A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, DIRECTING THE CITY ADMINISTRATION, AS
PART OF ANY REQUEST FOR PROPOSALS ("RFP") FOR THE SALE OR
LEASE OF THE NORTH SHORE BRANCH LIBRARY LOCATED AT 7505 AND
7515 COLLINS AVENUE (THE "LIBRARY SITE"), TO SPECIFY IN THE RFP
THAT ALL FIVE PARCELS COMPRISING THE LIBRARY SITE, INCLUDING
THE THREE CITY -OWNED WATERFRONT PARCELS LOCATED EAST OF
THE LIBRARY BUILDING AND CURRENTLY USED AS A SURFACE PARKING
LOT, SHALL REMAIN UNIFIED AND SHALL NOT BE SUBDIVIDED IN ANY
MANNER FOR PURPOSES OF THE SALE OR LEASE THEREOF, TO ENSURE
THAT THE SALE OR LEASE OF THE LIBRARY SITE IS SUBJECT TO VOTER
REFERENDUM APPROVAL, IN ACCORDANCE WITH SECTION 1.03(B)(1) OF
THE CITY CHARTER, RELATING TO THE SALE OR LEASE OF CITY -OWNED
WATERFRONT LAND.
WHEREAS, the City is the owner of the property comprised of five (5) parcels,
located at 7505 and 7515 Collins Ave, Miami Beach, which is currently the home of the
Miami -Dade County Branch North Shore Public Library (the "Library Site"), pursuant to
an Interlocal Agreement between the City and Miami -Dade County ("Interlocal
Agreement"); and
WHEREAS, the waterfront property located directly east of the library building and
adjacent parking lot fronting Collins Avenue, is comprised of three (3) separate parcels,
(Folio Numbers 02-3202-004-0360, 02-3202-004-0370, and 02-3202-004-0380) (the
"Waterfront Parcels") and is currently used as a surface parking lot, addressing critical
parking needs for the library and the broader Ocean Terrace area; and
WHEREAS, voter referendum approval respect to the sale or long-term lease of
the City's most important and valuable real estate assets is a core value enshrined in the
City's Charter; and
WHEREAS, currently, the Waterfront Parcels cannot be sold, leased, or otherwise
disposed without an approval by a majority vote of the voters in a City-wide referendum
in accordance with Section 1.03(b)(1) of the City Charter, which provides that the sale,
exchange, conveyance, or lease of ten (10) years or longer (including option periods) of
City -owned park, recreation, or waterfront property shall require approval by a majority
vote of the voters in a City-wide referendum; and
WHEREAS, the Mayor and City Commission direct the City Administration to
specify in the Requests for Proposals for the sale or lease of the Library Site that all five
(5) parcels comprising the Library Site, including the three city -owned Waterfront Parcels
located east of the Library Building, shall remain unified and shall not be subdivided in
any manner for purposes of the sale or lease thereof; and
WHEREAS, maintaining the unity of all five (5) parcels for purposes of any future
sale or lease of the Library Site will ensure that the Library Site is not subdivided to avoid
voter input into the sale, and that the entire transaction shall remain subject to voter
referendum approval, in accordance with section 1.03(b)(1) of the City Charter, relating
to the sale or lease of City -owned waterfront land.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the City Administration, as part of any Request for Proposals
("RFP") for the sale or lease of the North Shore Branch Library located at 7505 and 7515
Collins Avenue (the "Library Site"), to specify in the RFP that all five parcels comprising
the Library Site, including the three City -owned waterfront parcels located east of the
library building and currently used as a surface parking lot, shall remain unified and shall
not be subdivided in any manner for purposes of the sale or lease thereof, to ensure that
the sale or lease of the Library Site is subject to voter referendum approval, in accordance
with Section 1.03(b)(1) of the City Charter, relating to the sale or lease of City -owned
waterfront land.
