Steel Hector & Davis LLP 200 South Biscayne Boulevard Suite 4000 Miami, Florida 33131-2398 EASEMENT The undersigned, owner of the property described below, in consideration of the payment of$1 0.00 and other good and valuable consideration, the receipt, sufficiency and adequacy of which is hereby acknowledged, does hereby grant, convey and assign to Florida Power & Light Company, a Florida corporation, whose address is Post Office Box 14000, Juno Beach, Florida 33408-0429, and its successors and assigns, a perpetual easement for the construction, installation, operation and maintenance of underground electric utility facilities, including lines, conduits, anchors, cables, terminals, markers, boxes, manholes, underground cables and wires and all other amplifiers, boxes, appurtenances, devices, utility lines and mains, within the property more particularly described on Exhibit A attached hereto and made a part hereof (the "Easement Area"). Together with the right from time to time to permit any other person, firm or corporation to attach wires to any facilities hereunder and lay cable and conduit within the Easement area and to operate same for communication purposes; the right from time to time to reconstruct, alter, improve, change the size of and remove such facilities or any of them, and together with all rights and privileges necessary and convenient for the use ofthe easement granted hereby, including, without limitation, the right to clear the land and keep it cleared of all improvements, including trees, undergrowth or other obstructions within the Easement Area, to trim and cut and keep trimmed and cut all leaning or dangerous trees or limbs outside ofthe Easement Area which might interfere with or fall upon such facilities; and further grants the rights hereinabove granted over, along, under and across the roads, streets or highways adjoining or through the Easement Area, and the right of ingress and egress for personnel and equipment of Florida Power & Light Company, its successors, agents, successors or assigns, of the adjoining lands of the undersigned for the purpose of exercising and enjoying the rights granted by this Easement. The easement rights granted hereunder shall run with the land and shall be binding upon and inure to the benefit of Florida Power & Light Company, and its successors and assigns.
