A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, CREATING RESIDENTIAL PARKING PERMIT
ZONE THREE WITHIN THE AREA BOUNDED BY MICHIGAN AVENUE ON
THE EAST, LENOX COURT ON THE WEST, 12TH STREET ON THE SOUTH,
AND 15TH STREET ON THE NORTH; PURSUANT TO SECTION 44-84 OF THE
MIAMI BEACH CITY CODE.
'WHEREAS, pursuant to Section 44-84 of the Miami Beach City Code, the City Manager is
authorized to determine if a residential area is impacted by commuter vehicles in accordance
with the criteria set forth in Sections 44-82 and 44-83 therein, and after making such a
determination may initiate the creation of a residential parking area; and
'WHEREAS, residents within the affected areas concur on a need to restrict parking on 12th
Street, from Lenox Court to Michigan Avenue, and Michigan Avenue (east side) from 12th
Street to 15th Street, including the Flamingo Park Baseball Stadium Surface Parking Lot to be
restricted for Residential Zone Two and Residential Zone Three permit holders, during the hours
of 11 p.m. to 6 a.m.lseven days a week, and on Michigan Avenue (west side), and Lenox
,\venue (both sides) from 12th Street to 15th Street, and 13th Street and 14th Street between
Lenox Court and Michigan Avenue, 24 hours a day, seven days a week; and
'WHEREAS, a public hearing was duly noticed and held on July 2, 1997, following the
mailing of notices to every household that could reasonably be established within the area( s)
I mder consideration fifteen (15) days prior to the hearing date; and
\VHEREAS, the areas affected include:
Ivlichigan Avenue between 12th and 15th Streets, including the Flamingo Park Baseball Stadium
Parking Lot;
Lenox Avenue between 12th and 15th Streets;
. 2th Street between Michigan Avenue and Lenox Court;
3th Street between Michigan Avenue and Lenox Court;
:14th Street between Michigan Avenue and Lenox Court; and
llN"HEREAS, the following testimony at the July 2, 1997 public hearing, the Administration
lvould recommend creating Residential Parking Permit Zone Three within the area bounded by
I'vlichigan Avenue on the east, Lenox Court on the west, 12th Street on the south, and 15th Street
on the north; pursuant to Section 44-84 of the Beach City Code; and
llN"HEREAS, the Flamingo Park Baseball Stadium Surface Parking Lot will be restricted for use
by Residential Zone Two and Residential Zone Three permit holders, during the hours of 11 p.m.

~OW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the resolution

BACKGROUND:
( n May 22, 1997, the Police Department, Parks and Recreation Department, and Parking
Iepll1:ment held a "Joint Workshop" at the Flamingo Park Police Athletic League (PAL) facility
t( a,certain the viability of and demand for a Residential Parking Permit program. Several
a ternatives for implementation were discussed, including: areas to be restricted by signage, hours
o ~ r~strictions, fee structure, and visitor permit availability. Valuable input and insight were
p '0\ ided by the citizenry. A public hearing has been set in order to consider further public comment
n garding the proposed restrictions.

12th Street from Lenox Court to Michigan Avenue and Michigan Avenue (east side) from 12th

H esi dents must initially register for residential parking permit at the City of Miami Beach Parking
I epartment providing proof of residency such as a lease, mortgage, utility bill, etc. In the future,

I' romul~ation of Re~ulations:
Signs will be posted in the areas promulgating the appropriate restriction. Typically two to three
s gns per block face will be installed.
.Ii nfnrcement:
F'rogressive enforcement will commence 30 days after sale of permits commences in the form of
v arnings for a period of 15 days, followed by parking citations for a period of 15 days. Thirty (30)
d lY~: after commencement of permit sales, vehicle impoundment will be implemented, if necessary.
