Resolution 2022-32009RESOLUTION NO. 2022-32009 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE NATIONAL INSTITUTE OF HEALTH TO IMMEDIATELY CEASE FUNDING ANY RESEARCH THAT USES ANIMAL TESTING, PARTICULARLY BEAGLES; EXPRESSING SUPPORT FOR H.R. 2565, ENTITLED "FDA MODERNIZATION ACT," WHICH WOULD END OUTDATED FDA MANDATE THAT EXPERIMENTAL DRUGS MUST BE TESTED ON ANIMALS; AND DIRECTING THE CITY CLERK TO TRANSMIT THIS RESOLUTION TO THE NATIONAL INSTITUTE OF HEALTH. WHEREAS, the City of Miami Beach (the "City") and the Mayor and City Commission are deeply committed to the welfare of animals; and WHEREAS, the Mayor and City Commission are in support of H.R. 2565, entitled the "FDA Modernization Act", a bi-partisan bill introduced on April 15, 2021, to end an outdated FDA mandate that experimental drugs must be tested on animals before they are used on humans in clinical trials; and WHEREAS, if adopted, H.R. 2565 would amend the Federal Food, Drug, and Cosmetic Act to allow manufacturers and sponsors of a drug to use alternative testing methods to animal testing to investigate the safety and effectiveness of a drug, and for other purposes; and WHEREAS, alternative testing methods may include cell -based assays, organ chips and microphysiological systems, sophisticated computer modeling, and other human biology -based test methods. WHEREAS, the National Institute of Health ("NIH"), is one of the largest funders of research that uses animals in preclinical trials, however, 51%-89% of preclinical research is faulty and it is estimated that $14 billion to $25 billion in animal research is wasted'; and WHEREAS, according to the Animal Legal Defense Fund, it is estimated that the NIH spends some $14.5 billion per year on animal experimentation; and WHEREAS, based on the routine inspections conducted in July, 2021, officials from the U.S. Department of Agriculture cited Envigo — an Indianapolis -based firm that breeds dogs and sells them as research animals to the NIH, and other pharmaceutical and biotechnology industries — for mistreatment of beagles and poor conditions at the facility in Virginia; and WHEREAS, on October 26, 2021, Shannon Keith, President and founder of the Beagle Freedom Project, a nonprofit 501(c)(3) animal advocacy and rescue organization based in the United States, wrote a letter calling on the NIH to immediately stop funding any research that uses animals, particularly beagles, which are often selected for animal testing due to their sweet and docile natures. See Exhibit A attached to this Resolution, NIH under investigation for $1.2M purchase of beagles for "hideous" experiments; and WHEREAS, the National Institute of Health published an article by respected M.D., M.P.H., Aysha Akhtar about The Flaws and Human Harms of Animal Experimentation, which states "... animal experimentation often significantly harms humans through misleading safety I Source: Herrman, K. (2019) Animal Experimentation: Working Towards a Paradigm Change]. studies, potential abandonment of effective therapeutics, and direction of resources away from more effective testing methods. The resulting evidence suggests that the collective harms and costs to humans from animal experimentation outweigh potential benefits and that resources would be better invested in developing human -based testing methods." 2; and WHEREAS, the Mayor and City Commission demands that the NIH Health immediately cease the use of animals in research, end funding of those using animals, and release those animals who are currently in laboratories to the Beagle Freedom Project. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby urge the National Institute of Health to immediately cease funding any research that uses animal testing, particularly beagles; express support for H.R. 2565, entitled "FDA Modernization Act," which would end outdated FDA mandate that experimental drugs must be tested on animals; and direct the City Clerk to transmit this Resolution to the National Institute of Health.
