RESOLUTION NO. 97-22439
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING THE JACKIE GLEASON THEATER
BOOKING POLICY AND APPROVING THE REVISED BOOKING POLICY AS
AMENDED.
WHEREAS, the City owns the Jackie Gleason Theater of the Performing Arts (TOP}\)
and is desirous of facilitating the continued presentation of high quality entertainment eventslt
that venue; and
WHEREAS, the City has previously had in effect a Booking Policy to provide guidelim s
for the management of TOP A for facilitating the booking of such entertainment events; and
WHEREAS, the Booking Policy has not been reviewed or revised since its inception
approximately five years ago; and
WHEREAS, the Mayor and City Commission have instructed the Convention Center
Advisory Board to review said policy; and
WHEREAS, the Convention Center Advisory Board and Spectacor Management Gre UJ:
(SMG), the management company for the Jackie Gleason Theater, have reviewed and deemed
necessary revisions to the Booking Policy in order to adequately facilitate the scheduling of
entertainment events at the facility.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby amend and approve the revisions to the Jackie Gleason Theater Booking
Policy, as amended, and as same is attached and incorporated to this Resolution.

The Jackie Gleason Theater (JGT) is a regional multi-purpose theater owned by the City of Miami Beach and Ipperated by
Spectacor Management Group (SMG). The facility was rcec.~ Ic<k3ign~ and IGmodc.l~ redesi&ned and irmll!de ..~
in 1990 with the proceeds of a $22 million bond issue. The City of Miami Beach is committed to operatin,g the vel ue
according to policies which will:
. Produce the highest possible income and operate the theater in a fiscally responsible manner.
. Encourage artistic events that interest the entire community, which include, but are not limited to, Broadway 5ho' {s,
symphony presentations, ballet, opera, popular presentations and revues, etc.
. Make the JGT available to as many producers as possible so as to maximize the number of days dIning wh ch
events are held
. Contribute to the image of Miami Beach as a cultural destination and support the above policies by devl~loping I nd
implementing a strong marketing plan using the new image of the theater as a cornerstone of this effiPrt,
. Assist programs from small, local community arts groups and educational institutions by offering in(lentives.

Presenters usin& the facility shall be classified within the followin~ priorities:
First Priority - Users who contract to present at least twenty performances over at least foY\.r...Rl':.lU>tte
events in a subscription series each year for more than one year
Second Prioritv - Users who contract to present at least twenty performances over at least fO~I!.!l[~
events in a subscription series in one year
Third Priority - Users who contract to present at least four performances of a sin&le event OR"y'ws l'I!1l!!

Fourth Priority - Users who contract to present at least one performance of at least one event.

II1. Date Hold Time Frames
Tentative date holds may be placed by users accordine to the followin2:
First Priority - Dates may be placed on hold at any time in the future prior to the event
Second Priority - Dates may be placed on hold at any time within the 18 months precedir~tjl:n

a non-refundable deposit in accordance with the following schedule: .
1. For a series of at least four events during a theater season - $1000
2. For an event with at least six performances during a theater season - $750
3. For a small community arts group or educational institution programs - $300
4. All other bookings - $500
The paid non-refundable deposit will entitle the presenter to an additional 60 days extension period. !d:.~

V. Contract Deposits
A) The minimum contract deposit required will be ~ of the base rental for all users.
B) New clients will pay a contract deposit offull rent at the management's discretion.
C) Small community arts groups and educational organizations will pay as contract deposit tl~e miJirr IlID

D) The remainder of the base rent is due two weeks prior to the event.
E) Producers with a series will be allowed to deposit the base rent for one performance, w~ch,.vi[ be
credited to the fmal performance of the series,
F) Deposits are non-refundable, Any producer who believes that its event was canceled duje to exit ent
circumstances may request a partial or full return of the deposit, which is subject to the apI~rovall of the
Convention Center Advisory Board,
VL Rental Rates
A) Not-For-Profit, Section 501 ( C ) ( 3 ) organizations (as defined below) - $3,000 j~at rent per
performance, Flat daily rent for more than one performance per day is $4,650. Events Wilih more taan
four performances per week are subject to negotiation with management.

vn. Community Arts and Educational Prolrams
Small local community arts groups and educational institutions (as defined below) - will be offered use of he
facility, when available, between the hours of 9:00 A.M. - 5:00 PM at a discounted rate of$1.00/seat - milllim un
rental- $600, with a cap of $1 ,000 plus front of the house and back of the house expenses. These groups nay be
eligible to apply for a subsidy for a portion of the expenses from the appropriate City sources or other gt ant ng

VllL Definitions
A) "Not-Far-Profit, Section 501 (C) (3) Organizations" are defmed as organizations which meet all of he
following qualifications:
1) Current exemption letter from the IRS,
2) Current state certificate of incorporation and good standing.
B) "Small local community arts groups" are defmed as organizations which meet all of the follow ng
qualifications:
1) Annual cash budget under S250,000$500.000
2) A year-round presence in Dade County
3) A track record demonstrating successful presentation of cultural and/or educltic lal
programs.
C) "Educational institutions" are defined as organizations meeting the definition set forth in Florida Sl atu. es,
Section 212.08 ( 7 ) ( 0 ) ( 2 )d, as amended from time to time.
D) A "Commercial organization" is defmed as any organization which does not qualifY as A), B) or C)
above.

ADMINISTRA TION RECOMMENDATION:
The Administration recommends approval of the Resolution amending the Jackie Gleason Theate-
Booking Policy and approving same, as amended.
BACKGROUND:
The Mayor and City Commission, on May 7, 1997, evaluating the request to issue Request fo.
Proposals (RFP) seeking a presenter for a Broadway Series at the Jackie Gleason Theater ofth:
Performing Arts (TOP A), voted to issue said RFP and in conjunction requested the Conventiol,
Center Advisory Board (CCAB) to review the existing Jackie Gleason Theater Booking Policy
At its regular meeting on May 22, 1997, a subcommittee of the CCAB was appointed consisting of
Stu Blumberg, Chair, Jeff Abbaticchio, and Lea Sloan of the CCAB; Doug Tober of SMG; :m<
Michael Spring of the Metro-Dade Cultural Affairs Council. This subcommittee met on May 28
1997 and again on June 10, 1997 to review and revise the Jackie Gleason Theater Booking Policy
such revisions being presented as attached. The attached copy has also included the current poi ic~
for comparison. Users of TOPA were invited to the June 10, 1997 meeting to voice any opini1m:
concerning the proposed revisions.
Although a quorum was not present, at its regular meeting on June 12, 1997, the Convention Certe:
Advisory Board convened to discuss the proposed (attached); a formal vote to recommend sam<
could not be taken, but those members present expressed the sentiment that the proposed revision:
were satisfactory and consistent with the Board's original directive. Additionally, SN[G
recommend approval of the attached revisions.

The subcommittee has determined based on the revisions to an open Booking Policy, as well as, tJ Ie
existing policy not having been reviewed since its inception approximately five years ago, that tJ .e
Booking Policy should be amended, as revised attached hereto. The revisions accurately reflect ar d
facilitate the ability to program the Theater effectively within its new booking environment.
CONCLUSION:
This resolution should be approved to amend the Jackie Gleason Theater Booking Policy ard
approve the revised Booking Policy, as amended.
