WHEREAS,the Murano Grande at Portofino Project was developed by Murano Two, Ltd.,
as evidenced in the Declaration of Covenants, Restrictions and Easements for Murano Grande
at Portofino Project, recorded in Official Records Book 21134 at Page 3878 of the Public Records
of Miami-Dade County, Florida ("Master Covenants"); and
WHEREAS, the Murano Grande at Portofino is a condominium located at 400 Alton Road,
Miami Beach, FL 33139, developed by Murano Two, Ltd., the developer of the Murano Grande
condominium as evidenced in the Declaration of Murano Grande at Portofino, a condominium,
recorded in Official Records Book 21134 at Page 3930-4041 of the Public Records of Miami-Dade
County, Florida ("Murano Declaration of Condominium"); and
WHEREAS, on March 31, 2003, the Murano Two, Ltd. formed the Murano Grande at
Portofino Condominium Association, Inc. (the "Murano Grande") pursuant to the Murano
Declaration of Condominium, and formed the Murano Grande at Portofino Master Association,
Inc. (the"Master Association") pursuant to the Master Covenants; and
WHEREAS, the Master Association owns and is charged with, among other things,
managing and maintaining the"Common Properties,"as defined in Paragraph 1.1(i)of the Master
Covenants; and
WHEREAS, on or about April 9, 2003, Murano Two, Ltd., entered into a 101-year lease
agreement with Tenant(the "Murano Lease")for the leasing of parking spaces, laundry, lavatory
and shower facilities, a trash room and a maintenance room, all located within the "City Unit", as
set forth in the Murano Lease; and

WHEREAS, the Icon South Beach is a condominium located at 45,0 Alton Road,, Miami.
Beach, FL 33139,,developed by Murano Three, Ltd., as evidenced in the Declaration of Icon, a
condominium recorded in.Official Records Book 22824 at Page 4451 of the Public Records of
Miami-Dade County, Florida("Icon Declaration of Condominium");'and
WHEREAS, on or about April 9, 2003, Murano Three,,Ltd., entered into a 101-year!ease
agreement with Tenant ("Icon Lease") for the leasing of parking spaces, office space and an
electric room all located within the"City Unit", as set forth in the Icon Lease; and
WHEREAS, on 'November 16, 2004, the Murano Three, Ltd. formed. the Icon
Condominium Association, Inc. (the"Icon")pursuant to the Icon Declarationof Condominium;and
WHEREAS, the Murano Grande and Icon, joined by Master Association, filed separate
lawsuits for damages and eviction under the Icon Lease and Murano Lease against the City, the
RDA and the.Marina, in consolidated Case Nos. 2015-11069 CA43 and.2014-023217 CA43, in
the Eleventh Judicial Circuit in and for Miami-Dade County(collectively the"Lawsuit"); and
WHEREAS,the City and the RDA filed a third-party complaint/counterclaim in the Lawsuit
seeking declaratory action pursuant to the.Declaratory Judgment Act, 86.111, Fla. Stat'. seeking
to determine, inter a/ia,that pursuant to the Master Covenants,the Master Association is the City
and RDA's"landlord" under both the Murano Lease and the Icon Lease; and
WHEREAS; on or about April 27, 2017, the Court entered an Order on The City'Of Miami
Beach,and Miami Beach:Redevelopment Agency's Amended Motion for, Summary Judgment as
to the Counterclaim Third Party Complaint for Declaratory Relief, finding that "the Master
Association is the sole Landlord under the [Murano Lease) and "the Master Association is the
sole.Landlord under the Icon Lease."; and
WHEREAS,the Murano Grande, Icon, and Master Association appealed the Court's April
27, 2017 Order to the Third District Court of Appeals, Murano Grande at Portofino Condominium
Association, Inc., et al., v. The City of Miami Beach et. al., Appellate Case No: 3d1.7-2356 (the
"Appeal".). Through the Appeal, the Associations also appealed the Court's.Order on Tenant's
Motion to Dismiss First Amended Complaiint, rendered on October 5, 2017, as amended on
October 13, 2017; the Courts. Order Denying, Associations' Amended Motion for Summary
Judgment rendered on October 20, 2016; and Order Denying Associations' Motion for Rehearing
or Alternative Motion for Entry of Corrected Order and Clarification, rendered on May 30, 2017;
and
WHEREAS, on August 13, 2018, the Mayor and. City Commission held an 'Executive
Session to discuss a settlement agreement regarding pending litigation with the Murano Grande
at Portofino Association, Inc.,the Icon Condominium Association, Inc.and the Murano Grande at
Portofino Master Association, Inc.;and
WHEREAS,the Mayor and City Commission directed the"City Attorney's Office to prepare
the settlement agreement and lease amendments in accordance with the direction provided at
the Executive Session; and
WHEREAS, the Administration recommends in favor of approving the settlement
agreement and executing the lease amendments pursuant to the direction of the Mayor and City
Commission.

