRICT AND POTENTIAL PUBLIC USAGE
The project benefits to public navigation will be realized through
the creation and maintenance of a safer boating environment in the
Dade County area. Pleasure and commercial vessels will be able to
travel our waterways with the knowledge that boating and navigation
laws and rules will be enforced, that floating and submerged
obstacles to boating will be noted, reported, and removed in a
timely manner, that emergency assistance can be provided
immediately, that reckless and careless boating operations can be
controlled, that littering of the waterways will be enforced, that
property damage will be reduced, and that boating can be
accomplished in a safe manner, thereby reducing the chance of being
involved in a boating accident.
