A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A
DATE AND TIME FOR HEARING AN APPEAL FROM A
DECISION OF THE JOINT DESIGN REVIEW/HISTORIC
PRESERVATION BOARD GRANTING A CERTIFICATE OF
APPROPRIATENESS AND DESIGN REVIEW APPROVAL FOR
CONSTRUCTION OF A TOWNHOUSE COMPLEX AT 1017
MERIDIAN AVENUE AND IMPOSING CERTAIN
CONDITIONS FOR THE APPROVALS, INCLUDING THE
ELIMINATION OF A PROPOSED CURB CUT ON MERIDIAN
AVENUE.
WHEREAS, an application was submitted to the Planning, Design
and Historic Preservation Services Division requesting a
Certificate of Appropriateness and Design Review Approval for
construction of a townhouse complex at 1017 Meridian Avenue, Miami
Beach, Florida; and
WHEREAS, on May 11, 1993 , the City' s joint Design
Review/Historic Preservation Board granted the applicant' s request,
imposing certain conditions upon its approval of the project, which
conditions included the elimination of a proposed curb cut on
Meridian Avenue; and
WHEREAS, on June 8, 1993 , the joint Board heard the
applicant' s request for reconsideration of the conditions of
approval so as to allow for the proposed curb cut on Meridian
Avenue, and the Board voted to deny the applicant' s request for
construction of the curb cut; and
WHEREAS, pursuant to Subsection 18-2 of the City' s Zoning
Ordinance, an applicant may appeal a decision of the joint Design
Review/Historic Preservation Board regarding the granting or denial
of a request for a Certificate of Appropriateness and Design Review
Approval to the City Commission; and
WHEREAS, the applicant has appealed the Board' s decision to
grant approval conditioned upon elimination of the proposed curb
cut to the City Commission; and
WHEREAS, pursuant to Subsection 18-2 of the City' s Zoning
Ordinance, the Mayor and City Commission must hear the appeal and
render a decision regarding this matter.

SUBJECT: RESOLUTION SETTING DATE AND TIME OF APPEAL OF DESIGN
REVIEW/HISTORIC PRESERVATION BOARD DECISION REGARDING THE
GRANTING OF A CERTIFICATE OF APPROPRIATENESS AND DESIGN
REVIEW APPROVAL FOR CONSTRUCTION OF A TOWNHOUSE COMPLEX
AT 1017 MERIDIAN AVENUE.
Pursuant to Subsection 18-2 of the City's Zoning Ordinance,
decisions of the City's joint Design Review/Historic Preservation
Board regarding the granting or denying of a Certificate of
Appropriateness and Design Review Approval may be appealed to the

City Commission. On May 11, and June 8, 1993 , the joint
Boards granted a Certificate of Appropriateness and Design Review
Approval for construction of a townhouse complex at 1017 Meridian
Avenue. These approvals were conditioned upon the applicant's
making several changes in the proposed plans, including elimination
of a curb cut at Meridian Avenue. Pursuant to Subsection 18-2 , the
applicant has appealed the joint Board' s decision to the City
Commission. The Mayor and City Commission are now required to
hear the appeal and render a decision regarding this matter.
The attached Resolution will establish a date and time for
consideration of this appeal.

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission will consider an appeal of a decision of the City' s
joint Design Review/Historic Preservation Board granting a
Certificate of Appropriateness and Design Review Approval for
construction of a townhouse complex at 1017 Meridian Avenue and
imposing certain conditions for the approvals including the
elimination of a proposed curb cut on Meridian Avenue, in their
chambers on the Third Floor of City Hall, 1700 Convention Center
Drive, Miami Beach,Florida, on July 28 , 1993 , beginning at
3:30 p .m.
PASSED and ADOPTED this 14th da of July , 1993.
