97-22443 RESO RESOLUTION NO. 97-22443 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A FIRST AMENDMENT, IN THE LUMP SUM AMOUNT OF $18,000, TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY AND DR. DAVID SANTISTEBAN FOR DEVELOPMENT /VALIDATION OF NEW WRITTEN TESTS FOR THE SERGEANT OF POLICE AND LIEUTENANT OF POLICE CLASSIFICATIONS. Whereas, the Fraternal Order of Police bargaining unit contract requjrEs in part that the City Human Resources Director shall cause to be develcpE:i validated tests which closely measure the knowledge, skills and abilities c,f a Miami Beach Sergeant of Police and a Miami Beach Lieutenant of Police; and Whereas, the Fraternal Order of Police bargaining unit contract furthEr requires that the promotional examinations for Sergeant and Lieutenant- sf.all include a written test; and Whereas, the performance of test validation will help the City comply ~'ith Federal law, especially Title VII of the Civil Rights Act and the Federal UnifoITI Guidelines on Employee Selection Procedures; and Whereas, the City, through a competitive bidding process, entered jnt~ Professional Services Agreements with Dr. David Santisteban (Consultant), as lc# bidder, on June 1, 1990, for written test development for the Sergeant of Police classification, and on October 10, 1990, for the Lieutenant of Police classification; and the City entered into Professional Services Agreements ~it~ the Consultant, on October 12, 1992, for job analysis and test developm~nt ani validation for the Sergeant of Police and Lieutenant of Police classificaticns; and, on March 31, 1995, for test development/validation for the Sergeant cE Police and Lieutenant of Police classifications; and Whereas, the Consultant is therefore familiar with these classification3 and with City procedures; and Whereas, the Mayor and City Commission wish to expedite the administratic] of these examinations and therefore deem it to be in the best interest'of the City to amend the Professional Services Agreement between the City and th e Consultant for test development/validation for the Sergeant of Police ~nd the Lieutenant of Police classifications; and Whereas, the cost for the additional services will be charged to the] Police Department Professional Services Account. DAVID SANTISTEBAN FOR DEVELOPMENT AND VALIDATION OF WRITTEN TESTS FOR THE SERGEANT OF POLICE AND LIEUTENANT OF POLICE CLASSIFICATIONS TO: SUBJECT: ADMINISTRATION RECOMMENDATION: It is recommended that the Mayor and the City Commission authorize a first amendment to th~ Professional Services Agreement with Dr. David Santisteban (Consultant) for development and validation of written tests for the Sergeant of Police and Lieutenant of Police classificatibns. CONTRACT AMOUNT AND FUNDING: The cost of the services will be $18,000.00, charged to the Police Department's Profession,,1I Services Account No. 011.1130.000312. BACKGROUND: Through competitive bidding procedures, the City of Miami Beach has previously ent$red in!:> Agreements with Dr. David Santisteban as low bidder. On June 1, 1990, the City contra~ted Witl Dr. Santisteban for the Sergeant of Police classification and, on October 10, 1990j for th~ Lieutenant of Police classification. These two Agreements included the development of writte 1 tests only and did not include job analysis or written test validation. On October 12, 1992,! the City entered into a subsequent Agreement with Dr. Santisteban again for the Sergeant and Li$utenar t of Police classifications. This project was much wider in scope than the first one, Umder thli S Agreement, the Consultant conducted thorough job analyses, developed the two writ~en t'~st S based upon the results of the job analyses, and validated the written tests for the Serg$ant an :l Lieutenant of Police classifications, The City entered into another Agreement with Dr. Saotistebal on March 31, 1995, to develop and validate written tests for the classifications of Sergeant pf Polic3 and Lieutenant of Police. The current Agreement Between City of Miami Beach, Florida and Miami Beach Fraterrlal O"dET of Police (FOP) contains the following language: . DATE C.1i B 1-~-9'L AGENDA ITEM July 2, 1997 Page Two BACKGROUND (Continued): "Section 1 - Advancement to the ranks of Sergeant and Lieutenant shall be by examinations that measure the knowledge, skills and ability of personnel and by seniNit". A promotional test will be given every eighteen (18) months. Section 2 - Eligible applicants for the promotional examination for Sergeant ar d Lieutenant shall be given a two-part test, consisting of a validated, written examinatic n which shall comprise thirty-five percent (35%)of the final test score,.. " ANAL YSIS: In order to comply with Federal law and the Fraternal Order of Police Agreement, it is necessal y to develop examination processes which include validated written tests. In requestin~: an amendment to the Professional Services Agreement with Dr. Santisteban, the following facts \i'/ele considered: 1) The City must comply with the FOP Agreement (see Background above), so time is a facto: . 2) Dr. David Santisteban is thoroughly familiar with the Sergeant and Lieutenant of Police classifications in the City of Miami Beach, and he has conducted job analyses, and developed and validated written tests for these classifications. 3) Dr. David Santisteban was sole bidder or low bidder on the previous Requests For Propose:ll fflr Sergeant and Lieutenant of Police written test development. The scope of the original Agreement with Dr. David Santisteban will be enlarged to include updatES of the job analyses. The Consultant will draw upon his recent experience with the Unit~d StatEs Department of Justice related to City of Miami Beach Police Officer and Firefighter job!anays s methodology when updating the job analyses. This will strengthen the validation processi As wi'h the original Agreement, the Consultant will revise previously developed written tests based upc n the job analyses, laws, practices, and reading sources; and validate these new written tests. Each of these steps is essential for meeting the criteria set forth in Title VII of the Civil Right~ Act t~ e Federal Uniform Guidelines on Employee Selection Procedures, and the terms of the FO::> Agreement. The price quoted for this Agreement with Dr. David Santisteban for job analyses update$, wntten test development and validation for the Sergeant and Lieutenant of Police classifications ($18,JOi!I) includes all out-of-pocket and other expenses. 2 July 2, 1997 Page Three CONCLUSION: Dr. David Santisteban has extensive experience in written test development and validation fef promotional Police classifications. Further, Dr. Santisteban performed these services for the Ciiy of Miami Beach for prior Police promotional examinations. Dr. Santisteban was the low biddm ( f the sole bidder for previous Requests For Proposals.
