IN MIAMI DADE, INC. TO PROVIDE RENT AND UTILITY ASSISTANCE TO RESIDENT HOUSEHOLDS IMPACTED BY COVID-19 This Amendment No. 1 (Amendment) to the Professional Services Agreement (the Agreement),dated September 18, 2020, by and between the City of Miami Beach, Florida, a municipal corporation organized and existing under the laws of the State of Florida, having its principal place of business at 1700 Convention Center Drive, Miami Beach, Florida 33139 (City), and H.O.P.E. in Miami-Dade, Inc., a non-profit company, having its principal place of business at 50 Biscayne Boulevard #1806, Miami, FL 33132 (Contractor), to provide rent and utility assistance to resident households impacted by COVID-19 is entered into this 30 day of 'Decerr,be/ , 2020 with an effective date of December 31,2020 (Effective Date). RECITALS WHEREAS,on July 29, 2020,the Mayor and City Commission adopted Resolution 2020-31328, approving the award of $230,000 to provide rent, mortgage and utilities assistance to resident households adversely impacted by COVID-19; and WHEREAS, the funds were awarded to H.O.P.E. in Miami Dade, Inc., a non-profit provider; and WHEREAS, the City has prioritized expending time-sensitive funds that were subsequently awarded to the City for rent, mortgage and utilities assistance resulting in a delay of referrals to Contractor; and WHEREAS, the need for rent, mortgage and utilities assistance remains high throughout our community as a result of ongoing impacts from COVID-19 and the term of the Agreement is set to expire on December 30, 2020. NOW THEREFORE, in consideration of the mutual promises and conditions contained herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged,the City and Contractor hereby agree to amend the Agreement as follows: 1. ABOVE RECITALS. The above recitals are true and correct and are incorporated as part of this Amendment. 2. MODIFICATIONS. a. Section 3(Term)of the Agreement is hereby modified to amend the expiration date of the Agreement from December 30,2020 to January 31, 2021. 1 b. The income eligibility criteria for assisted households, as set forth in subsection B(6) of Exhibit A, is hereby modified from "no greater than 60% Area Median Income (AMI) for the household" to "no greater than 120% Area Median Income (AM I) for the household", to reflect the changes made in the regulations for the CARES Act and Coronavirus Relief Act funding. c. The rent arrears eligibility criteria, as set forth in subsection B(3) of Exhibit A, is hereby modified from "Rent Arrears no greater than 3 months"to"Rent arrears no greater than 6 months". 3. RATIFICATION. Except as amended herein, all other terms and conditions of the Agreement shall remain unchanged and in full force and effect. In the event there is a conflict between the provisions of this Amendment and the Agreement, the provisions of this Amendment shall govern.
