RESOLUTION NO. 86-18505
A RESOLUTION OF THE CITY. COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE A REVOCABLE PERMIT
BETWEEN THE CITY OF MIAMI BEACH AND JEFFREY
AND ALICIA BOYLE FOR THE MAINTENANCE OF A
FENCE IN A PORTION OF THE RIGHT-OF-WAY OF SUN-
SET DRIVE AND WEST 23RD STREET.
WHEREAS, the City, wishes to execute a Revocable Permit be-
tween the City of Miami Beach and Jeffrey and Alicia Boyle for the
maintenance of a fence in a portion of the right-of-way of Sunset
Drive and West 23rd Street.
WHEREAS, a Revocable Permit has been prepared and the City
Manager has recommended its execution and the City Attorney has
approved it as to form.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk are authorized and directed to execute the Revocable Permit
for the maintenance of a fence in a portion of the right-of-way of
Sunset Drive and West 23rd Street.
PASSED and ADOPTED this 9th day of July, 1986 .

Dear Mr. Parkins: rrl
This office represents Jeffrey and Alicia Boyle, the owhrc
of a residence located at 2300 Sunset Drive. The Boyles have
been informed by the Building Department that their picket
fence and a portion of a hedge encroaches upon a City right-of-
way.
This right-of-way apparently has been reserved by the City
for use should the City ever decide to put in a sidewalk,
which is highly unlikely, to say the least. The hedge in
question has been in place for as long as anyone who has
ever lived upon the Island can remember. The picket fence
is picturesque, and adds charm and elegance to the neighbor-
hood.
My residence happens to be directly across the street from
the property in question, and we were delighted when the Boyles
purchased and restored their home and added the picket fence.
They are currently constructing a swimming pool on their
property, and when they commenced work on the pool, . removal
of the fence was attached as a condition of their building
permit. It would cause a great financial hardship and would
destroy the beauty of This corner lot should the Boyles be
required to pull the fence down.
We therefore respectfully request that this matter be placed
on the next City Commission agenda, so that we may apply to
the Commission for a revocable permit to waive said condition
• of the building permit, and leave the fence in place. Per
instructions from Mr. Fosmoen of your office, I have attached
a copy of the permitting documents.
