A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, URGING MIAMI-DADE
COUNTY TO ADOPT A COUNTYWIDE ORDINANCE FOR
FLORIDA-FRIEN DL Y FERTILIZER USE ON URBAN
LANDSCAPES FOR THE PROTECTION OF LOCAL SURFACE
AND GROUNDWATER QUALITY; AND DIRECTING THE CITY
CLERK TO TRANSMIT THIS RESOLUTION TO THE
CHAIRPERSON AND MEMBERS OF THE MIAMI-DADE BOARD
OF COUNTY COMMISSIONERS, AND ALL MUNICIPAL
GOVERNMENTS WITHIN MIAMI-DADE COUNTY.
RESOLUTION NO.
WHEREAS, the water quality of Biscayne Bay, the Atlantic Ocean, and area water
channels is critical to the health of the environment, strength of the economy (including the tourism
and recreation sectors), and the health, safety, and welfare of the citizens of the City of Miami
Beach and Miami-Dade County; and
WHEREAS, currently in Miami-Dade County, thirty-four municipal stormwater systems
and one County stormwater system discharge nutrients into Biscayne Bay from on-land activities
such as the use of fertilizers; and
WHEREAS, according to a report dated January 29, 2019, on the findings of a Miami-
Dade County Division of Environmental Resources Management study on the decline of seagrass
and hardbottom in Biscayne Bay, "catastrophic losses can occur in bodies of water with limited
tidal flushing, such as the Julia Tuttle Basin in north Biscayne Bay, and nutrient loads that are
both concentrated and frequent"; and
WHEREAS, similarly, a report filed on August 8, 2019 by a Grand Jury convened by the
Miami-Dade County State Attorney's Office recognized that "too much nitrogen and phosphorous
in the water causes algae to grow faster than the ecosystems can handle"; and
WHEREAS, the overgrowth of algae and other harmful marine vegetation hinders the flood
attenuation effects of natural and constructed stormwater conveyances; accordingly, regulations
on the use of nutrients, including phosphorus and nitrogen contained in fertilizers, will help
improve and maintain water and habitat quality; and
WHEREAS, at its meeting on September 9, 2019, the Miami-Dade County Biscayne Bay
Task Force, a group of nine Biscayne Bay stakeholders established by the Miami-Dade Board of
County Commissioners (the "Board") to advise the Mayor and the Board on issues related to
Biscayne Bay, expressed support for the City's recommendation to expand local initiatives
regarding fertilizer use to the entire County; and
WHEREAS, Section 403.9337, Florida Statutes, provides that each municipality and
county located within the watershed of a water body or water segment that is listed as impaired
by nutrients pursuant to Section 403.067, Florida Statutes, shall adopt a model Ordinance for
Florida-Friendly Fertilizer use on Urban Landscapes or an equivalent as a mechanism for
protecting local surface and groundwater quality; and
W H E R E A S , the Florida Department of Environmental Protection has identified areas of
Biscayne Bay as "impaired" as a result of excess nutrients under the Florida Impaired Waters
Rule set forth in Chapter 62-303 of the Florida Administrative Code; and
WHEREAS, it is in the best interest of the public health, safety, and welfare of the residents
of the City to regulate landscape management practices, including the application and use of
fertilizers containing nitrogen and/or phosphorus within Miami-Dade County; and
WHEREAS, Countywide restrictions on fertilizer use would yield a positive regional impact
in reducing the volume of nutrients discharged and improving water quality throughout the entire
Biscayne Bay watershed; and
WHEREAS, as such, the Mayor and City Commission urge Miami-Dade County to adopt
a model Florida-Friendly Fertilizer Ordinance, or any substitute or similar legislation which would
regulate the proper use and application of fertilizers and reduce pollution of our water bodies.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge Miami-Dade County to adopt a Countywide Ordinance for Florida-
Friendly Fertilizer Use on Urban Landscapes for the protection of local surface and groundwater
quality; and direct the City Clerk to transmit this Resolution to the Chairperson and Members of
the Miami-Dade Board of County Commissioners and all municipal governments within Miami-
Dade County.
