A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL
AGREEMENT WITH DADE COUNTY, THE CITY OF MIAMI,
AND THE CITY OF HIALEAH; AGREEING TO A FORMULA
FOR DISTRIBUTING THE PROCEEDS AND USES FOR UP
TO AN ADDITIONAL FIVE CENTS OF LOCAL OPTION
GAS TAX LEVIED BY DADE COUNTY UNDER SECTION
336. 025, FLORIDA STATUTES, FOR THE LIFE OF THE
CAPITAL IMPROVEMENTS LOCAL OPTION GAS TAX.
WHEREAS, Section 336 . 025, Florida Statutes authorized
counties, by referendum or ordinance, to levy up to an additional
five cents of local option gas tax to be used for transportation
needs in the capital improvement element of an adopted
comprehensive plan; and
WHEREAS, on May 5, 1993 , the Mayor and City Commission
authorized the City Manager to enter into negotiation with Dade
County for the distribution formula for up to an additional five
cents of gas tax; and
WHEREAS, the City Manager along with representatives of other
municipalities in the Dade County and the Dade League of Cities
have been actively negotiating a distribution formula with the
County Administration; and
WHEREAS, on July 15, 1993 , the Dade County Board of County
Commissioners, sitting as the Metropolitan Planning Organization
(MPO) , approved a distribution formula agreed upon by the
representative of the cities and the County administration.
NOW, THEREFORE, BE IT DULY RESOLVED, BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Clerk are authorized to execute an Interlocal Agreement,
attached hereto as Exhibit "A" , with Dade County, the City of
Miami, and the City of Hialeah, agreeing to the formula for
distribution and uses of up to an additional five cents of local
option gas tax, as authorized under Section 336. 025, Florida
Statutes, for the life of the Capital Improve =nts Local Option Gas
Tax.

IMPROVEMENTS LOCAL OPTION GAS TAX
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the
attached Resolution which authorizes the Mayor to enter into an
interlocal agreement with Dade County, the City of Miami, and the
City of Hialeah, governing the distribution and uses of up to an
additional five cents of local option gas tax, as authorized by
Section 336. 025, Florida Statutes and contained herein as
Attachment "A" .
BACKGROUND:
Section 336. 025, Florida Statutes, authorizes counties, by
ordinance or referendum, to levy additional gas taxes of up to five
cents (5 ) per gallon to be used for transportation needs in the
capital improvement element of an adopted comprehensive plan.
Distribution of these taxes may be accomplished by an interlocal
agreement between the municipalities representing the majority of
the population of the incorporated area of the county.
The Statute further states that, for the first year, the tax must
be imposed by November 1, 1993 to be effective January 1, 1994 . In
addition, any interlocal agreements, if necessary, must be entered
into prior to September 1, 1993. If there is no interlocal
agreement, Florida Statutes require that distribution be by a
formula of actual transportation expenses during the past five
years. Under this default formula, Dade County could receive up to
90% of the total proceeds.
On May 5, 1993 , the City Commission authorized the Mayor to enter
into an interlocal agreement for renewing the existing six cents of
local option gas tax for the period June 1, 1993 to May 31, 1998 .
At the same meeting, the Commission also authorized the City
Manager to negotiate a distribution formula that would be more
advantageous to the cities if the County were to enact up to an
additional five cents of gas tax.
Since then, the Administration along with representatives from
other cities and the Dade League of Cities have met on numerous
occasions with the County to negotiate the distribution formula.
On July 15, 1993 , a tentative distribution formula was agreed upon
by the representatives of the cities and the County and approved by
the Board of County Commissioners sitting as the Metropolitan
Planning Organization (MPO) . AGENDA

