A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE
RECOMMENDATION OF THE NEIGHBORHOOD AND QUALITY
OF LIFE COMMITTEE, AT ITS SEPTEMBER 23, 2020 MEETING,
TO AUTHORIZE THE CITY MANAGER AND CITY ATTORNEY'S
OFFICE TO NEGOTIATE AN AGREEMENT WITH THE RITZ-
CARLTON, THE DECOPLAGE CONDOMINIUM, AND THE
GEORGIAN CONDOMINIUM, TO "ACTIVATE" (INCLUDING
PROVIDING ADDITIONAL ENHANCED MAINTENANCE AND
SECURITY) FOR THE CITY-OWNED PROPERTY ABUTTING
THE AFORESTATED PROPERTIES, ALONG LINCOLN ROAD,
FROM COLLINS AVENUE TO THE BEACH ENTRANCE, AND
ALONG THE BEACHWALK, FROM THE NORTHERN BORDER
OF THE RITZ-CARLTON PARCEL TO THE SOUTHERN
BORDER OF THE GEORGIAN CONDOMINIUM PARCEL
(COMMONLY REFERRED TO AS THE "LINCOLN ROAD
STREET END"); AND, FURTHER REQUIRING THAT THE FINAL
NEGOTIATED AGREEMENT COME TO THE MAYOR AND CITY
COMMISSION FOR ITS REVIEW AND CONSIDERATION.
WHEREAS, on September 15, 2020, the Police Citizen Relations Committee passed a
motion to improve the safety and cleanliness of the Lincoln Road Street End, from Collins Avenue
to the beach walk; and
WHEREAS, the motion's objective was to "activiate" that portion of Lincoln Road, from
Collins Avenue to the beach entrance and along the Beachwalk, through coordinated efforts among
the City and the abutting stakeholders, the Ritz-Carlton, the Decoplage Condominium, and the
Georgian Condominum Association; and
WHEREAS, a proposed agreement approving the City and the aforestated properties would
seek to address, amoung other measures, expansion of the current private patrolled security area;
providing a direct line of communication to the Miami Beach Police Department for security services;
supplement minimum maintenance provided by the City; empower the private properties to
maintain, or contribute to additional and enhanced maitenance and security to the proposed public
area(s); and occupying portions of the public area with vendors and concessions managed by the
Ritz-Carlton; and
WHEREAS, at its September 23, 2020 meeting, the Neighborhoods and Quality of Life
Committee discussed the Police Citizen Relations Committee's motion, and recommended
proceeding with negotiating the aforestated agreement to achieve the desired partnership; and
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
accept the recommendation of the Neighborhoods and Quality of Life Committee to authorize the
City Manager and City Attorney's office to negotiate an agreement with the Ritz-Carlton, the
Decoplage Condominium, and the Georgian Condominium, to "activate" (including providing
additional enhanced maintenance and security)for the City-owned property abutting the aforestated
properties, along Lincoln Road, from Collins Avenue to the beach entrance, and along the
Beachwalk, from the northern border of the Ritz-Carlton parcel to the southern border of the
Georgian Condominium parcel (the "Lincoln Road Street End"); and, further requiring that final
negotiated agreement come to the Mayor and City Commission for its review and consideration .

ADMINISTRATION RECOMMENDATION
The Administration recommends approving of the Resolution.
ANALYSIS
On September 15, 2020, the Police Citizen Relations Committee passed Motion #5, "To improve
safety and cleanliness to Lincoln Road from Collins Avenue to the beach walk". The motion's
objective to restore Lincoln Road, from Collins Avenue to the beach entrance and along the
Beachwalk (the "Active Zone") through coordinated efforts between the City of Miami Beach (the
"City") and the Ritz-Carlton, the Decoplage, and the Georgian Condominium Association (the
"Stakeholders").
The partnership seeks to achieve expansion of the private patrolled security area, provide a direct
line of communication to the Miami Beach Police Department for the security services, supplement
minimum maintenance provided by the City, establish a five-minute Active Zone, empower

Stakeholders to maintain the proposed Active Zone, and occupy the Active Zone with vendors
and concessions professionally managed by the Ritz-Carlton.
On September 23,2020, the Neighborhood and Quality of Life Committee discussed Motion#5 by
the Police Citizen Relations Committee and recommended proceeding with negotiating an
agreement with the Stakeholders to achieve the desired partnership.
CONCLUSION
The Administration recommends that the Mayor and City Commission accept the
recommendation of the Neighborhood and Quality of Life Committee to authorize the City
Manager to negotiate an agreement with the property owners of the Ritz-Carlton, the
Decoplage Condominium, and the Georgian Condominium; said agreement authorizing
the property owners to provide private security, maintenance and activation for the city
owned property abutting each property owner's private property, along Lincoln Road, from
Collins Avenue to the beach entrance, and along the Beachwalk, from the northern border
of the Ritz-Carlton parcel to the southern border of the Georgian Condominium parcel;
and, further, requiring the approval of the final negotiated agreement by the Mayor and
City Commission.
