OF ISRAELI TERRITORIES; DIRECTING THE CITY MANAGER TO AVOID

ITS PARENT COMPANY UNILEVER TO THE GREATEST EXTENT

3 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
4 THE CITY OF HALLANDALE BEACH, FLORIDA STRONGLY
5 OPPOSING THE LINE 3 TAR SANDS PIPELINE; AND
6 PROVIDING FOR AN EFFECTIVE DATE.

8 WHEREAS, the City of Hallandale Beach has committed to reducing greenhouse gas
9 emissions in line with the IPCC Special Report15 and acknowledges that fossil fuels contribute
10 significantly to anthropogenic climate change; and
11
12 WHEREAS, the IPCC's Sixth Assessment Report, released in August of 2021, stated it
13 is unequivocal that human influence has warmed the atmosphere, ocean, and land; and
14
15 WHEREAS, after six years of contentious regulatory hearings, the controversial
16 expansion and reroute of the Line 3 tar sands oil pipeline is now being constructed by the
17 Canadian corporation, Enbridge Inc, in northern Minnesota; and
18
19 WHEREAS, Line 3 is planned to be one of the largest crude oil pipelines in the world,
20 proposed to transport up to 915,000 barrels per day of toxic tar sands oil at a cost of over $4
21 billion; and
22
23 WHEREAS, according to the December 24, 2020, federal court filing against the U S
24 Army Corps of Engineers, "Tar sands oil production generates almost triple the global warming
25 pollution as conventional oil production due to the massive amounts of energy needed to
26 extract, upgrade, and refine the oil , and
27
28 WHEREAS, Line 3 is proposed to cut through treaty territory where the Anishinaabe
29 tribal members have treaty rights off of reservations that include hunting, fishing, and gathering
30 of wild rice; and
31
32 WHEREAS, the Red Lake and White Earth bands argue that construction of Line 3
33 would destroy their "treaty-protected interest" in the lands, water, plants, and animals, as well as
34 their cultural and religious rights; and
35

36 WHEREAS, pipeline construction increases rates of sex trafficking and violent crime,
37 specifically against Indigenous women and there have already been multiple arrests directly
38 connected to Enbridge workers; and
39
40 WHEREAS, tar sands oil extraction is the dirtiest, most destructive, and polluting oil on
41 the planet, and spills of the diluted bitumen from the tar sands are nearly impossible to clean up
42 since they have a tendency to sink to the bottom of water bodies; and
43
44 WHEREAS, based on the amount of carbon in the oil that a new Line 3 would move, it
45 would be roughly equivalent to building 50 new coal fired power plants; and
46
47 WHEREAS, the State of Minnesota calculated the "social cost of carbon" for a new Line
48 3 to be $287 billion over the first 30 years of the pipeline's life; and
49
50 WHEREAS, the pipeline is being built during a global movement to divest from fossil
51 fuels that has already divested over $11 trillion from fossil fuels and which the City of Hallandale
52 Beach has formally divested investments from firms deriving revenue from the direct or indirect
53 use of fossil fuels supported in Resolution 20-027, passed on May 5 2020
54
55 WHEREAS, more than 500 religious leaders have signed a letter strongly opposing Line
56 3 on moral grounds; and
57
58 WHEREAS, the Line 3 pipeline requires a "Presidential permit" to cross the United
59 States border, the same kind of permit that President Biden recently rescinded for the proposed
60 Keystone XL pipeline due to climate change concerns; and
61
62 WHEREAS, the original Line 3 pipeline (owned by Lakehead Pipeline Company) spilled
63 17 million gallons of crude oil in Michigan in the year 1991, and
64
65 WHEREAS, the average cost of a tar sand oil spill cleanup is on average $26,000 per
66 barrel as opposed to $2,000 per barrel for a standard oil spill; and
67
68 WHEREAS, Enbridge is responsible for the Kalamazoo River Oil Spill of 201 O, one of
69 the most colossal land based oil spills in the United States, costing approx. $1.2 Billion

7 1 WHEREAS, MPR news reports 28 releases since June 8th at 12 river crossings, while
72 the pipeline has been under construction

74 WHEREAS, a 2019 publication from John Hopkins School of Public Health states that
75 Volatile Organic Compounds emitted after an oil spill are known to have negative implications to
76 those exposed These health impacts include, but are not limited to headaches, alterations in
77 blood profiles, and lung cancer

