A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, RE-AFFIRMING THE POLICY
DIRECTION SET FORTH IN CITY COMMISSION RESOLUTION NO.
2019-30803 TO PURSUE CONSISTENT, ASSERTIVE ZERO
TOLERANCE ENFORCEMENT OF QUALITY OF LIFE OFFENSES IN
THE CITY OF MIAMI BEACH.
WHEREAS, the protection of the health, safety and general welfare of the City's
residents and visitors is one of the fundamental functions performed by the City; and
WHEREAS, visible signs of crime and civil noncompliance create an environment
that encourages further crime and disorder, including serious crimes; and
WHEREAS, at the April 4, 2019 meeting of the Mayor's Panel on Ocean Drive —
Safety, Security and Infrastructure Subcommittee ("Subcommittee"), the Subcommittee
recommended that the City pursue more assertive enforcement throughout the year with
respect to violations of open container laws, marijuana laws, underage drinking, noise
and quality of life offenses, in order to convey to the City's residents and visitors that such
misconduct will not be tolerated; and
WHEREAS, on June 26, 2019, the Mayor and City Commission adopted
Resolution No. 2019-30803, accepting the recommendations of the Subcommittee and
directing the Administration to identify resources and policy recommendations that could
be utilized to mitigate quality of life concerns for future High Impact Periods; and
WHEREAS, the City has continued to experience an increasingly large number of
visitors during these High Impact Periods, and the sizeable number of individuals
attending these events has posed numerous challenges for the City; and
WHEREAS, the City enforces its zero tolerance approach while always trying to
deescalate situations and seeking peaceful resolutions of issues; and
WHEREAS, the City is committed to reducing crime(including low-level crime) and
repeat offenses, addressing unreasonable or excessive noise, and bringing social
services to those that may find it difficult to otherwise obtain such services; and
WHEREAS, on October 27, 2021, the Mayor and City Commission adopted
Ordinance 2021-4452, which authorized the immediate issuance of a notice of violation
(without providing 15 minutes to comply and a prior written warning) for noise ordinance
infractions committed by persons in vehicles, and increased the associated civil fines
pertaining to violations of the City's noise ordinance; and
WHEREAS, on November 23, 2021, the Mayor and City Commission adopted
Resolution No. 2021-31922, adopting the certification of the results of the November 16,

2021 run-off election for the City, and declaring elected the following candidates for Mayor
and City Commissioner Groups I, II and Ill:
For Mayor: Dan Gelber
for City Commissioner Group I: Kristen Rosen Gonzalez
for City Commissioner Group II: Mark Samuelian
for City Commissioner Group Ill: Alex Fernandez; and
WHEREAS, in light of the new additions to the governing body of the City, the
Mayor and City Commissioners desire to re-affirm the City's commitment to pursue
consistent, assertive zero-tolerance enforcement, throughout the year, of open container
laws, marijuana laws, underage drinking, noise and quality of life offenses, in order to
convey to the City's residents and visitors that such misconduct will not be tolerated.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby re-affirm the policy direction set forth in City Commission Resolution
No. 2019-30803 to pursue consistent, assertive zero-tolerance enforcement of quality of
life offenses in the City of Miami Beach.
