A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
AUTHORIZING THE CITY ATTORNEY'S OFFICE AND THE MIAMI
BEACH POLICE DEPARTMENT TO PREPARE AND EXECUTE A
MEMORANDUM OF UNDERSTANDING WITH THE MIAMI-DADE
STATE ATTORNEY'S OFFICE, TO ESTABLISH A UNIFIED
TRACKING SYSTEM IN ORDER TO COMPILE AND OBTAIN MORE
ACCURATE AND ACCESSIBLE STATISTICAL DATA PERTAINING
TO THE PROSECUTION OF THOSE DEFENDANTS ARRESTED
FOR THE COMMISSION OF CRIMINAL OFFENSES WITHIN THE
CITY OF MIAMI BEACH.
WHEREAS, the City of Miami Beach (the "City") is a unique, coastal community
which, due to a myriad of factors, consistently experiences the commission of a -
significant amount of criminal, quality of life offenses; and
WHEREAS, the City is committed to reducing all crime (including misdemeanor,,
and quality of life offenses) and repeat offenses, and bringing social services to those;,
that may find it difficult to otherwise obtain such services; and
WHEREAS, on September 25, 2017, the Mayor and City Commission adopted
Resolution No. 2017-30023, which authorized the City Attorney's Office to commence
the in-house prosecution, by and through a City municipal prosecution team, of those
individuals exclusively charged with violating the City's criminal ordinances; and
WHEREAS, on December 8, 2021, the Mayor and 'City Commission adopted
Resolution No. 2021-31956 authorizing the City Manager to execute a Memorandum 'of
Understanding with Court Options, Inc., to provide the City's Municipal Prosecutor with
an appropriate mechanism to address first-time and qualifying offenders exclusively
charged with municipal ordinance violations; and
WHEREAS, the Miami -Dade State Attorney's Office remains the prosecutorial
entity responsible for the prosecution of criminal offenders arrested for the commission
of all felony, misdemeanor, and/or County ordinance violations (which also includes City
ordinance violations if committed in conjunction with any felony, misdemeanor or
County ordinance violation); and
WHEREAS, statistical crime and prosecution data, in conjunction with case
disposition data, can be utilized as an effective tool to acquire a detailed understanding
surrounding criminal conduct; and
WHEREAS, statistical data can also assist in identifying any challenges that may
have impacted the successful prosecution of those persons committing criminal
offenses in the City; and
WHEREAS, statistical crime and prosecution data can further assist in identifying .
any tools, policies. procedures and/or resources which may be utilized to aid in the
future prosecution(s) of criminal offenders; and
WHEREAS, the State Attorney has expressed her approval and support for a
Memorandum of Understanding ("MOU") between the City of Miami Beach and the
Miami -Dade State Attorney's Office pertaining to prosecutorial statistical data; and
WHEREAS, an MOU establishing a unified tracking system will allow the City
and the State Attorney's Office to both have more complete, consistent, and accurate .
statistical data; and
WHEREAS, the Mayor and City Commission desire to adopt this Resolution in
order to have more accurate, understandable, and readily -accessible statistical
prosecution data, which will allow for more effective evaluation of their previously -
adopted crime remediation measures, and further allow the Mayor and City Commission
to determine whether the implementation of any additional prosecutorial tools would
further support the Miami -Dade State Attorney's Office in its prosecutorial efforts and
protect the health, safety, and welfare of the City's residents, visitors and businesses.
NOW THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby approve and
authorize the City Attorney's Office and the Miami Beach Police Department to prepare
and execute a Memorandum of Understanding with the Miami -Dade State Attorney's
Office, to establish a unified tracking system in order to compile and obtain more
accurate and accessible statistical data pertaining to the , prosecution of those
defendants arrested for the commission of criminal offenses within the City of. Miami
Beach.
