A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE
FLORIDA LEGISLATURE TO ENACT SENATE BILL 1912,
AND ITS RELATED BILL, HOUSE BILL 1581, WHICH
WOULD CREATE A CRIMINAL PENALTY FOR INDIVIDUALS
WHO, AFTER A WARNING, APPROACH LAW
ENFORCEMENT OFFICERS WITH THE INTENT TO IMPEDE,
PROVOKE, OR HARASS OFFICERS; JOINING THE MIAMI-
DADE COUNTY BOARD OF COUNTY COMMISSIONERS IN
ITS SUPPORT OF THE LEGISLATION; AND DIRECTING THE
CITY CLERK TO TRANSMIT THIS RESOLUTION TO THE
PRESIDENT OF THE FLORIDA SENATE AND THE
SPEAKER OF THE FLORIDA HOUSE OF
REPRESENTATIVES.
WHEREAS, law enforcement officers serve critical roles in keeping our
community safe and must be allowed to do their jobs effectively; and
WHEREAS, Senate Bill ("SB") 1912, and its related bill, House Bill ("HB") 1581,
have been filed for consideration during the 2021 Florida Legislative Session; and
WHEREAS, SB 1912 and HB 1581 make it a misdemeanor of the second degree
for an individual who, after receiving a warning from a law enforcement officer not to
approach, violates such warning and approaches or remains within 30 feet of a law
enforcement officer who is engaged in the lawful performance of any legal duty with the
intent to interrupt, disrupt, hinder, impede, or interfere with the law enforcement officer's
ability to perform such duty; and
WHEREAS, in addition, the bills provide the same criminal penalty for an
individual who fails to heed such a warning with the intent to provoke a physical
response from the law enforcement officer or directly or indirectly harass the law
enforcement officer; and
WHEREAS, on March 16, 2021, the Miami-Dade Board of County
Commissioners adopted Resolution No. 210622, declaring its support for SB 1912 and
HB 1581; and
WHEREAS, as such, the Mayor and City Commission declare their strong
support for SB 1912 and HB 1581, and any substitute or similar legislation which would
create a criminal penalty for individuals who, after a warning, approach law enforcement
officers with the intent to impede, provoke, or harass.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby urge the Florida Legislature to enact Senate Bill 1912, and its
related bill, House Bill 1581, which would create a criminal penalty for individuals who,
after a warning, approach law enforcement officers with the intent to impede, provoke,
or harass officers; join the Miami-Dade County Board of County Commissioners in its
support of the legislation; and direct the City Clerk to transmit this Resolution to the
President of the Florida Senate and the Speaker of the Florida House of
Representatives.
