A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING TO CONSIDER A
REVOCABLE PERMIT APPLICATION BY BERNARD MOLLOD, AS OWNER OF
THE DAYS INN-NORTH BEACH, LOCATED AT 7450 OCEAN TERRACE, FOR
CONSTRUCTION OF A PORTION OF A HANDICAP ACCESS RAMP WITH
RAILING WITHIN THE ADJACENT CITY RIGHT-OF-WAY.
WHEREAS, Bernard Mollod (the Applicant) owns the Days Inn-North Beach, located at
7450 Ocean Terrace (the Property) ; and
WHEREAS, the Applicant has applied for a revocable permit to install a portion of a
handicap access ramp with railing on the Ocean Terrace City public right-of-way, adjacent to the
Property; and
WHEREAS, pursuant to the City of Miami Beach Code, Chapter 82, Article III, Division
2, Section 82-93, the Mayor and City Commission are required to hold a public hearing to
consider the afore stated request.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to
consider a request by Bernard Mollod, as owner of the Days Inn-North Beach, located at 7450
Ocean Terrace, to install a portion of a handicap access ramp within City public right-of-way, is
hereby called to be held before the Mayor and City Commission in their Chambers on the Third
Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on July 7, 1999
beginning at2.:00 p.m, and the City Clerk is hereby authorized and directed to publish appropriate
Public Notice of the said Public Hearing in a newspaper of Miami Beach, at which time and place
all interested parties will be heard.

ADMINISTRATION RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
Pursuant to City Code, Chapter 82, Article III, Division 2, upon receipt of a complete application,
the City Commission shall schedule a public hearing to consider a request for a Revocable Permit,
Bernard Mollod, owner of the property located at 7450 Ocean Terrace, operated as Days Inn - North
Beach, has completed the application requirements for a Revocable Permit requesting the
construction of a portion of a handicap access ramp with handrail within City right-of-way on Ocean
Terrace near 75th Street, as shown in the attached Exhibit "A".
ANAL YSIS:
Pursuant to City Code, Chapter 82, Article III, Division 2, Section 82-92, Revocable Permits, the
applicant has complied with the application requirements, submitted the application fee and provided
a list of property owners within a radius of 375 feet to be notified of the scheduled public hearing.

The Revocable Permit application covers an encroachment area of29.l4 square feet on the City's
right-of-way/sidewalk. The City Commission is required to schedule a public hearing allowing
fifteen days notice to the property owners within 375 feet of the site, in order to consider this
application for a Revocable Permit.
CONCLUSION:
The City Commission should set a time and date for a public hearing to consider this application for
a Revocable Permit.
