RESOLUTION NO. 86-18579
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, DECLARING THE
CITY COMMISSION'S OPPOSITION TO ADOPTION OF A
UNIFORM STATE-WIDE BUILDING CODE; ENCOURAGING
AND REQUESTING OTHER MUNICIPALTIES WITHIN DADE
COUNTY AS WELL AS THE DADE COUNTY COMMISSION
TO PASS RESOLUTIONS OPPOSING ADOPTION OF A
UNIFORM STATE-WIDE BUILDING CODE; ENCOURGAGING
OTHER CITY COMMISSION MEMBERS AND DADE COUNTY
COMMISSIONERS TO INFORM THEIR APPROPRIATE STATE
LEGISLATORS OF ACTIONS TAKEN BY THEIR
GOVERNING BODIES IN OPPOSITION TO A UNIFORM
STATE-WIDE BUILDING CODE.
WHEREAS, the Dade League of Cities and the Broward
County League of Cities have within the last year taken a firm
stand opposing adoption of a Uniform or State-Wide Building Code;
and,
WHEREAS, the Florida League of Cities has adopted
Resolutions opposing a State-Wide Uniform Building Code,
restrictions on local amendments Codes, and State interpretations
of local codes; and,
WHEREAS, the Standard Building Code, proposed as the
Uniform Building Code, is administratively weak as compared to the
South Florida Building Code and would eliminate those standards
established for Building Officials and Inspectors within the South
Florida Building Code; and,
WHEREAS, the adoption of the Southern Standard Building
Code as a State-Wide Building Code would eliminate the current
local Board of Rules and Appeals, as well as eliminate those
standards established for Building Departments adopted after many
years of study, experience and practice; and,
WHEREAS, the Southern Standard Building Code would not
afford equal protection of buildings against hurricanes to the
extent which the South Florida Building Code presently does.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows:
SECTION 1. The City of Miami Beach Commission affirms
its strong opposition to the adoption of the Uniform State-Wide
Building Code and requests that each Dade County Municipality as
well as the Dade County Commission, pass Resolutions to this
effect and inform their State Legislators of this action.
SECTION 2. The City Clerk is hereby directed to send
copies to the Dade League of Cities, each Dade Municipality, Dade
County Commissioners, and all other appropriate State
Representatives.
This Resolution shall be effective as of September 3 ,1986.
