Resolution 2020-31332 RESOLUTION NO. 2020-31332 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE WRITTEN RECOMMENDATION OF THE CITY MANAGER WITH RESPECT TO PROVIDING COVID-19 RENT RELIEF TO THE COMMERCIAL TENANTS/OPERATORS OF CITY-OWNED PROPERTY, AND APPROVING THE WAIVER OF ALL RENTS AND FEES DUE TO THE CITY, IN ITS PROPRIETARY CAPACITY, FOR THE PERIOD FROM APRIL 2020 THROUGH SEPTEMBER 2020; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY AGREEMENTS TO FORMALIZE SUCH WAIVERS. WHEREAS, on March 9, 2020, Governor Ron DeSantis issued Executive Order 20-52, declaring a State of Emergency for the State of Florida related to COVID-19; and WHEREAS, on March 12, 2020, Miami-Dade County Mayor Carlos Gimenez declared a State of Emergency for all of Miami-Dade County due to the threats associated with COVID-19; and WHEREAS, on March 12, 2020, the City Manager for the City of Miami Beach, declared a State of Emergency for the City of Miami Beach, as COVID-19 poses a health risk to the City's residents, particularly elderly residents and those who are immunosuppressed or otherwise have high risk of medical conditions; and WHEREAS, on March 13, 2020,the Mayor and City Commission of the City of Miami Beach unanimously adopted Resolution No. 2020-31192, and later adopted Resolutions No. No. 2020- 31192, No. 2020-31219, No. 2020-31245, No. 2020-31246, No. 2020-31273, No. 2020-31280, No. 2020-31282, No. 2020-31284, No. 2020-31287, and No. 2020-31308 respectively, authorizing the City Manager to extend the duration of the State of Emergency and implement discretionary emergency measures deemed necessary to address the COVID-19 crisis and to protect the public health, safety and welfare of the people of the City of Miami Beach; and WHEREAS, in order to mitigate the spread of the coronavirus disease, state and local governments have enacted several restrictions to protect public welfare; and WHEREAS, since its initial declaration, Miami-Dade County issued various Emergency Orders which temporarily closed public and private facilities, including non-essential retail and commercial establishments within the County; and WHEREAS, the COVID-19 crisis has precipitously impacted businesses' revenues and local economies; and WHEREAS,to counterbalance revenue loss due to closures mandated by the County and City, the Administration suspended rents and fees from April to July 2020; and WHEREAS, COVID-19 infection rates continue to rise and plague the nation and the state, with 4,193,667 confirmed cases in the United States and 3,362 reported in Miami-Dade County reported on July 24, 2020; and WHEREAS, local and state governments will continue implementing measures and restrictions, the City Administration recommends waiving monthly payments, rent and other related fees for the period of April through September 2020. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the written recommendation of the City Manager with respect to providing COVID-19 rent relief to the commercial tenants/operators of City-owned property, and approving the waiver of all rents and fess due to the City, in its proprietary capacity, for the period of April 2020 through September 2020; and further authorizing the City Manager to execute any necessary agreements to formalize such waivers. BACKGROUND On March 12, 2020, in line with Executive Order 20-52 instituted by Governor Ron DeSantis and emergency declaration issued by County Mayor Carlos Gimenez, the City Manager declared a State of Emergency, in response to the coronavirus (COVID-19) pandemic. Since March 13, 2020, the Mayor and City Commission have adopted Resolutions No. 2020-31192, No. 2020- 31219, No. 2020-31245, No. 2020-31246, No. 2020-31273, No. 2020-31280, No. 2020-31282, No. 2020-31284, No. 2020-31287, and No. 2020-31308 respectively, authorizing the City Manager to extend the duration of the State of Emergency and implement discretionary emergency measures deemed necessary to address the COVID-19 crisis and to protect the public health, safety and welfare of the people of the City of Miami Beach. On July 24, 2020, the United States recorded over 4,193,667 confirmed cases, with 3,362 reported in Miami-Dade County. Counties and municipalities will be required to continue implementing necessary measures and restrictions for many months ahead. As businesses begin rebuilding, providing COVID-19 rent relief or waiver should be considered. The Administration recommends providing the waiver of monthly payments, rent, minimum guarantee, and other related fees to the commercial tenants and operators of the City-owned properties for the period of April 2020 through September 2020. Attachment A, attached herein, summarizes the total monthly payments, rent, and fees suspended and projected for the proposed time period. CONCLUSION: The Administration recommends accepting the written recommendation of the City Manager with respect to providing COVID-19 rent relief to the commercial tenants / operators of City-owned property, and approving the waiver of all rents and fess due to the City, in its proprietary capacity, for the period of April 2020 through September 2020; and further authorizing the City Manager to execute any necessary agreements to formalize such waivers.
