Attached for your information is Resolution No. 2021-48, adopted by the Mayor and City
Commission of City of West Miami on September 15, 2021.
RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF WEST
MIAMI OPPOSING THE COUNTY CODE AMENDMENTS, AS DRAFTED,
INFRINGING RIGHTS OF THE CITY REGARDING PUBLIC WORKS
CONSTRUCTION AND PERMITTING WITHIN EASEMENTS AND RIGHTS-OF-
WAY WITHIN THE CITY; PROVIDING FOR INSTRUCTIONS TO CITY CLERK;
PROVIDING FOR EFFECTIVE DATE.

RESOLUTION # 2021-48
RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF WEST MIAMI OPPOSING THE COUNTY CODE
AMENDMENTS, AS DRAFTED, INFRINGING RIGHTS OF THE
CITY REGARDING PUBLIC WORKS CONSTRUCTION AND
PERMITTING WITHIN EASEMENTS AND RIGHTS-OF-WAY
WITHIN THE CITY; PROVIDING FOR INSTRUCTIONS TO CITY
CLERK; PROVIDING FOR EFFECTIVE DATE.
WHEREAS, Miami-Dade County Commission on First Reading voted favorably
to enact an ordinance amending sections 2-103.1 and 2-103.4 providing exclusive
permitting jurisdiction to DTPW for construction work on certain roadways, except for
state highways; and
WHEREAS, the Second Reading of said ordinance that has been scheduled to
be heard before the Miami-Dade County Commission has been presently continued;
and
WHEREAS, the aforementioned proposed ordinance also prohibited
municipalities from requiring municipal permits and payment for fees for work on county-
owned or county-maintained right-of-ways or other roadways; and
WHEREAS, the aforementioned ordinance stated it is in the best interest of the
County to e the sole permitting agency for construction work for county-owned or
county-maintained right-of-ways and certain other roadways within the unincorporated
and incorporated areas of the County; and
WHEREAS, in addition to the objections of said ordinance, Miami-Dade County
League of Cities, MDCLC President, Joseph Corradino, Mayor of the Village of
Pinecrest addressed correspondence to Honorable Jose "Pepe" Diaz, Chairman of the
Miami-Dade County Commission requesting continuance of the second reading of said
ordinance to afford an opportunity to address municipal objections to said ordinance;
and
WHEREAS, the proposed Miami-Dade County ordinance is intrusive and
directed to create additional burdensome and bureaucratic conditions upon cities and
specially for work on applicants and City personnel; and
WHEREAS, local supervision and permitting is most adequate to address
individual needs of each municipality; and
WHEREAS, the City of West Miami finds that said proposed ordinance to Miami-
Dade County codes is undesirable and unduly inclusive .

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WEST MIAMI, FLORIDA:
Section 1. The foregoing "whereas" clauses and heading are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this
Resolution upon adoption thereof.
Section 2. The City of West Miami joins the rest of the municipalities in Miami-
Dade County in opposing proposed amendments to Article XII of Chapter 2 of the Code
of Miami -Dade County, Florida.
Section 3. The City Clerk is hereby directed to provide a copy of this
Resolution to all members of the Miami-Dade County Board of County Commissioners.
Section 4. This Resolution shall take effect immediately upon passage by the City
Commission and signature by the Mayor.