2-PROPOSED DISTRIBUTION FORMULA
The proposed provisions for distribution of up to the additional
five cents (5 ) local option gas tax is as follows:
1. Seventy-four percent (74%) to the County and twenty-six
percent (26%) to cities until such time that a general
obligation transportation bond issue (Dade 2000) is placed on
the ballot.
A. If the general obligation transportation bond issue (Dade
2000) is approved by referendum, the cities ' share would
increase to 33%.
B. If the general obligation transportation bond issue (Dade
2000) is not approved by referendum, the cities ' share
would decrease to 20%.
2 . The cities ' share would be divided on a formula weighted 75%
for population and 25% for centerline miles of roadway
maintained by the municipality.
3 . The County is required to spend a minimum of 20% of the total
net proceeds in the unincorporated areas of the County with
such amounts coming from the County 74% share.
4 . Expenditures of the additional up to five cents of local
option gas tax would be subject to audit and review by the
County Commission.
5. Provisions for the distribution of the additional gas tax
shall not affect the distribution of the existing six (6)
cents of gas tax.
ANALYSIS:
The recommended formula of "26/74" for the entire five cents of gas
tax would provide the City of Miami Beach with an estimated $1
million annually to be used for transportation needs in the capital
improvement element of an adopted comprehensive plan. This is in
. addition to the $1. 2 million received annually from the first six
cents of gas tax.
If the County' s proposed general obligation transportation bond
issue (Dade 2000) is approved by voter referendum, the City of
Miami Beach share would increase to $1. 3 million annually. If on
the other hand, the proposal is not approved, the City of Miami
Beach share would decrease to $769, 230.
CONCLUSION:
The City' s plan for future development and returning to fiscal
health includes greater utilization of local option gas tax funds
for the repair and maintenance of local roadways and rights-of-way.
In order to ensure that additional funds are obtained, it is
necessary that the interlocal agreement between Dade County, the
City of Miami, the City of Hialeah, and the City of Miami Beach be
approved.

INTERLOCAL AGREEMENT
This agreement entered into this day of J6c(7.v
1993 , by and between Dade County, Florida, a political subdivi-
sion of the State of Florida and the signatory municipalities
representing a majority of the population of the incorporated
area of Dade County.
WITNESSETH
WHEREAS, Section 336 . 025, Florida Statutes (1993) authorized
counties to impose, in addition to other local gas taxes, up to a
five cent local option gas tax upon motor fuel for capital
improvements associated with the capital improvements element of
an adopted comprehensive plan; and
WHEREAS, if imposed and levied, Dade County proposes to
impose and levy said tax under the procedures of Section 336 . 025
(1) (b) (2) , Florida Statutes (1993) or Chapter 93-206 , Laws of
Florida;
NOW THEREFORE in consideration of the covenants contained
herein, the receipt and adequacy of which are hereby acknowledged
by all parties hereto, it is agreed as follows :
1 . This agreement shall become effective upon its approval
by the governing bodies of the County and of municipalities
representing a majority of the population of the incorporated
area of Dade County and upon imposition of the capital improve-
ments gas tax and shall be in effect for the life of the capital
improvements local option gas tax.

2 . Should Dade County impose and levy a local option gas
tax of up to five cents effective January 1 , 1994 , the net
proceeds thereof shall be allocated on the basis of 74 percent to
the County (the County portion) and 26 percent to all eligible
incorporated municipalities (the Municipal portion) in Dade
County, Florida pursuant to Section 336 . 025 ( 6 ) , Florida Statutes,
( 1993) . If the transportation component of a general obligation
bond issue, e.g. , Dade 2000, is approved by the voters, the
cities ' portion of the tax collected will increase to 33 percent
and the County' s portion will decrease to 67 percent; however, if
the transportation component is rejected by the voters , the
municipal portion will be reduced to 20 percent and the County' s
portion will increase to 80 percent . Net proceeds shall mean the
local option gas tax collected by the Florida Department of
Revenue (DOR) less the administrative cost retained by the DOR as
provided in Section 215 . 20, Florida Statutes ( 1993) . Any change
to the distribution between the County and the cities based upon
the success or failure of the transportation component of a
general obligation bond program will be effective on the
September 1, immediately following such referendum.
3 . Not less than twenty percent of the net proceeds
collected shall be utilized by the County for municipal
transportation services in unincorporated Dade County and shall
be taken from the County' s share of the tax proceeds .
4 . The Municipal portion of the local option gas tax shall
be distributed among the eligible incorporated municipalities in
Dade County, Florida, based on a formula as follows :
a. Seventy-five percent based upon the ration of the

