RESOLUTION NO. 86-18346
A RESOLUTION RECOGNIZING THE NEEDS OF RESIDENTS LNING
IN THE CONDEMNED AREA SELECTED AS THE SITE FOR THE
CITY OF MIAMI BEACH'S FORTY-FIRST STREET/OFF -STREET
PARKING PROJECT; PROVIDING FOR THEIR POSSIBLE
COMPENSATION BASED UPON THEIR PROPERTY INTERESTS;
FUNDS TO BE PROVIDED FROM THE 6 MILLION DOLLAR
PARKING REVENUE BOND FUND, WHERE APPLICABLE FOR THIS
PROJECT.
WHEREAS, in Resolution No. 84-17740, the City Commission of the City of
Miami Beach approved the site selection for the Forty-First Street/Off-Street Parking
Project; and,
WHEREAS, ON January 13, 1986, the City acquired title to the subject
properties through condemnation; and,
WHEREAS, the construction of the Parking Facility is a public project
which has necessitated the relocation of certain residents currently living in the area
approved for site selection; and,
WHEREAS, it is the intention of the City to compensate fully all those
persons entitled to compensation; and,
WHEREAS, such compensation shall be paid regardless of whether the
tenants have moved prior to the date of acquisition; and,
WHEREAS, the City desires to pay relocation benefits to those qualified
residents eligible for such benefits;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that:
1. All of the above recitals are true and correct;
2. The City Commission hereby directs the City Manager to issue
benefits to those residents determined to be eligible in the following
manner: The tenant shall be allowed to occupy his/her current rental
unit until March 1, 1986 without paying rent to the City, or the
tenant may continue to pay rental fees to the City, and upon the
tenant vacating the rental unit, the City will provide a payment equal
to one and one-half (1V2) times the normal rental fee. The choice of
benefit will be at the sole discretion of the tenant(s). Said decision
to be made by the tenant during the eligibility evaluation period. All
tenants will be required to vacate no later than March 1, 1986.
3. Payments will be made from the 6 Million Dollar Parking Revenue
Bond Fund allocation to the Forty-First Street/Off-Street Parking
project, 'where-applicable.
