A RESOLUTION OF THE CITY OF MIAMI BEACH APPROVING THE
TRANSMITTAL TO THE STATE OF FLORIDA DEPARTMENT OF
COMMUNITY AFFAIRS, A PROPOSED AMENDMENT TO THE
CITY'S COMPREHENSIVE PLAN PURSUANT TO THE STATE OF
FLORIDA COMPREHENSIVE PLANNING AND LAND USE
DEVELOPMENT ACT PERTAINING TO THE AIR RIGHTS
DEVELOPMENT OF CITY-OWNED PROPERTY LOCATED IN THE
CONVENTION CENTER (CCC) DISTRICT, LINCOLN ROAD C-3
DISTRICT, SOUTHWEST AND NORTHEAST CORNERS OF 13th
STREET AND COLLINS AVENUE, AND ON NON-OCEANFRONT
LOTS IN THE SOUTH POINTE REDEVELOPMENT AREA.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA,
THAT:
WHEREAS, the Planning Board of the City of Miami Beach held a public hearing on
September 23, 1986 and October 20, 1986 and a public workshop on October 14, 1986 for
purposes of considering 1) an amendment to the Comprehensive Plan pertaining to the
definition of the public institution land use category term to allow air rights developments;
2) including the south 300 feet of City-owned property on the east side of Collins Avenue in
the public institutional category and deleting same from the Recreation and Open Space
category; 3) amending the City's Zoning Ordinance to permit air rights category in the (MU)
Municipal Use Zoning District; and, 4) pertaining to a recommendation on the lease of said
property to Club Eden Roc, Inc. in which the Planning Board recommended that the City
Commission approve all four (4) requests;
WHEREAS, the City Commission held a public hearing on November 19, 1986 for
purposes of considering that portion of the proposed Comprehensive Plan amendments that
relate to the City-owned property at 46th Street;
WHEREAS, the City Commission on November 19, 1986 unanimously voted to eliminate
the proposed Comprehensive Plan amendments pertaining to the City-owned property at
46th Street thereby amending Resolution No. 86-18680 relating to items that are the subject
of a public hearing called for December 17, 1986.
WHEREAS, the City Commission on December 17, 1986 unanimously voted to transmit
the attached Ordinance amending the definition of the land use category term
"Public/Institutional" to permit developments, either through the lease and/or sale of
air rights, when said develoment is consistent with the Future Land Use Element of the
Comprehensive Plan and in locations herein described as follows:
1. Property in the Convention Center (CCC) Zoning district as set forth in the
City's Comprehensive Zoning Ordinance;
2. Property in or adjacent to the Lincoln Road C-3 Zoning District;
3. Property at 13th Street and Collins Avenue (southwest and northeast
corners); and,
4. Non-oceanfront property in the South Pointe Redevelopment Area.
NOW, THEREFORE, BE IT RESOLVED that the City Commission of the City of Miami
Beach, Florida transmits the proposed Ordinance amending the City's Comprehensive Plan to
the State of Florida Department of Community Affairs pursuant to the regulations as set
forth in the State of Florida Comprehensive Planning and Land Use Development Act.