NOW,THEREFORE, BE IT DULY RESOLVED BY THE CHAIRPERSON AND MEMBERS
OF THE MIAMI BEACH REDEVELOPMENT AGENCY, that the Chairperson and Members of
the Miami Beach Redevelopment Agency hereby approve the settlement between the Miami
Beach Redevelopment Agency and the Murano Grande at Portofino Condominium Association,
Inc., the Icon Condominium Association, Inc., and the Murano Grande at Portofino Master
Association, Inc., and authorize the Executive Director .and General Counsel to take the
necessary and appropriate steps for the implementation thereof; and further authorize the
Chairperson and Secretary to execute any documents and/or agreements, as required, to
effectuate the terms of the settlement; and further approve and authorize the Chairperson and
Secretary to execute,as part of Such settlement,a first amendment to the lease agreement among
the City of Miami Beach, the Miami Beach Redevelopment Agency, the Murano Grande at

ANALYSIS
On August 13, 2018, the Mayor and City Commission held an Executive Session to discuss a
settlement agreement regarding pending litigation with the Murano Grande at Portofino Association,
Inc., the Icon Condominium Association, Inc. and the Murano Grande at Portofino Master
Association, Inc. The Mayor and City Commission directed the City Attorney's Office to prepare the
settlement agreement and lease amendments in accordance with the direction provided at the
Executive Session.
CONCLUSION
The Administration recommends in favor of approving the settlement agreement and executing the
lease amendments pursuant to the direction of the Mayor and City Commission.

How a crazy idea to make a
about Miami's Cocaineplay
Cowboys is becoming a reality

The idea seemed outlandish, maybe even impossible at the time: a one-man play
about Miami's infamous Cocaine Cowboys of the 198os.
Some 15 years ago, the Miami-raised Billy Corben was deep into research for
what would become "Cocaine Cowboys," a seminal documentary on Miami's coke
trade.
Back then, Corben was a recent New World School of the Arts grad.
He was reading the deposition of Cocaine Cowboys hitman Jorge "Rivi"Ayala in
the State of Florida v. Griselda Blanco case to prepare for an interview with Rivi.
Ayala worked for Blanco,the bloodthirsty Miami drug kingpin of the 197os and
'8os,who was known as "the Godmother."
Blanco was eventually deported to Colombia and gunned down in Medellin in
2012. In 1993,Ayala was sentenced to life in prison with the possibility of parole
after 25 years for his role in three murders. His next hearing before a Florida
parole board is in 2019.
The deposition read so much like a play, that it lingered as a"maybe one day"
proposition in an ambitious young Miami film director's mind for years.
Now it is becoming a reality.
The documentary was ultimately released in 2006 by rakontur, the film
production company Corben runs with producing partner Alfred Spellman from
an office on Lincoln Road.
Ayala and Blanco were prominently featured in "Cocaine Cowboys" and its 2008
sequel, "Cocaine Cowboys 2: Hustlin'With the Godmother." "Cocaine Cowboys:

Reloaded"in 2014 expanded the original documentary with new footage and
interviews.
That's a lot of content spun off of the reading of a deposition. But a stage play?
"I went to New World and was immersed in theater reading of plays and I'm
reading this deposition and it's unlike any deposition I've seen," Corben said of
his original idea. "These were not short'yes' or'no' answers. Rivi was a
cooperating witness and they were looking to him to expound and elaborate in
every minute detail on these murders he was involved in.

