97-22444 RESO RESOLUTION NO. 97-22444 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A THIRD AMENDMENT, IN THE LUMP SUM AMOUNT OF $60,000, TO THE PROFESSIONAL SERVICES AGREEMENT WITH BURROUGHS AND ROCKHILL, INCORPORATED, FOR DEVELOPMENT AND VALIDATION OF ASSESSMENT CENTERS FOR THE CLASSIFICATIONS OF SERGEANT OF POLICE AND LIEUTENANT OF POLICE. Whereas, the current Fraternal Order of Police (FOP) bargaining agreement states th it eligible applicants for the promotional examination for Sergeant and Lieutenant shall be given j n Assessment Center evaluation for the second part of the testing process; and Whereas,the performance of test validation will help the City comply with Federal la" , especially Title VII of the Civil Rights Act and the Federal Uniform Guidelines on Empl)y,:e Selection Procedures; and Whereas, the City, following a competitive bidding process, entered into a PrQfessionll Services Agreement with Burroughs and Rockhill, Incorporated (Consultant), as the top-ra:1kc d proposer, on October 25, 1995, for Assessment Center Development and Validation for the Sergeant of Police and Lieutenant of Police classifications (Agreement); and Whereas, on July 17, 1996, the Mayor and City Commission authorized aFil st Amendment to the Agreement; and Whereas, on May 7, 1997, the Mayor and City Commission authorized a Se'~OI Ild Amendment to the Agreement; and Whereas, as Consultant is familiar with the Sergeant and Lieutenant Of P)li:e classifications and with City procedures and the Mayor and City Commission wish to exIi>edit~ tie administration of these examinations, they herein deem it to be in the best interest of t* City :0 approve the attached Third Amendment to the Agreement for continued Assessme~t Cent~r Development/Validation for the Sergeant of Police and the Lieutenant of Police classificaLor s; I and j Whereas, the cost for the additional services set forth in the attached Third Am~ndr leI !It will be charged to the Police Department Professional Services Account. CONTRACT AMOUNT AND FUNDING: The cost of the services will be $60,000.00, charged to the Police Department's profession:!1 Services Account No. 011.1130.000312. BACKGROUND: The current Agreement Between City of Miami Beach, Florida and Miami Beach Frater~al C'rd~r of Police (FOP) contains the following language: i "Section 1 - Advancement to the ranks of Sergeant and Lieutenant shall be b~ examinations that measure the knowledge, skills and ability of personnel and by reniorit (. A promotional test will be given every eighteen (18) months. I Section 2 - Eligible applicants for the promotional examination for sergtant ar d Lieutenant shall be given a two-part test, consisting of a validated, written exam nation .' and an Assessment Center for the second part of the testing process. " i Through competitive bidding procedures, the City has previously entered into Profession I Sevic:e Agreements with BRI as top-ranked proposer. On October 25, 1995, the City contracte witt- BR.I for development and validation of Assessment Centers for the Sergeant and Lieutenant of Polic:e classifications and, on June 19, 1996, for the Fire Lieutenant and Captain classificatio s. AGENDA ITEM ~~._ DATE~1_ 1 July 2, 1997 Page Two BACKGROUND (Continued): The Professional Services Agreement with Burroughs and Rockhill, Incorporated (BRI), f( r Development and Validation of Assessment Centers for the Sergeant of Police and Lieutenant ( ,f Police Classifications was first amended on July 17, 1996, and again on May 5, 1997. ANALYSIS: In order to comply with Federal law and the Fraternal Order of Police Agreement, it is neces~;ar ~ to develop examination processes which include validated Assessment Centers. In req4esting .:1 third amendment to the Professional Services Agreement with BRI, the following faets wer3 considered: 1) The City must comply with the FOP Agreement (see Background above), so time is a factor, 2) BRI was the top-ranked bidder on the previous Requests For Proposal for Assessmel1t Cente r development for Police and Fire promotional exams. 3) BRI is thoroughly familiar with the Sergeant and Lieutenant of Police classifications in! the Cil ~ of Miami Beach, having developed and validated the prior Assessment Centers for t~ese classifications, 4) The additional services, while equivalent in scope to those in the original Agreemen~, will bE provided by BRI for $60,000 (previous low bid was approximately $93,000). 5) The Consultant's recent experience with the United States Department of Justice, r~lating t) the City of Miami Beach Police Officer and Firefighter permanent hiring processes, '4'ill hnlp strengthen project methodology. ' The price quoted for this Agreement with BRI for additional job analyses and devel~pmen / validation of Assessment Centers for the Sergeant and Lieutenant of Police classification; ($60,000) includes all out-of-pocket and other expenses. ! CONCLUSION: Burroughs and Rockhill, Incorporated, has extensive experience in assessmen ce1teT development and validation for promotional Police classifications, Further, BRI perform d thes.~ services for the City of Miami Beach for prior Police promotional examinations. NOW, THEREFORE, the Agreement is hereby amended as follows: 1. SCOPE OF WORK AND SERVICES REQUIRED The Scope of Work covered by this Third Amendment, to be performed by the Consultant includes, but is not limited to, continuing to conduct necessary job analyses and develop administer and validate Assessment Centers for each classification. The SGOrle of Work is more specifically set forth in Attachment A in the original Agreement. 2.
