RESOLUTION NO. 86-18472
• RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH REQUESTING THE METRO-DADE
COUNTY COMMISSION TO TAKE ALL NECESSARY STEPS
TO HAVE VIRGINIA KEY OUTFALL LINE EXTENDED;
REQUESTING FEDERAL COURT TO KEEP ALTERNATIVES
AWARDED TO THE CITY OF MIAMI BEACH BY FEDERAL
APPEALS COURT
WHEREAS, the Dade County Water and Sewer Authority applied
for a grant to extend the Virginia Key outfall line towards the
Gulf Stream so that the effluent could not return to pollute South
Beach or Virginia Key, and to thereafter reduce the amount of
chlorine used in order to minimize the degradation of the near
shore marine environment; and
WHEREAS, the effluent from the Virginia Key outfall line,
discharged at the ninety (90) foot depth in the near shore waters,
can pollute South Point beaches in 4 .3 hours after discharge with
potentially dangerous effects, according to a study of the
movement of effluents from outfall lines, as reported in
University of Miami Sea Grant Technical Bulletin Number 27; and
WHEREAS, the chlorine charged effluent degrades near shore
marine life and the marine environment and is only partially
effective against viruses; and
WHEREAS, even the Florida Department of Environmental
Regulations admitted, in its May 1981 publication that "Chlorine
used in conjunction with wastewater treatment" has "potentially
harmful effects" ;
NOW, THEREFORE, BE IT RESOLVED that the Miami Beach City
Commission requests the Metro-Dade County Commission to take all
necessary steps, including reliance upon protection offered by the
Federal Court, to have the Virginia Key outfall line extended to a
point from which the effluent cannot return to pollute the beaches
of South Pointe and Virginia Key;
AND, BE IT FURTHER RESOLVED that the Federal Court, Southern
District of Florida, in Rite-Research Improves the Environment,
Inc. , and City of Miami Beach vs. Lee Thomas, etc. , et al, be
requested to keep open for Miami Beach all alternatives awarded to
the City and other interested governmental entities by the Fifth
Circuit Federal Appeals Court in the suit RITE - Research Improves

the Environment, Inc. versus THE US EPA, Dade County and the State
of Florida.
