99-23218 RESO RESOLUTION 99-23218 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AMENDMENT NO.1 TO THE AGREEMENT WITH ROBERT A. M. STERN ARCHITECTS (STERN), FOR THE CUL TURAL CAMPUSIREGIONAL LIBRARY PROJECT, IN AN AMOUNT NOT TO EXCEED $91,035, FOR ADDITIONAL SERVICES ON THE PROJECT FOR STREETSCAPE DESIGN AND CONSTRUCTION DOCUMENTS; AND TO ADJUST STERN'S COMPENSATION FOR BASIC ARCHITECTURAL ENGINEERING SERVICES, UNDER ITS AGREEMENT WITH THE CITY DATED SEPTEMBER 23, 1998, FROM THE ORIGINAL AMOUNT OF $1,125,000 TO $925,000 AS A RESULT OF THE DELETION OF THE 400 SPACE PARKING GARAGE; FURTHER REQUESTING THAT STERN HOLD THE COST OF DESIGNING THE PARKING GARAGE AT ITS ESTIMATED COST OF $200,000, SHOULD THE CITY NOTIFY THEM TO INCORPORA TE SAME INTO THE CULTURAL CAMPUSIREGIONAL LIBRARY PROJECT WITHIN TWENTY-FOUR MONTHS OF THE ORIGINAL AGREEMENT DATED SEPTEMBER 23, 1998. WHEREAS, on September 23, 1998, the Mayor and City Commission adopted Resolution No. 98-22904, authorizing the Administration to execute an Agreement with the firm of Robert A. M. Stem Architects (Stem) (the Agreement) for the architectural and engineering design of a Regional Library; a 400-space Parking Garage; and Park and Streetscape Improvements in the area surrounding Collins Park (the Project); and WHEREAS, due to developments in the acquisition of the properties required for the construction of the Project, as set forth above, the proposed 400-space parking garage has been deleted from the scope of the Project; and WHEREAS, two surface parking lots will be provided in place of the originally proposed Parking Garage; and WHEREAS, on April 17, 1999, Stem presented the Master Plan for the Cultural Campus and the Schematic Design for the Regional Library to the Mayor and City Commission; and WHEREAS,as part of further negotiations, the City Manager was directed to negotiate an amendment to the Agreement to deal with the development of the streetscape design and construction documents for the area around Collins Park; the parking lot East of Collins; and the blocks around the Miami City Ballet building and the proposed Regional Library; and WHEREAS,the Administration is herein requesting approval of Amendment No.1 to the Agreement with Stem, in an amount not to exceed $91,035, for additional services on the Project for the streetscape design and construction documents; and to adjust Stem's compensation for basic architectural engineering services, under its Agreement with the City dated September 23, 1998, from the original amount of $1,125,000 to $925,000 as a result of the deletion of the 400 space parking garage; further requesting that Stem hold the cost of designing the parking garage at its estimated cost of $200,000, should the City notify them to incorporate same into the Cultural Campus/Regional Library project within twenty-four months of the original Agreement dated September 23, 1998. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein authorize Amendment No.1 to the Agreement with Robert A. M. Stem Architects (Stem), for the Cultural Campus/Regional Library project, in an amount not to exceed $91,035, for additional services on the Project for streetscape design and construction documents; and to adjust Stem's compensation for basic architectural engineering services, under its Agreement with the city dated September 23, 1998, from the original amount of$1,125,000 to $925,000 as a result of the deletion of the 400 space parking garage; further requesting that Stem hold the cost of designing the parking garage at its estimated cost of $200,000, should the City notify them to incorporate same into the Cultural Campus/Regional Library project within twenty-four months of the original Agreement dated September 23, 1998. RECOMMENDATION: Adopt the Resolution. FUNDING: Funds are available in work order No. 372.2181.069357. BACKGROUND: On September 23, 1998, the Mayor and City Commission adopted Resolution No. 98-22904 authorizing the Mayor and City Clerk to execute an agreement with the firm of Robert A. M. Stern Architects (Stern) for the architectural and engineering design of a Regional Library, a 400-space Parking Garage, and Park and Streetscape Improvements in the area surrounding Collins Park. On November 18, 1998, the City Commission directed the Administration not to proceed with the design of a 400-space Parking Garage and to instead design two surface lots on parcels 2 and 4. On FUNDING APPROVED 105 AGENDAITEM~ DATE ~-~3-9'1 Mar1ag January 6, 1999, the Mayor and City Commission authorized appropriation of the funding necessary to implement the architectural and engineering design agreement with Stem for the Cultural Campus/Regional Library in the amount of $1,370,000 and authorized an amendment to said agreement which reflected a change in scope deleting the 400 space parking garage facility and providing two surface lots in its place. On February 17, 1999, Stem presented the Master Plan for the Cultural Campus and the Schematic Design for the Regional Library to the City Commission. During the discussion, the Administration was directed to negotiate an amendment to the agreement with Stem to deal with the development of the streetscape design and construction documents for the area around Collins Park, the parking lot east of Collins, and the blocks around the Miami City Ballet building and the Regional Library. Stem was to include an estimate of the associated costs to the improvements and the Administration was directed to identify a funding source for the project. ANALYSIS: The Administration is now requesting approval of Amendment No. 1 to the agreement with Stem in the not to exceed amount of$91,305 for the additional services required to design and prepare construction documents for the area around Collins Park, the parking lot East of Collins, and the blocks around the Miami City Ballet building and the Regional Library. This amount is based on a proposal presented by Stem in response to the request for additional services (Attachment No. I). As of the writing of this memo, the Administration is negotiating further the additional fees with Stem and expects a reduction in the requested amount. Definition of the scope of services and discussions on the costs assigned to the individual tasks are in progress and the final agreement should reflect a lower amount. The scope of the services include design of sidewalks, pedestrian ramps, curbs and gutters, tree pits, landscaping and irrigation, selection and location of benches, bike racks and trash receptacles, design of street lighting and obtaining design approvals and permits from City agencies. The project's design and the preparation of construction documents is estimated to last six weeks. The Administration also seeks approval for the reduction of the fee for basic architectural engineering services from the original amount of$I,125,000 to $925,000 resulting from the deletion of the 400 space parking garage from the scope of services; and for the provision that Stem hold the cost of designing the parking garage at the original fee of $200,000, if the city notifies Stem to incorporate it into the project within twenty-four months of the original agreement dated September 23, 1998. CONCLUSION: The Mayor and the City Commission should approve Amendment No.1 to the agreement with Robert A. M. Stem Architects, in the not to exceed amount of $91,035, for additional services on the Cultural Campus/Regional Library project, for streetscape design and construction documents; 106 to reduce Stem's compensation for basic architectural engineering services from the original amount of$1,125,000 to $925,000 for the deletion of the 400 space parking garage; and for Stem to hold the cost of designing the parking garage at the original fee of $200,000 should the City determine to incorporate it into the project within twenty-four months of the original agreement. \f\~9 \ _ i~ SRJMSDIMDB/JGdfJECh '.
