A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY
CLERK TO RENEW A SERVICE AGREEMENT WITH BFI WASTE
SYSTEMS OF NORTH AMERICA, INC., FOR A TERM OF ONE YEAR
COMMENCING NOVEMBER 1, 2003 AND ENDING ON OCTOBER 31,
2004, FOR THE COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID
WASTE, YARD TRASH, BULK WASTE AND OPERATION OF THE CITY'S
SOLID WASTE MANAGEMENT FACILITY, PROVIDED FURTHER THAT
SAID RENEWAL OF THE SERVICE AGREEMENT IS CONTINGENT UPON
AND SUBJECT TO AN AMENDMENT TO THE SERVICE AGREEMENT TO
ALLOW ONLY FOR THE DISPOSAL OF REGULAR AND BULK YARD
TRASH AT THE CITY'S SOLID WASTE MANAGEMENT FACILITY,
LOCATED AT 2800 MERIDIAN AVENUE, AND ALLOW RESIDENTS TO
TRANSPORT SUCH ITEMS AT NO CHARGE IN A VAN OR TRAILER.
WHEREAS, the City issued a Request for Proposals NO.1 01-99/00 on May 24,
2000 to solicit proposals for a two-year contract for the collection and disposal of
residential solid waste, yard trash, bulk wastes, and operation of the City's solid waste
management facility; and
WHEREAS, on September 13, 2000, the Mayor and Commission authorized the
Mayor and City Clerk to execute a Service Agreement with BFI Waste Systems of North
America, Inc. commencing on October 18, 2000 and expiring on October 31,2002; and
WHEREAS, the terms of the Service Agreement allows for three additional one-
(1) year term renewals at the sole discretion of the City; and
WHEREAS, on September 26,2002, the Mayor and Commission authorized the
first one year term renewal which expires October 31, 2003; and.
WHEREAS, the Administration is satisfied with BFI Waste Systems of North
America, Inc. and its overall level of service, including responsiveness, customer
service and communication; and
WHEREAS, BFI Waste Systems of North America, Inc. has agreed to continue
the office paper-recycling program at City Hall; and
WHEREAS, BFI Waste Systems of North America, Inc. has agreed to implement
a management tracking system which will include a monthly meeting between the City
of Miami Beach, Sanitation Director and the General Manager of BFI; and
WHEREAS, BFI Waste Systems of North America, Inc. has agreed to implement
a monthly Neighborhood Pride Weekend; and
WHEREAS, BFI Waste Systems of North America, Inc. has agreed to work with
the City's Sanitation Division to develop an Anti-litter campaign.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City
Commission, upon recommendation of the Administration, herein authorizes the Mayor
and the City Clerk to renew a service agreement with BFI Waste Systems of North
America, Inc., for a term of one year commencing on November 1, 2003 and ending on
October 31, 2004, provided further that said renewal of the Service Agreement is
contingent upon and subject to an amendment to the Service Agreement to allow only
for the disposal of regular and bulk yard trash at the City's Solid Waste Management
Facility, located at 2800 Meridian Avenue, and allow residents to transport such items at
no charge in a van or trailer.

Should the City authorize the renewal of the BFI Waste Systems of North America, Inc. service
agreement?
Item Summarv/Recommendation:
The City Commission authorized the execution of a service agreement with BFI Waste Systems on
September 13, 2000, starting October 18, 2000 and ending on October 31,2002 and providing for three (3)
one (1) year renewals at the City's option. On September 10, 2002 the service Agreement was renewed for
an additional one (1) year term expiring October 31,2003.
The Administration's recommendation to renew the service agreement for one year is based on the
following:
1. Excellent customer service and low record of complaints.
2. Favorable results of a customer satisfaction telephone survey.
3. Additional services BFI has agreed to provide at no additional cost to the City.
BFI as part of their service agreement operates the Community Trash Recycling Center (CTRC) at 29th
street and Meridian avenue. In response to concerns by neighboring residents, administrative changes will
be made to the agreement and Construction and Demolition Debris and White Goods will no longer be
accepted at the CTRC, effective November 1, 2003. Other modification to definition of terms contained in
the agreement are currently being discussed with the concerned neighboring residents will be incorporated
once they are finalized. The construction and renovation of the existing facility will be sized to properly
handle the modified waste stream.
Based on the above, the Administration recommends the renewal of this service agreement for a one (1)
year term commencino November 1, 2003 and endino on October 3 1, 2004.