population of each eligible incorporated munici-
pality compared to the total population of all
eligible incorporated municipalities in Dade
County; and
b. Twenty-five percent based upon the ratio of total
centerline miles of roadway maintained by each
eligible incorporated municipality compared to the
total centerline miles maintained by all eligible
incorporated municipalities in Dade County.
5 . Population figures shall be based on the figures used
to determine the annual distribution of the half cent local
government sales tax pursuant to Section 218 . 60 (1) (a) , Florida
Statutes (1992) . Centerline mile figures shall be based upon
yearly figures submitted by each municipality to the Department
of Banking and Finance in their Annual Financial Report and
recorded by the Florida Department of Transportation as required
by Section 218 . 32 (1) (a) and (4) , Florida Statutes (1992) . The
population and centerline mile figures shall be updated annually
with data current as of June 1 of each year.
6 . The percentages for distribution shall be calculated by
the County annually. By July 1 of each year, the County shall
notify all municipalities and the appropriate State agencies of
the percentages for distribution of the capital improvements
local option gas tax proceeds among the municipalities for the
upcoming annual period commencing September 1 . The percentage
for distribution of capital improvements local option gas tax
proceeds to any city whose current population or centerline mile

figures are not available shall be determined by the County based
on the most recent available population and/or centerline mile
figures reported to the State . Any change in percentage
distributions required by section 2 above shall be reported to
the State by the first of July, following the general obligation
bond referendum.
7 . Pursuant to Section 336 . 05 (b) , Florida Statutes
(1993) , disputes regarding the percentages of distribution to any
municipality hereunder shall be resolved through an appeal to the
Administration Commission in accordance with procedures developed
by the Commission. Pending final disposition of such proceed-
ings, the tax shall be collected and such funds shall be held in
escrow by the Clerk of the Circuit Court of the County until
final disposition is made .
8 . In accordance with Section 336 . 025 , Florida Statutes
(1993) , as amended by the 1993 Legislature, the net proceeds of
the capital improvements local option gas tax (not to exceed five
cents) shall only be used for transportation expenses needed to
meet requirements of the Capital Improvement Element (CIE) of an
adopted comprehensive capital plan. Transportation expenses
shall be limited to the programs defined in Florida Statutes
336 . 025 (7) .
9 . The provisions contained herein shall in no way affect
the distribution provisions of the interlocal agreement governing
the existing six cent local option gas tax imposed pursuant to
Florida Statutes 336 . 025 .

10 . By June 1st of each year, to be eligible for gas tax
funds, each city must certify to the County that they are using
the tax proceeds in accordance with Section 336 . 025 ( 1 ) (b) ( 3 ) ,
Florida Statutes ( 1993) . Said certification is to include a list
of projects in the CIE of the city' s adopted comprehensive plan
and indicate which projects are to be funded with the proceeds of
this local option gas tax. This certification will be forwarded
to the Metropolitan Planning Organization. If a city fails to
meet the certification requirements, the portion of the tax that
is due to them shall be distributed to the remaining eligible
cities based on the distribution formula for the municipal share
of the tax proceeds .
11 . The Board of County Commissioners may, at its
discretion, request an audit of funds allocated pursuant to this
agreement to assure funds are utilized in accordance with State
law.

