SUBJECT: NORTH BAY ROAD
Attached, please find a response from the County to the City's request to implement the proposed
traffic modifications contained in the "Consensus Agreement" for the North Bay Road120th Street
area.
Accordingly, staff has contacted URG, the project consultant, to incorporate the requirements
requested by the County in their study of the subject area. Furthermore, the County is requesting
the City to "assume all future liabilities that may arise due to the installation of these devices." By
copy ofthis memorandum, I would request that the City Attorney review and advise as to the legal
implications and inherent liability associated with the implementation of these traffic improvements.

The Department has completed its review of the City's proposal to implement traffic control
modifications in the area of North Bay Road and 20th Street. However, prior to our approval, the
City of Miami Beach must complete a comprehensive study in order to analyze the post conditions
and also must submit a set of the construction plans for said modifications, inclusive of placement
of the proposed signage. Furthermore, the City will assume all future liabilities that may arise due
to the installation of these devices. In addition, this Department must be notified of the actual
installation date for all traffic control devices.
We look forward to our continued relationship with the City in resolving concerns of Miami Beach
residents and appreciate having had the opportunity to investigate this for you. Should you have any

Dear Mayo~ and Commissioners,
This letter is to remind you that nearly two months have
passed since you approved the final version of an agreement between
the homeowner and resident groups representing lower North Bay
Road, lower Alton Road and Sunset Islands 3 an~ 4. This agreement
basically called for certain rearrangements and restrictions on
area traffic patterns and also for the removal of the left turn
restriction at the foot of North Bay. SQ far, it does not appear
that anything has been done in this direction. The understanding
was that tb1s would be implemented within 90 days.
As you know, this agreement followed weeks of negotiating,
which we~e in turn preceded by a year ot squabbles and
misunderstandings. It would be most unfortunate if that regrettable
cycle was to repeat itself.
Time is of the eeeence for the following ~easons.
1) According to Publix officials, the old Publix will be
closed at some indeterminate date in the near future for
renovations. This closing will probably l~st for several months.
This will greatly increase trarfic 1n and out or the new Publix.
2) The talk is that when the old publix reopens, it will be as
an upscale "Bpicure-type~ market, meaning that many of ita current
customers will gravitate to the new PUb11x for economic reasons.
3) The aforementioned left turn restriction was authorized on
March 4, 1998 and implemented on March 11 as a test item, to be
removed within a period ot from 30 to 90 days, depending on
interpretation. It has now been in place for 10 months. It is
widely disregarded, and, except for brief test periods.. is not
being enforced.
