97-22441 RESO RESOLUTION NUMBER 97-22441 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ISSUANCE OF A CHANGE ORDER INCREASE IN THE AMOUNT OF $35,472 TO METCALF & EDDY UNDER STANDING ORDER # 0007602000 TO PROVIDE FOR THE COMPLETION OF THE CONTAMINATION ASSESSMENT AND DEVELOPMENT OF A REMEDIAL ACTION PLAN FOR THE NORMANDY SHORES GOLF COURSE MAINTENANCE FACILITY AND APPROPRIATING THE FUNDS FROM REALLOCATED BOND FUND 351 INTO EXISTING WORK ORDER # 2066 TO FUND THE WORK. WHEREAS, it has been determined that hazardous waste contamination exists at th.;: Normandy Shores Golf Course maintenance facility; and WHEREAS, the City engaged the environmental engineering firm of Metcalf & Eddy t) begin the assessment of the extent of the contamination on the golf course; and WHEREAS, Metcalf & Eddy has successfully completed the scope of work include~ in 1 he r Professional Services Agreement with the City; and I , WHEREAS, the data obtained during this initial phase of work did partially deli~eatf tr e extent of the contamination at the facility, the entire extent of the contamination has not ~et hee III delineated; and I WHEREAS, the City is now required to prepare a Contamination Assessment IPlar f( r submission to the Dade County Department of Environmental Resources Management DElUv) describing the steps that will be taken to complete the assessment of the extent of contamin ion; ar d WHEREAS, after the DERM has approved the Assessment Plan, the City will be required to implement the plan by installing the prescribed number of monitoring wells, advan ing so IiI borings, collecting & analyzing the corresponding samples and compiling the resul s into a Contamination Assessment Report for submission to the DERM; and WHEREAS, once the extent of the contamination has been delineated, the City ust tht n have a Remedial Action Plan prepared which describes the steps that will be taken to rem diate tl e contamination; and WHEREAS, it is in the best interest of the City to allow the existing contractor to omple e the required work at the site through the development of the Remedial Action Plan, to e sun: tl e consistency and defensibility of the work product; and WHEREAS, funding in the amount of $35,472 is available in Reallocated Bond Fund ~:,5] . BACKGROUND As a result of the discovery of extensive industrial and agricultural waste contamination at the ~ay~ ho !:e Golf Course maintenance yard, the subsequent enforcement actions taken by the Dade County ~ep(lrtnent of Environmental Resources Management (DERM), and the resulting dispute that has developed between t Ie City and the City's former golf course operator, American Golf Corporation, the City engaged the ~nvim mental engineering firm of Metcalf & Eddy to initiate an assessment of the Normandy Shores GolfCour1e main enance yard to determine if the soil and groundwater in the area were also contaminated. I The results of the initial phase of assessment work did reveal that the soil and groundwat r bfne lth the maintenance yard area are contaminated with arsenic and other agricultural chemicals. While t e in tic! I phase of work did partially delineate the extent of the contamination at the facility, the entire extfnt of the contamination has not yet been delineated. The City is now required to prepare a Contamination Assessment Plan for submission to th Dade .:::ounty Department of Environmental Resources Management (DERM) describing the steps that w 11 be tlken to complete the assessment of the extent of contamination. Once the DERM has reviewed an aprro 'ed the Assessment Plan, the City will be required to implement the plan by installing the prescri ed nurnber of monitoring wells and soil borings, collecting and analyzing the corresponding samples and compo ing tht. results into a Contamination Assessment Report for submission to the DERM' AGENDA IT M _.(3..6 DA E_l2Bl After the DERM has reviewed and approved the assessment report, the City will then be required to have a Remedial Action Plan prepared which will describe the steps that will be taken to remediate the cont,lffi nation. Implementation of the site remediation efforts will be required following the DERM's approval ofthe ~P. The City is involved in a dispute with American Golf Corporation, the former golf course opera1or which pertains to their operation of the course. American Golfhas been put on notice that the City holds ther 1 liable for the costs associated with assessing and remediating the golf course. The City Attorney's Office i:. iI volved in on-going negotiations with American Golfs representatives. However, no agreements regarding AIlerican Golfs financial participation have yet been reached. ANALYSIS At the onset of an environmental site assessment, it is not possible to anticipate accurately theltota e: .:tent of contamination at a site. Therefore, ifthe contamination proves to be too extensive to be fully delineate, by the initial scope of work, a second estimate of the amount of work that will be required to complete the a ss( ssment is developed, and the contractor is authorized to complete that next phase of the assessment. WNle this nethod does require the issuance of multiple contracts or change orders, the process allows for the compl te a ss( ssment of a site, while minimizing costs. Because the City's dispute with American Golf Corporation may lead to litigation, it is in the bes intere~t of the City to allow the existing contractor to complete the required work at the site through the deve opmer t of the Remedial Action Plan, to ensure the consistency and defensibility of the work product. The im emfut ILtion of the actual remediation or clean-up of the site will be competitively bid subsequent to the a prova of the Remedial Action Plan by the DERM. The completion of the assessment and the development of the remedial action plan will cost $35, 72 and should be appropriated from Bond Fund 351 into existing Work Order # 2066 to fund the work.