WHEREAS, this Board desires to accomplish the purposes
outlined in the accompanying memorandum, a copy of which is
incorporated herein by reference,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF DADE COUNTY, FLORIDA, that this Board approves
the Interlocal Agreement between Dade County and municipalities
representing a majority'orit of the population of the incorporated

As with the existing six-cent local option gas tax, the county
may, prior to imposition of the tax, establish by interlocal
agreement a distribution formula for dividing the tax proceeds
between the County and eligible municipalities.
To distribute the tax proceeds based upon an interlocal agree-
ment, only Miami and either Hialeah or Miami Beach are required
as signatories to meet the statutory requirement as representa-
tives of a majority of the incorporated area population of Dade
County.
The attached interlocal agreement contains the mutually accepted
terms and conditions reached after negotiations with representa-
tives of the above cities and the Dade League of Cities. In
order for the tax to be effective in FY 1993-94 with an
interlocal agreement the statutes require that this agreement be
executed prior to September 1, 1993 and approvals are being
sought within this time frame .
If an interlocal agreement has not been executed prior to
September 1, 1993 , the County Commission may proceed with
agreement . In P FY 1993-94 without an imposition of the tax for
this situation, the Commission must levy and impose the tax by
November 1, 1993 to be effective January 1, 1994 and an alter-
nate formula must be utilized that distributes the gas tax to
the County and eligible municipalities in proportion to their
actual transportation expenditures over the preceding five
fiscal years. If this method is used, Dade County would be
entitled to approximately 90 percent of the proceeds rather than
the shares we have negotiated with the cities .
Approval of the attached resolution would indicate the County' s
intent to distribute the proceeds of the five cent capital
improvements local option gas tax as outlined in the attached
interlocal agreement . Your approval of this resolution is
required at this time in order to allow for execution of the
agreement prior to the deadline of September 1, but following
concurrence by Miami Beach (7/28/93) , Miami (7/22/93) and
Hialeah (8/10/93) .

WHEREAS, the City of Hialeah has entered into an Interlocal Agreement with

cents ($0.06) Local Option Gas Tax in effect through August of 1998, passed and adopted
by the Boarcipf_County Commissioners pursuant to.Section 336.025, Florida Statutes;
and
WHEREAS, the City of Hialeah, City of Miami, City of Miami Beach, and other
municipalities are currently negotiating with Metropolitan Dade County for a more
equitable distribution of Local Option Gas Tax money to municipalities should
Metropolitan Dade County pass an additional Local Option Gas Tax up to five cents
($0.05), given that the Florida Legislature passed and adopted legislation earlier this
Spring allowing the counties to impose said additional five cents ($0.05) Local Option Gas
Tax; and
WHEREAS, an additional five cents ($0.05) Local Option Gas Tax would
generate approximately $35 Million Dollars in Dade County; the amount of funding that
would be allocated to the City of Hialeah under the current distribution formula (74% to
counties, 26% to municipalities) is approximately $1.9 Million Dollars; any additional
percentage negotiated and agreed to by Administration would be over and above said $1.9
Million Dollars; and
WHEREAS, time is of the essence in this matter, given that the Hialeah City
Council is on vacation during the month of July, 1993, and the City Commissions for the
Cities of Miami and Miami Beach are on vacation during the month of August, 1993.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY

WHEREAS , on July 15 , 1993 , the Board of County Commissioners
of Dade County reached an agreement with the municipalities which

WHEREAS , Florida Statutes require that said Interlocal
Agreement must be executed by the municipalities prior to

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI , FLORIDA:
Section 1 . The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to
execute an Interlocal Agreement , in substantially the attached
form, with Metropolitan Dade County ( "Dade County" ) and
municipalities representing a majority of the population of the
incorporated areas of Dade County to provide to said
municipalities a portion of the proposed Dade County Optional Gas
Tax, said authorization contingent upon Dade County imposing and

WHEREAS, Section 336.025,
Florida Statutes (1993) ,
a local
authorizes counties to levy option gas tax upon motor
fuel and special fuel, not to
exceed five cents ($0.05) , said tax
in addition to the six cents ($0.06) local option gas tax now in
effect; and
WHEREAS , State law requires that the counties share the
proceeds of such a tax with municipalities; and
WHEREAS , pursuant to Resolution No. 93-337, adopted
May 27, 1993 , the City Manager
was anthoriZed to negotiate with
Metropolitan Dade County to optimize the finanoial return to the
City of Miami; and
WHEREAS, on July 15, 1993,
the Board of County Commissioners
of Dade County reached an agreement with the municipalities which