ANALYSIS
Browning Ferris Industries (BFI) Waste Systems of North America, Inc. has provided the
collection and disposal of residential solid waste and operation of the City's Community
Trash Recycling Center (CTRC) since October 31,2000. On September 26,2002, the
Mayor and Commission authorized the first one (1) year term renewal which expires
October 31,2003. The terms of the Agreement allows for three (3) additional one (1) year
renewals at the discretion of the City. This recommendation would constitute the second of
three (3) renewal options.
The recommendation to renew BFl's agreement for the second of three (3) one (1) year
terms has been made based on the following criteria:
1. Excellent customer service and a low record of complaints:
The Sanitation Division researched complaints logged by the City regarding missed
garbage pick-ups during one (1) year renewal period of the Agreement. This research
showed a decrease in complaints and an increase in responsiveness compared to the
previous contractor performance. BFI has averaged about 50 complaints per month, well
below the 127 allowed per the Agreement. Good communication with BFI field supervisors
and customer service representatives has been a key element in the success of this
Agreement.
2. Favorable results of a customer satisfaction telephone survey conducted by the.
City of Miami Beach, Neighborhood Services Department
The City of Miami Beach, Neighborhood Services Division, conducted a random customer
satisfaction telephone survey among 70 residents of Miami Beach that are serviced by BFI.
The results ofthe customer survey revealed that in general our residents are satisfied with
BFI's performance. The survey questions and results are attached.
3. Additional services to be provided by BFI at no additional cost to the City.
The Administration met with BFI to seek additional services at no cost to the City. BFI has
agreed to provide the following additional services effective November 1, 2003:
. BFI will continue the office paper-recycling program at City Hall using desk side
containers and 90 gallon wheeled carts. Equipment, training, employee information
and collection is provided by BFI at no cost to the City.
. BFI will implement a management customer service tracking system which will include
a monthly meeting between the City of Miami Beach, Sanitation Director and the
General Manager of BFI to discuss any operation issues.
. BFI will implement a monthly Neighborhood Pride Weekend in which the City will target
areas with illegal dumping problems and BFI will place containers and staff during
operational hours the first Saturday of each month to allow residents in the area to
dump unwanted items.
. BFI will work with the City's Sanitation Division to develop an Anti-litter campaign.
In addition, Community Trash Recycling Center which is part of the BFI agreement will
continue to be operated at the City's direction. This is a site used for temporary storage of
solid waste material en route to a landfill or recycling center.
There are no other facilities within or in close proximity to the City, which may be utilized by
the City's residents, contractors, or City crews for disposal of acceptable materials. The
facility provides an advantage to residents needing to dispose of acceptable items.
Under our current operational practices the following materials are being disposed at the
Community Trash Recycling Center:
1. Yard Trash - clean landscaping waste (residents and property owners or
their contracted landscapers)
2. Bulk Waste
. Household furniture
. Household trash - accumulations of a nature other than garbage or
yard trash, such as paper, magazines, and packaging.
. Remodeling and home repairs trash - waste material accumulated by
the homeowner or tenant during the course of self-performed
improvement projects.
. White Goods- domestic appliances such as refrigerators and water
heaters.
3. Construction and Demolition Debris- (residents and property owners or their
contractors)
The current operations are perceived by neighboring residents to produce significant truck
traffic. In practice, on the average, only one (1) BFI truck per day enters the facility to drop
of an empty roll-off container and pick-up a full one.
Due to concerns expressed by residents in the immediate area administrative changes will
be made to the agreement and Construction and Demolition Debris and White Goods will
be deleted from the agreement and no longer be accepted at the Community Trash
Recycling Center, effective November 1, 2003. Other modification to definition of terms
contained in the agreement are currently being discussed with the concerned neighboring
residents will be incorporated once they are finalized. The construction and renovation of
the existing facility will be sized to properly handle the modified waste stream.
CONCLUSION
The Administration recommends that the Mayor and Commission authorize the renewal of
the service agreement with BFI Waste Systems of North America, Inc. for a term of one (1)
year commencing on November 1, 2003 and ending on October 31,2004.

Dear Mr. Rodriguez-Terol,
On October 15th, 2003 the Mayor and City Commission adopted Resolution No. 2003-25386
authorizing the renewal of the above referenced Service Agreement between the City and BFI for the
collection and disposal of residential solid waste, yard trash, bulk waste, and operation of the City's
solid waste management facility, said renewal for a term of one (1) year, commencing November 1,
2003 and ending on October 31,2004. The renewal of the Agreement was further conditioned upon
the foregoing amendment to the Agreement, allowing only regular and bulk yard trash to be disposed
of at the City's solid waste management facility, located at 2800 Meridian Avenue, and for residents
to dump such items using vans or trailers at no charge.
The following are excerpts from the Service Agreement which reflect the aforestated amendment.

9.13 Acceptable Materials: "Acceptable Materials" shall include those items set forth under Sections ~
5.6, 5.12, 5.13, 5.26, 5.32, 5.33, and 5.34. Any waste containing biohazardous waste, hazardous
waste, industrial waste, infectious waste, or garbage shall not be deemed Acceptable Material.
Contractor shall be responsible for disposing of all Acceptable Materials delivered to the Facility. All
disposal shall be in accordance with current City, County, State and Federal laws and regulations.
If the aforestated amended terms and conditions meet your approval, please acknowledge, execute
and have same duly attested in the space provided below. Upon execution by the City, we will
forward a fully executed copy to your office for your records and this Letter Agreement will be
incorporated as an amendment to the above referenced Service Agreement.
