A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, DIRECTING THE CITY
ADMINISTRATION TO PROVIDE A WEEKLY LETTER TO COMMISSION
("LTC") AND POST ON THE CITY WEBSITE ANY INFORMATION AVAILABLE
TO THE CITY RELATING TO ROAD CONSTRUCTION WORK TAKING PLACE
THROUGHOUT THE CITY, INCLUDING WORK ON STATE-OWNED OR
COUNTY -OWNED ROADS, OR WORK PERFORMED BY UTILITY
COMPANIES, INCLUDING, WITHOUT LIMITATION, INFORMATION
RELATING TO ANY LANE CLOSURES OR OTHER MAINTENANCE OF
TRAFFIC RESTRICTIONS, AND THE LOCATIONS AND TIMES THEREOF,
WITH THE WEEKLY LTC TO INCLUDE INFORMATION REGARDING
EFFORTS MADE TO MITIGATE TRAFFIC CONGESTION CAUSED BY SUCH
PROJECTS.
WHEREAS, the Florida Department of Transportation ("FDOT") is an executive agency in
the State of Florida whose mission is to provide a safe transportation system that ensures the
mobility of people and goods, enhances economic prosperity, and preserves the quality of the
State's environment and communities; and
WHEREAS, FDOT has jurisdiction over the State Highway System, which includes
roadways throughout the City of Miami Beach; and
WHEREAS, Miami -Dade County also has jurisdiction over certain county roadways which
run through the City of Miami Beach; and
WHEREAS, FDOT and Miami -Dade County are not required to apply for municipal permits
when performing roadway projects, as the City does not have jurisdiction on these roadways; and
WHEREAS, the City is concerned that contractor(s) working on roadway projects
throughout the City Close lanes, which closures have caused major traffic impacts and created
traffic nuisances, during peak hours, for the City's residents and visitors; and
WHEREAS, these contractors may also have disregarded lane closure requirements by
closing lanes of traffic that were unnecessary for the scope of work for the project(s) or by closing
lanes of traffic during non -approved times; and
WHEREAS, these lane closures and various other traffic concerns caused by the projects
have resulted in many complaints by residents of the City; and
WHEREAS, City administration is exploring GIS technology to be able to plot Right of Way
and other roadway construction permits to better provide City residents with the best available
information; and
WHEREAS, while the City recognizes that unforeseen and/or extenuating circumstances
will occasionally require contractors (and their subcontractors) to operate outside of their
permitted hours, lane closures and work taking place beyond the hours or beyond the scope of
work established in the contract plans has been routinely occurring, with no notice to the City, in

WHEREAS, providing residents with information about City -related and non City -related
construction projects would alleviate some traffic impacts and traffic nuisances caused by such
projects by allowing residents and visitors to alter their plans and routes as may be needed.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby direct the City Administration to provide a weekly Letter to Commission
("LTC") and publish on the City's official website any information available to the City relating to
road construction work taking place throughout the City, including work on state-owned or county -
owned roads, or work performed by utility companies, including, without limitation, information
relating to any lane closures or other maintenance of traffic restrictions, and the locations and
times thereof, with the weekly LTC to include information regarding efforts made to mitigate traffic
congestion caused by such projects.

RECOMMENDATION
Pursuant to the request of Commissioner Alex Fernandez the above -referenced Resolution is
submitted for consideration by the Mayor and City Commission at the March 9, 2022. City
Commission meeting.
