Resolution 2022-32019RESOLUTION NO., 2022-32019 A RESOLUTION OF .THE MAYOR AND CITY COMMISSION ACCEPTING A DONATION OF SURPLUS CAMPAIGN FUNDS, IN THE AMOUNT OF $49,599.53, FROM COMMISSIONER MARK SAMUELIAN, AND ACCEPTING THE CITY MANAGER'S RECOMMENDATION TO ALLOCATE THESE FUNDS TOWARD SCHOLASTIC CHESS INITIATIVES, IN RECOGNITION OF COMMISSIONER SAMUELIAN'S COMMITMENT TO EXPANDING OPPORTUNITIES FOR MIAMI BEACH RESIDENTS TO LEARN AND PLAY THE GAME OF CHESS. WHEREAS, in November 2021, Commissioner Mark Samuelian was re-elected without opposition to a second, four-year term as City Commissioner, Group 2; and WHEREAS, under Section 106.141, Florida Statutes, "each candidate who ... becomes an unopposed candidate ... or elected to office shall, within 90 days, dispose of the funds on deposit in his or her campaign account' as provided in the statute; and WHEREAS, a candidate required to dispose of surplus campaign funds may "give the funds that have not been spent or obligated ... to a political subdivision, to be deposited in the general fund thereof' pursuant to Section 106.141(4)(a)4.b, Florida Statutes; and WHEREAS, under Section 1.01 of the Florida Statutes, the City of Miami Beach ("City") is a political subdivision within the meaning of Section 106.141(4)(a)4.b, Florida Statutes; and WHEREAS, Commissioner Samuelian wishes to donate surplus campaign funds, in the amount of $49,599.53, to the City's general fund; and WHEREAS, the Mayor and City Commission accept, with gratitude, Commissioner Samuelian's donation of surplus campaign funds; and WHEREAS, as a former national chess master, Commissioner Samuelian actively sponsors scholastic chess programs across Miami Beach schools; and WHEREAS, in recognition of Commissioner Samuelian's leadership with regard to youth chess initiatives, the City Manager recommends that Commissioner Samuelian's donated surplus campaign funds be used to support chess programming, such as lessons, competitions, or other activations; purchase chess sets for use in City parks and other facilities; and sponsor participation in Miami Beach schools, and by Miami Beach residents, in scholastic chess programs or events; and WHEREAS, the Mayor and City Commission hereby accept the City Manager's recommendation, find that a public purpose would be served, and allocate Commissioner Samuelian's donated funds toward scholastic chess initiatives in Miami Beach. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept a donation of surplus campaign funds, in the amount of $49,599.53, from Commissioner Mark Samuelian, and accept the City. Manager's recommendation to allocate these funds toward scholastic chess initiatives, in recognition of Commissioner Samuelian's commitment to expanding opportunities for Miami Beach residents to learn and play the game of chess.
