SUBJECT: REPORT ON THE IMP ACT OF THE ORDINANCE LIMITING THE SALES
OF ALCOHOLIC BEVERAGES FOR OFF - PREMISES CONSUMPTION
On July 15, 1998, the Mayor and City Commission enacted Ordinance Number 98-3132, entitled,
"Liquor Control Regulation". This Ordinance amended the existing Ordinance and limited the sales
of alcoholic beverages for off - premises consumption to the hours of 8:00 a.m. through 10:00 p.m.
for all vendors licensed to sell alcoholic beverages for off - premises consumption.
The Police Department conducted research into the impact this new Ordinance was having and
provides the following information:
CODE VIOLATIONS
The Code Compliance Department, between the dates of July 15, 1998 and September 30, 1998,
conducted 177 inspections and cited 15 for violations. (The Police Department conducted follow-up
inspections in mid-January 1999 and found no violations)
CALLS FOR SERVICE, ARRESTS AND TYPE OF ARRESTS
The calls for service, arrests and type of arrest statistics were compiled on Washington A venue and
Ocean Drive, from 5th Street to 17th Street between the hours of 10:00 p.m. through 5:00 a.m. for the
period the ordinance went into effect and the previous year for comparison.

REVENUE REVIEW
A letter requesting information relevant to the impact of the new City ordinance was sent to all
establishments holding Licenses for Package Sales only. To date, the following businesses
responded, via telephone, indicating that the sales of beer and wine, as well as other merchandise,
have been affected by the ordinance and are down:

It should be noted that Gulf Liquors, at 1681 Alton Road, has a license allowing the sale of beer and
wine for off premises consumption and has been closing well before the hours permitted by the
ordinance for years.
FEEDBACK
The midnight shift supervisors/officers have noticed a decrease in the number of alcohol related
instances requiring police intervention, especially among underage violators. At the October 1998
Washington Avenue Task Force meeting, those in attendance expressed the opinion that the
ordinance was having a positive impact on cleaning up the area. .
CONCLUSION
Taking into account the inherent variables involved in this type of law enforcement and the fact that
the ordinance has only been in effect for three and a half months, it would be unreliable to corne to
a definitive opinion regarding the impact of the Ordinance. However, based on comments by
knowledgeable individuals, merchants of the Washington Avenue Association and police
supervisors, it appears the Ordinance is having a positive impact. As we monitor it for a longer
period of time and obtain new information, we will advise the Mayor and Commission.