"I said to Alfred, my producing partner, 'This reads like a one-man play. I can see
it on stage.'Alfred says, `Let's make the documentary first then we can revisit the
stage play' — obviously joking at the time," Corben recalled.
"I,however, was not. I thought it would be an extraordinary piece of theater and
kind of filed that away for awhile," Corben said.

Fourteen years later, Corben, now 39, is partnering with Miami New Drama's
artistic director Michel Hausmann to create a stage adaptation.
Miami New Drama was awarded a $150,00o Knight Arts Challenge grant in
December to explore a piece of the city
's history on stage.

Hausmann and Corben had long bonded over shared conversations as The
Colony and rakontur are nearby on Lincoln Road Mall. Hausmann, a native of
Venezuela,known for his creative approach to theater in recent productions like
Colony's multilingual English-Spanish-Creole production of Thorton Wilder's
"Our Town,"saw the possibilities in Corben's brainstorm.
"A collaboration with Billy is an amazing opportunity. He's a unique artist,
someone who always speaks the truth regardless of consequences. Someone who
has a profound connection with Miami. We complement each other a bit,"
Hausmann said. "Billy is very pessimistic about the city, in general. I am kind of
an optimist, a champion of the new Miami."

For the original"Cocaine Cowboys" documentary, "Billy went to the gutter of the
city to tell its stories. Me, a recent Miami native, I have a different outlook and I
like the fact we can complement that."
The theatrical version,both say,will not be the placing of the 2006 documentary
on the stage,with its myriad characters. "That would be stupid," Haussman said.
And, no, it won't be a musical, though Corben jokes that Gloria Gaynor's 1979
disco hit"I Will Survive" could be"a brilliant 11-o'-clock number."
He's just kidding. Unless he's not.

The idea, now, is to tell the dramatic story through the words of the charismatic
sociopath Ayala that Corben first gleaned off that intriguing deposition.
"We want to know what we have learned as a city since then and how we will
move forward," Hausmann said. "We are entering the material with a fresh new
take, a decade-and-a-half later."
Hausmann sees a stage version of"Cocaine Cowboys" as part of Colony's mission
to present original, daring works. "We do work that is in direct conversation with

our community,with the issues of our community now, and work that is
multicultural and diverse as our city is.We are not interested in doing what New
York did last year. We want New York to do what we are doing this year."
Corben and Hausmann expect the"Cocaine Cowboys" stage play to makes its
theatrical debut in the spring of 2019 at Miami Beach's Colony Theatre.
They are currently talking to a South Florida-based playwright who has "blown
up in the TV writing world in Los Angeles and New York,"Corben said. They will
name him as soon as contracts are signed, a process they figure is imminent.
The harmonious homegrown production, so far, has had a resounding effect on
Corben. Could he be becoming closer to the optimist like Hausmann defines
himself?
"It's kind of wonderful how much writing talent has emerged from Miami in show
business. I can't think of that many cities in the world or in the country where you
can accomplish something like this — that you can conceive, develop, write,
produce, mount a world premiere and finance, most importantly, an original
show like this," Corben said.
"It really speaks that for all we joke about Miami and its lack of culture it's pretty
inspiring that something like this can take off entirely from Miami people and
that includes the Knight Foundation,"he said. "It's inspiring and bodes well for
the future of the community that something like this is even possible from
something that started as a joke in 2003 and can progressively manifest itself.
This makes me feel warm and fuzzy on an otherwise bitter and uncharacteristic
cold day."
