A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROPIATING FUNDING;
APPROVING AND AUTHORIZING THE CITY MANAGER, OR HIS
DESIGNEES, TO APPLY FOR AND ACCEPT FUNDING, AND EXECUTE
ANY AND ALL NECESSARY DOCUMENTS OR AGREEMENTS, IN
CONNECTION WITH FINANCIAL DISASTER RELIEF AND RECOVERY
ASSISTANCE FUNDS RELATED TO THE NOVEL CORONAVIRUS (COVID-
19) PANDEMIC INCLUDING, BUT NOT LIMITED TO, THE FUNDS FROM
THE U.S. DEPARTMENT OF HOMELAND SECURITY, THE FEDERAL
EMERGENCY MANAGEMENT AGENCY (FEMA) PUBLIC ASSISTANCE
PROGRAM, AND THE CORONAVIRUS AID, RELIEF AND ECONOMIC
SECURITY (CARES) ACT FUNDING THROUGH THE STATE OF FLORIDA,
DIVISION OF EMERGENCY MANAGEMENT; THE MIAMI-DADE COUNTY
CORONAVIRUS RELIEF FUND (CRF) AND INCLUDING, EXECUTING
REQUESTS FOR ASSISTANCE, RELIEF/ASSISTANCE CLAIMS,
REQUESTS FOR PAYMENTS AND OTHER SUPPLEMENTAL
DOCUMENTATION NECESSARY TO SUPPORT DISASTER FUNDING
PROGRAMS REIMBURSEMENTS.
WHEREAS, coronavirus disease 2019("COVID-19"), a severe acute respiratory illness
caused by the SARS-CoV-2 virus that can spread rapidly from person to person and cause
serious illness or death, constitutes a clear and present threat to the lives, health, welfare and
safety of the people of the City of Miami Beach; and
WHEREAS, on March 9, 2020, Governor Ron DeSantis issued Executive Order 20-52,
declaring a State of Emergency for the State of Florida related to COVID-19; and
WHEREAS, on March 11, 2020, the World Health Organization declared the rapidly
spreading coronavirus outbreak a pandemic; and
WHEREAS, on March 12, 2020, Miami-Dade County Mayor Carlos Gimenez issued a
Declaration of a State of Emergency for all Miami-Dade County concerning COVID-19 and
subsequently issued various emergency orders to mitigate the threats associated with COVID-
19; and
WHEREAS, on March 12, 2020, City Manager for the City of Miami Beach Jimmy
Morales issued a Declaration of a State of Emergency for the City of Miami Beach, which
declaration has been amended and extended; and subsequently issued various emergency
orders to mitigate COVID-19 threats and protect the general public; and
WHEREAS, on March 13, the President of the United States Donald J. Trump issued a
proclamation declaring a nationwide emergency due to COVID-19, activating the Stafford
Disaster Relief and Assistance Act, 42 U.S.C. 5121 et. Seq. (Stafford Act); and
WHEREAS, pursuant to the Stafford Act, local government expenses incurred in
connection with emergency protective measures in response to the COVID-19 pandemic at the
guidance of public health officials may be reimbursed under the Federal Emergency
Management Agency's (FEMA) Public Assistance (PA) Program; and
WHEREAS, on March 27, the Coronavirus Aid, Relief, and Economic Security
("CARES")Act was signed into law by President Trump; and
WHEREAS, for FEMA reimbursement purposes, the State of Florida, Division of
Emergency Management serves as the pass-through entity for Federal Awards from the U.S.
Department of Homeland Security and FEMA; and
WHEREAS, for CARES Act funding purposes, Miami Dade County Office of
Management and Budget serves as the recipient and administrator to sub-recipients, with
disbursements to municipalities handled through Hagerty Consultants; and
WHEREAS, the City of Miami Beach is a Sub-Recipient of sub-awards through FEMA,
CARES Act and other available funding and claims for municipalities to cover eligible expenses
incurred due to the COVID-19 pandemic; and
WHEREAS, as such, the City of Miami Beach must enter into agreements and execute
required documents to obtain financial assistance from the State of Florida and the United
States Government to address the City's on-going recovery efforts
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,that the Mayor and City Commission
hereby appropriate funding; and approve and authorize the City Manager, or his designees, to
apply for and accept funding, and execute any and all necessary documents or agreements, in
connection with financial, disaster relief and recovery assistance funds related to expenses
incurred due to COVID-19 including, but not limited to, funds from the U.S. Department of
Homeland Security, the Federal Emergency Management Agency (FEMA) Public Assistance
Program, through the State of Florida, Division of Emergency Management; the Miami-Dade
County Coronavirus Relief Fund (CRF)and including, executing requests for assistance, damage
claims, requests for payments and other supplemental documentation necessary to support
disaster funding programs reimbursements.

WHEREAS, on March 10, 2020, the Governor of Florida declared a State of Emergency
in response to the public health threat of COVID-19; and
WHEREAS, during this event, the City of Miami Beach continued to expend public
resources in response to public safety and economic impacts to the City; and

WHEREAS, the President of the United States issued a major disaster declaration
providing supplemental disaster assistance to areas impacted by Hu icane Irma, and the City
continues to expend public resources for • - • •
and
WHEREAS, Federal Disaster Declaration FEMA-4466-DR, authorized funds for local
governments within Miami-Dade County in order to reimburse eligible and allowable expenses
directly associated with the City's preparations for, response to, and recovery from the
Coronavirus; and
WHEREAS, for FEMA reimbursement purposes, the State of Florida, Division of
Emergency Management serves as the pass-through entity for Federal Awards from the U.S.
Department of Homeland Security, FEMA; and
WHEREAS, the City of Miami Beach would be the Sub-Recipient of a sub-award; and
WHEREAS, as such, the City of Miami Beach must enter into agreements and execute

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY

SUBJECT: A Resolution Authorizing the City Manager or Their Designee(s)to Apply for and
Accept Disaster Funding
ADMINISTRATION RECOMMENDATION:
Adopt the resolution.
ANALYSIS:
Pursuant to the Robert T. Stafford Disaster and Emergency Assistance Act (42 U.S.C. §§ 5121-
5206), local government expenses incurred in connection with emergency protective measures in
response to the COVID-19 pandemic at the guidance of public health officials may be reimbursed
under the Federal Emergency Management Agency's (FEMA) Public Assistance (PA) Program.
The City of Miami Beach is seeking reimbursement from FEMA through the State of Florida for
expenditures incurred for COVID-19 response. The activities to which these expenditures were
attributed include overtime labor costs due to additional assignments; purchase of personal
protective equipment(PPE)for frontline staff, hand sanitizer and cleaning supplies. The City is also
seeking funding through the Miami-Dade County Coronavirus Relief Fund (CRF), as the County's
Office of Management and Budget administers the sub-award disbursements. The CRF funds cover
expenditures that are not covered under FEMA Public Assistance.
In order to obtain financial assistance from the United States Government, State of Florida, and
Miami-Dade County, the City of Miami Beach must enter into agreements and execute required
documents as part of the process.
This resolution is simply a formality that expedites the process for the acceptance and remittance of
any approved funding through FEMA PA. Staff in the Finance Department and the Division of
Emergency Management are dedicated to carrying out this process in the most efficient manner.
RECOMENDATION:
The Administration recommends that the City Commission approve and authorize the City
Manager, or their designees, to apply for and accept funding, and execute any and all
necessary documents or agreements, in connection with financial, disaster relief and
recovery assistance funds related to expenses incurred due to COVID-19 response
activities.