79 WHEREAS, Benzene, a Volatile Organic Compound emitted after an oil spill, is a
80 recognized carcinogen and was recently the cause of a major recall of several spray on
81 sunscreens
82
83 WHEREAS, the National Ground Water Association states that only O 03% of water is
84 acceptable for human consumption, and the primary source of drinkable water comes from
85 rivers
86
87 WHEREAS, the Line 3 pipeline jeopardizes every body of water that it goes through, starting at
88 the Mississippi River going to Lake Superior

91 NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF
92 THE CITY OF HALLANDALE BEACH, FLORIDA:

94 SECTION 1. The foregoing "whereas" clauses are hereby ratified and confirmed as
95 being true and correct and are incorporated herein by this reference

97 SECTION 2. The Mayor and City Commission of Hallandale Beach strongly oppose the
98 Enbridge Energy Line 3 tar sands oil pipeline and call on every elected leader with the authority
99 to stop its construction to do so immediately

101 SECTION 3. The Mayor and City Commission of Hallandale Beach directs the Clerk of
102 the Board to transmit certified copies of this resolution to the White House, Senator Marco
103 Rubio, Senator Rick Scott, Representative Debbie Wasserman Schultz, the Broward County

19 WHEREAS, strong relations between the United States and Israel have led to
20 bilateral cooperation in many areas; and
21
22 WHEREAS, in 2016, the City Commission passed Ordinance 2016-12,
23 prohibiting the City from contracting with vendors engaging in boycotts, and explicitly
24 expressing the City's desire to protect the interests of its citizens by continuing to ensure
25 that the City will not be party to discriminatory business practices and boycotts; and
26
27 WHEREAS, in 2019 the City Commission passed Resolution 2019-012,
28 denouncing the "boycott, divestment and sanctions" (BOS) movement and other boycotts
29 of Israel; and
30
31 WHEREAS, the BOS movement seeks the "divestment" of university. municipal,
32 church, union and other investment portfolios from companies that advocates claim "aid
33 Israel's occupation", as well as the "boycott" of Israeli products, professionals, professional
34 associations and academic institutions, and artistic performances (in Israel and abroad)
35 and
36
37 WHEREAS, the BOS movement mirrors anti-Jewish/anti-Semitic tactics used by
38 the Nazi regime. When the Nazis came to power, the lives of German Jews changed
39 drastically. On April 1, 1933, the Nazis carried out the first nationwide, planned action

44 WHEREAS, on July 19, 2021 Ben & Jerry's announced plans to stop selling its
45 ice cream in the West Bank and Gaza, saying that sales in the "Occupied Palestinian
46 Territory" are "inconsistent with [their] values;" and
47
48 WHEREAS, both BDS and the Ben & Jerry announcement claim to be driven by a
49 principled concern for Palestinian human rights, but the idealistic message is arguably a
50 smokescreen for a nationalist agenda to abolish the State of Israel; and
51
52 WHEREAS, some supporters may genuinely believe that these efforts will
53 encourage Israel to change policies with which they disagree. However, the predominant
54 drive of the BDS campaign and its leadership is not criticism of policies, but the
55 demonization and delegitimization of Israel; and
56
57 WHEREAS, as of July 29, 2021, the State of Florida added Unilever PLC, the
58 parent company of Ben & Jerry's to the Scrutinized Companies that Boycott Israel list
59 maintained by the state pursuant to Florida Statute 215.4 725(a)(1). which prohibits
60 investments by the State Board of Administration in companies that boycott Israel; and
61
62 WHEREAS, the Mayor and City Commission of the City of Hallandale Beach will
63 not tolerate discrimination against the people of Israel.

65 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
66 COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:

68 SECTION 1. Recitals Adopted That each of the above recitals are hereby
69 adopted, confirmed, and incorporated herein
70
71 SECTION 2. Mayor and City Commission hereby denounce Ben & Jerry's
72 boycott of Israeli territories and further hold accountable its parent company, Unilever,
73 which fully controls the former, and direct the City Manager to avoid purchases, contracts
74 and investments with both companies to the greatest extent permitted by law, including,

77 SECTION 3. The Mayor and City Commission of the City of Hallandale Beach further urge
78 the pension boards of all Hallandale Beach pensions to avoid investments in Ben & Jerry's
79 and Unilever as long as they pursue their discriminatory course towards Israel.

81 SECTION 4 The City Clerk is hereby directed to forward a copy of the instant resolution
82 to all appropriate parties.

84 SECTION 5. This Resolution shall become effective immediately upon its adoption.
