The Lease Agreement is hereby amended, as of the date last entered below, as follows: 1. Landlord and Tenant (collectively, the "Parties") acknowledge that Tenant has exercised its first renewal option, as specified in the Lease Agreement, for a first renewal term of five (5) years, commencing on October 1, 2020 and ending on September 30, 2025(the"Renewal Term"). 2. Pursuant to the Lease Agreement, the rent to be paid by Tenant to Landlord for the duration of the Renewal Term shall be $90,000 per year (payable $7,500 per month), plus the increase in the amount of real estate taxes assessed against the Premises during the initial term(as fully described and set forth in the Lease Agreement). 3. Landlord and Tenant acknowledge that Tenant, at its own expense, had professional tenting fumigation completed at the Premises on August 20, 2020 in order to remediate the termite issue. 4. Tenant shall have the right, for its convenience and without cause, to terminate the Lease Agreement at any time during the Renewal Term by mailing written notice to Landlord of such termination, which shall become effective thirty(30)days following the mailing of such notice; and following which the Parties shall be discharged from any and all liabilities, duties, and terms arising out of, or by virtue of, the Lease Agreement and this Amendment No. 1. All other terms and conditions of the Lease Agreement shall remain unchanged and in full force and effect, and in the event there is a conflict between the provisions of this Amendment No. 1 and the Lease Agreement, the provisions of this Amendment No. 1 shall govern.
