Resolution 2021-31603 RESOLUTION NO.. 2021-31603 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE COMMITTEE OF THE WHOLE RELATING TO THE ANNUAL PERFORMANCE EVALUATION OF THE INSPECTOR GENERAL, JOSEPH M. CENTORINO; AND, IN CONSIDERATION AND RECOGNITION OF THE INSPECTOR GENERAL'S PERFORMANCE DURING FY19/20, AMENDING JOSEPH M. CENTORINO'S EMPLOYMENT AGREEMENT BY PROVIDING (1) A MERIT INCREASE AND COMMENSURATE SALARY ADJUSTMENT OF TWO PERCENT (2%) AND (2)A COST OF LIVING ADJUSTMENT FOR FY 20/21 IN THE AMOUNT OF 1%, IF PROVIDED TO GENERAL UNCLASSIFIED EMPLOYEES. WHEREAS, on November 6, 2018, the City' s voters approved an amendment to the City Charter, creating Article IX, which creates the City of Miami Beach Office of Inspector General; establishes the functions of the office; provides the Inspector General with the power to subpoena witnesses, administer oaths, and require production of records, in order to conduct its investigations; and provides that the Inspector General' s appointment, term, functions, authority, and powers shall be further established by Ordinance; and WHEREAS, on February 23, 2019, the Mayor and City Commission adopted Ordinance No. 2019- 4239, to implement the provisions of the newly created Article IX of the City Charter; and WHEREAS, on September 18, 2019, the Ad Hoc Inspector General Selection Committee unanimously recommended the appointment of Mr. Joseph M. Centorino as the City' s Inspector General; and WHEREAS, on October 16, 2019, pursuant to Section 2- 256(b)(2) of the City Code, the Mayor and Commission appointed Joseph M. Centorino as Inspector General of the City of Miami Beach, and authorized the negotiation of an employment agreement with Mr. Centorino; and WHEREAS, on October 30, 2019, the Mayor and City Commission adopted Resolution No. 2019-31072, approving and authorizing the Mayor and City Clerk to execute an Employment Agreement between the City and Inspector General Joseph M. Centorino,to provide for the terms and conditions of the Inspector General' s employment, for a term of up to four (4) years, commencing on November 1, 2019, and expiring on October 31, 2023, unless terminated earlier by either party in accordance with the terms of the Agreement; and WHEREAS, the Employment Agreement provides for an annual performance review and evaluation of the Inspector General, at which time the City Commission shall review the annual salary and/or other benefits of the Inspector General, and shall adjust in such amounts and to such extent a the City Commission may determine it is desirable to do so; and WHEREAS, in prior years, the City's informal policy has been to refer the evaluation for the performance of the constitutional officers to the Finance and Economic Resiliency Committee ("FERC"), where the Chair of the Committee was instructed to meet separately with each constitutional officer with regard to their performance and, in particular, any proposed contract changes the officer was proposing to their employment contract, and the FERC Chair would then give a recommendation at the Committee of the Whole meeting, which would then conduct its own evaluation; engage in discussion; ask questions; make comments; and formally move any proposed action; and WHEREAS, this year, in no small part due to the COVID-19 pandemic - which necessitated in other matters taking priority on Commission agendas and Commissioners' schedules-the FERC Chair, Commissioner Ricky Arriola, requested that the evaluations be done directly at a Committee of the Whole meeting; and WHEREAS, on February 10, 2021, the Committee of the Whole met, and discussed the annual performance evaluation and salary/benefits review of the Inspector General; and WHEREAS, in consideration and recognition of the Inspector General's performance for FYI9/20, the Mayor and City Commission hereby deem that it is in the best interest of the City to approve an amendment to the City Clerk's Employment Agreement, all as further set forth below. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that, in consideration and recognition of the Inspector General's exemplary performance during FY 19/20, the Mayor and City Commission hereby approve the following amendments to the Inspector General's Employment Agreement: 1. MERIT INCREASE Annual Present Base Salary: $210,000.18 +2% Salary Increase: $4,200 New Base Salary: $214,200.18 2. COST OF LIVING ADJUSTMENT.Any cost of living adjustment, if provided to general unclassified employees of the City.
