Resolution 2020-31407RESOLUTION NO. 2020-31407 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, WAIVING, PURSUANT TO ORDINANCE NO. 2018-4176, FEES ASSOCIATED WITH HISTORIC PRESERVATION BOARD REVIEW OF THE INSTALLA TION ENTITLED ETERNITY NOW, BY ARTIST SYLVIE FLEURY, AT 2100 COLLINS AVENUE, PROPOSED BY THE FRIENDS OF THE BASS MUSEUM, INC., A FLORIDA NON-PROFIT ORGANIZATION. WHEREAS, the City Code sets forth fees for development review, permitting, and other services, which fees permit the City to recover its costs for implementing the regulations contained therein; and WHEREAS, on March 7, 2018, the Mayor and City Commission adopted Ordinance No. 2018-4176 which, in pertinent part, amended Appendix A to the City Code to authorize the City Commission to reduce or waive Design Review Board or Historic Preservation Board fees for nonprofits proposing art in public places and/or non-commercial artistic murals; and WHEREAS, certain nonprofit organizations, such as The Bass Museum, desire to invest in public art installments for the benefit of City residents and visitors; and WHEREAS, The Bass Museum was established from its inception as a public/private partnership through a 1963 contractual agreement entered between the City of Miami Beach and John and Johanna Bass, whereby the City accepted the gift of the art collection of John and Johanna Bass (the "Collection"), in exchange for making the Collection open and available to the public in a building maintained by the City; and WHEREAS, The Friends of the Bass Museum, Inc. serves as the non-profit organization that oversees the management of The Bass Museum; and WHEREAS, The Bass Museum is a Miami Beach contemporary art museum that creates connections between international contemporary art and its diverse audiences, and shares the power of contemporary art through experiences that excite, challenge and educate; and WHEREAS, in 2017, The Bass Museum acquired a site-specific work of public art by artist Sylvie Fleury, entitled Eternity Now (2015), which is currently on display on the east facing façade of The Bass; and WHEREAS, on May 8, 2018, the Historic Preservation Board ("HPB") approved a Certificate of Appropriateness for the continued display of Eternity Now on top of the Bass Museum façade for up to three (3) additional years; and WHEREAS, Eternity Now is an iconic work of public art and has attracted national and international acclaim, and is a visual landmark for the Co llins Park community; and WHEREAS, The Bass Museum is required to submit a revised application for HPB review by May 2021; and Page 621 of 1855 W H E R E A S , The Bass Museum's HPB application will request that the HPB (i) delete the condition limiting the term of the approval to three (3) years, and (ii) convert the installation to a permanent exhibition; and WHEREAS, the estimated amount of the The Bass Museum's HPB application fee is $2,573.00; and WHEREAS, pursuant to Ordinance No. 2018-4176, fees associated with The Bass Museum's HPB application may be waived by Resolution of the City Commission adopted by a 4/7" affirmative vote. RECOMMENDATION Accept the waiver of, pursuant to Ordinance No. 2018-4176, fees associated with the Historic Preservation Board's review of the installation Eternity Now by artist Sylvie Fleury at The Bass Museum. ANALY SIS On May 8, 2018, the Historic Preservation Board approved The Bass Museum's Land Use Board Hearing application for the continued display of Eternity Now on the east façade of the Bass Museum for up to three (3) years. The Bass Museum is required to submit a revised application for Historic Preservation Board review by May 2021. The Bass Museum's Historic Preservation Board application will request the Historic Preservation Board remove the three (3) year term and request the work convert to a permanent exhibition. Page 618 of 1855 The Bass Museum's estimated Historic Preservation Board application fee is $2,573.00. Pursuant to Ordinance No. 2018-4176, fees associated with the Historic Preservation Board or Design Review Board may be reduced or waived by a 4/7 affirmative vote of the Mayor and City Commission via resolution. The Friends of the Bass Museum, Inc., have requested a waiver of these fees. CONCLUSION The fee waiver will assist The Bass Museum in investing in public art installations that will benefit the residents and visitors of Miami Beach. The fee waiver will reduce the fees associated with the Historic Preservation Board review of public art and/or non-commercial artistic murals, graphics and images, as per Ordinance No. 2018-4176.
