A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE FINDINGS OF THE
ADMINISTRATION THAT THE PALACE BAR AND RESTAURANT MEETS THE
CRITERIA UNDER' CITY CODE SECTION 18-391; DESIGNATING THE
PALACE RESTAURANT AND BAR, LOCATED AT 1052 OCEAN DRIVE, AS A
LEGACY BUSINESS PURSUANT TO CHAPTER 18 OF THE CODE OF THE
CITY OF MIAMI BEACH; AND LISTING THE BUSINESS IN THE CITY'S
LEGACY BUSINESS REGISTRY.
WHEREAS, on January 13, 2021, and pursuant to Ordinance No. 2021-4390, the Mayor
and City Commission amended the City Code to establish the City's Legacy Business Registry,
and create a process for designating a business as a Legacy Business in the City of Miami Beach
(the "City"); and
WHEREAS, the purpose of the Legacy Business Registry is to "formally recognize and
honor longstanding business institutions that have contributed to and define the cultural and
historical identity of Miami Beach; and
WHEREAS, on March 17, 2021, at the request of Commissioner Michael GOngora, the
City Commission approved the nomination of the Palace Bar and Restaurant ("the Palace") as
a Legacy Business by a vote of 7-0; and
WHEREAS. according to City records and historic research, the original location of the
Palace was at 1200 Ocean Drive, and the Palace's business operations commenced at least as
early as 1991, and possibly as early as 1988; and
WHEREAS, in 2007, Thomas Donal!, a nightclub owner and designer from Michigan,
assumed control of the Palace and made major renovations and upgrades to the restaurant and
bar operation; and
WHEREAS, in 2009, the Palace decorated the 12th Street corner sign and crosswalk
with rainbow colors, marking the location as a South Beach landmark and a meeting place for
the LGBTQ+ community; and
WHEREAS, in 2016, the Palace hosted a special ceremony honoring victims of the Pulse
nightclub tragedy and highlighting the Palace's long standing and continuous message of
diversity, equality, and inclusion; and
WHEREAS, in July of 2017, the Palace closed its doors at 1200 Ocean Drive due to the
sale of the building; and
WHEREAS, in November of 2017, the Palace reopened at its current location at 1052
Ocean Drive; and
WHEREAS, the Administration has reviewed the proposal to designate the Palace.Bar
and Restaurant as a Legacy Business and concluded that it meets the minimum requirements
and criteria for designation as a Legacy Business, as set forth in Sec. 18-931 of the City Code.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby (i)
accept the findings of the Administration that the Palace Restaurant and Bar meets the criteria
under City Code Section 18-391; (ii) designate the Palace Restaurant and Bar, located at 1052
Ocean Drive, as a Legacy Business pursuant to Chapter 18 of the Code of the City of Miami
Beach; and (iii) list the business in the City's Legacy Business Registry.

SUBJECT:A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, ACCEPTING THE FINDINGS OF THE

RECOMMENDATION
The Administration has determined that the Palace Bar and Restaurant located at 1052 Ocean
Drive, meets the criteria under City Code Section 18-391, and is eligible, subject to City
Commission approval, to be designated as a legacy business and listed in the City's Legacy
Business Registry.
BACKGROUND/HISTORY
On January 13, 2021, the City Commission adopted Ordinance No. 2021-4390, which
established a process for designating Legacy Businesses in the City of Miami Beach. On
March 17, 2021, at the request of Commissioner Michael Gongora, the City Commission
approved the nomination of the Palace Bar and Restaurant as a Legacy Business.
ANALYSIS
The purpose of the Miami Beach Legacy Business Registry is to formally recognize and honor
longstanding business institutions that have contributed to and define the cultural and historical
identity of Miami Beach. Section 18-391 of the City Code sets forth the minimum requirements
and criteria, as well as the procedure for the designation of a legacy business establishment.
Minimum requirements an criteria. To be eligible for designation as a legacy business
establishment and listed on the Heritage Legacy Business Registry, a business must satisfy
each of the following minimum requirements and applicable criteria:
1. The business must be a commercial establishment that is open to the public including,without
limitation, a retail establishment, restaurant, drinking establishment, or other commercial

establishment.
2. The business must have operated continuously in Miami Beach for at least 25 years.
3.At the time of its nomination,the business may have no active or pending violations of the City
Code.
The Administration has concluded that the Palace Bar and Restaurant meets all of the above
requirements.
Additional requirements and criteria. The City Manager or City Manager's designee must find
that the business meets at least three of the following additional criteria:
1. The establishment is unique to Miami Beach, and the original location of the establishment is
located in Miami Beach.
2. The establishment has a demonstrated record of promoting the City of Miami Beach.
3. The establishment has contributed significantly to the history or identity of the City, or of a
particular City neighborhood.
4. The establishment has demonstrated a commitment to maintaining the unique physical
features, services, performances, customs, or traditions that define the business, including, but
not limited to design, crafts, cuisine, special events, or art forms.
The Administration has concluded that the Palace Bar and Restaurant meets all of the above
criteria.
Nomination and approval. On March 17, 2021, at the request of Commissioner Michael
Gongora, the City Commission nominated the Palace Bar and Restaurant for designation as a
legacy business establishment. The Administration has determined that the Palace Bar and
Restaurant meets the criteria set forth in Section 18-391 of the City Code, and is eligible,
subject to final City Commission approval, to be designated as a legacy business establishment
and listed in the City's Legacy Business Registry.
