CITY OF MI^MI BEACH, FLORIUA, DECLARING SUPPORT FOR
HOUSE BILL 105 AMU ITS COMPANION BILL, SENATE BILL 224, ANU
URGING THE FLC FMln^ SENATE TO AUOPT SENATE BILL 224 WHICH
SEEKS TO AUTHORIZE COUNTIES AND MUNICIPALITIES TO
FURTHER RESTRICT SMOKING WITHIN PUBLIC BEACHES ANU
PUBLIC PARKS IM THEIR RESPECTIVE JURISDICTIONS; ANU
DIRECTING THE CITY CLERK TO SENU A COPY OF THIS
RESOLUTION TO THE HFIUSE OF
REPRESENTATIVES, AND THE PRESIDENT OF THE FLORID^
SENATE.
WHEREAS, House Bill 105 ("HB 105") and its companion bill Senate Bill 224 ("SB
224") have been filed for consideration during the Florida legislature's 2022 session (the
"Bills"); and
WHEREAS, on February 24, 2022, the Florida House of Representatives passed
House Bill 105 ("HB 105"); -Inc[
WHEREAS, the Bills seek to authorize municipalities to restrict smoking within
public beaches and parks in their respective jurisdictions; and
WHEREAS, public parks and beaches in the City of Miami Beach should be
smoke -free for young children and families to enjoy together; and
WHEREAS, there are also statewide concerns about the littering of cigarette
components due to plastic filters from cigarettes and cigars being left in public parks and
beaches; and
WHEREAS, plastic filters and other pieces from cigarettes and cigars are non -
biodegradable byproducts of smoking which are also harmful to the environment when
littered; and
WHEREAS, litter is an issue that also has an impact on the quality of life of the
citizens of the City; and
WHEREAS, the City has a particular interest in maintaining its parks and beaches
in pristine condition for the enjoyment of both residents and visitors alike; and
WHEREAS, the City declares that it is in the interest of the public health, safety,
and welfare of its residents and visitors to reduce pollutants in the air, on the lands, and
in the waters of the City; and
WHEREAS, the Bills, if adopted, would limit the littering of these items throughout
the City's beautiful parks and beaches; and
WHEREAS, as such, the Mayor and City Commission declare their support for SB
224 and urge the Florida Senate to pass the bill during its 2022 Legislative Session.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby declare support for House Bill 105, and its companion bill, Senate Bill 224,
and urge the Florida Senate to adopt Senate Bill 224 which seeks to authorize counties and
municipalities to further restrict smoking within public beaches and public parks in their respective
jurisdictions; and direct the City Clerk to send a copy of this Resolution to the Speaker of the
Florida House of Representatives, and the President of the Florida Senate.
