Resolution 2022-32183 RESOLUTION NO. 2022-32183 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 7, TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND RIBBECK ENGINEERING, INC. FOR THE INDIAN CREEK DRIVE/STATE ROAD (SR) A1A, 26 STREET TO 41 STREET FLOODING MITIGATION PROJECT, IN THE LUMP SUM OF $68,500 TO PROVIDE ADDITIONAL ENGINEERING SERVICES FOR THE ROADWAY ANALYSIS AND DESIGN OF A PROTECTED BICYCLE LANE, WITH PREVIOUSLY APPROPRIATED FUNDING. WHEREAS, on March 9, 2016, the Mayor and City Commission adopted Resolution 2016- 29332 approving a Department Funded Agreement(DFA)between the City of Miami Beach(City) and the Florida Department of Transportation(FDOT)for the cost sharing of a construction project on Indian Creek Drive from 26th to 41st Street; and WHEREAS, the infrastructure improvements under this agreement, designed to meet the new flood elevation requirements, included a new storm water drainage system, pump station, seawall, roadway, sidewalks, curbs and gutters and the scope also includes the replacement of driveways, light poles, signs, signals and pavement markings to match the new roadway alignment and configuration; and WHEREAS, on June 8, 2016, the Mayor and City Commission adopted Resolution 2016- 29456, approving the award of a professional services agreement to Ribbeck Engineering, Inc. (Ribbeck), in the total amount of$407,851.00, to develop the Design Criteria Package(DCP)and conceptual plans for approximately 0.85 miles of Indian Creek Drive in accordance with FDOT design criteria as well as the City's contract requirements; and WHEREAS, on April 26, 2017, the Mayor and City Commission adopted Resolution 2017- 29839, authorizing the negotiation of Amendment No. 1 to the Professional Services Agreement with Ribbeck, in the amount of$863,171.92 plus a $86,317.19 contingency, for a total amount of $949,489.11, to prepare a set of"Interim" construction plans from 25th to 26th Street, and 26th to 41st Street, including side streets along the entire project limits with the approximate length of roadway for this expanded project scope was 1.7 miles; and WHEREAS, on October 18, 2017, the Mayor and City Commission adopted Resolution 2017-30070, authorizing the negotiation of Amendment No. 2 to the Professional Services Agreement with Ribbeck, in the amount of $1,056,347.77, plus a $158,452.17 owner's contingency of fifteen percent (15%), for a total amount of $1,214,799.94, to complete the construction plans for the "Ultimate" Phase for the entire project limits; and WHEREAS, the scope of work included detailed plans for roadway, traffic control and analysis, seawall, drainage, signage, signalization, pavement markings, lighting, and related improvements and it also included a Design Variations memorandum, reports including crash data analysis, cost benefit ratios required by FDOT, electrical and mechanical design of the pump station; and 1 WHEREAS, on October 30, 2018, the Mayor and City Commission adopted Resolution 2018-30547, authorizing Amendment No. 3 to the Professional Services Agreement with Ribbeck, in the amount of $308,364.46, plus a ten percent (10%) owner's contingency in the amount of $30,836.05, for a total of $339,196.51, to perform subsurface exploration to further identify potential utilities conflicts, modifications to roadway and drainage design resulting from owner's requests to modify harmonization plans for the adjacent properties, parking lanes modification to meet FDOT criteria, additional utility coordination, special handrail design to meet new Historic Preservation Board (HPB) criteria and additional coordination efforts; and WHEREAS, on September 11, 2019, the Mayor and City Commission adopted Resolution 2019-30943, authorizing Amendment No. 4 to the Professional Services Agreement with Ribbeck, in the amount of $383,670.00, for performing post design services, reviewing contractor's submittal responding to requests for information(RFI's)and attending bi-weekly project meetings; and WHEREAS, on June 24, 2020, the Mayor and City Commission adopted Resolution 2020- 31292, authorizing Amendment No. 5 to the Professional Services Agreement with Ribbeck, in the amount of $350,270.73, including a 20% allowance for unforeseen design tasks, for design revisions associated with the generator relocation, geotechnical services, permitting assistance and post design services; and WHEREAS, on July 28, 2021, the Mayor and City Commission adopted Resolution 2021- 31792, authorizing Amendment No. 6 to the Professional Services Agreement with Ribbeck, in the amount of$125,541.19, to provide additional engineering services for the seawall component of the project; and WHEREAS, the community representatives have requested the incorporation of a protected bicycle lane through the replacement of the bike lane delineators (the vertical plastic poles) with a modular segregation system and associated pavement markings; and WHEREAS, the Zicla Zipper is a modular bike lane separator product made of recycled plastic that is approximately 11 inches in width and approximately 5 inches in height; and WHEREAS, the width at the bottom requires modification to the existing bicycle lane configuration to allow for its installation and this modular segregation system is designed to improve safety and mobility for road users and bicyclists by providing a curb-like barrier; and WHEREAS, as Indian Creek Drive is an FDOT roadway, in order to install the requested bike lane separators, coordination with and approval from,FDOT is required; and WHEREAS, the bike lane separators were conceptually discussed and coordinated with FDOT, however, the final design must be submitted to FDOT for review and approval; and WHEREAS, Ribbeck submitted a cost proposal, for Amendment No. 7 (Exhibit A) to the Agreement, in the amount of $68,500.00, to conduct roadway analysis, design the Zicla Zipper bike lane separator system, obtain the FDOT approval, and provide post design services; and WHEREAS, among other tasks, the major design scope will require Ribbeck to conduct the necessary analysis and modeling to reduce the width of the inside lane (east lane)from 11 to 10 feet, provide a dedicated 5.5 feet of bike lane and conduct a speed analysis along the corridor in order to reduce the posted speed limit from 35 mph to 30 mph; and 2 WHEREAS, amendment No. 7 in the amount of$68,500.00 to design and obtain approval from FDOT, has been reviewed by staff and was found to be fair and reasonable; and WHEREAS, this Amendment No. 7 will revise the total agreement amount to $3,839,318.48; WHEREAS, this Amendment No. 7, will bring the total contract amount to$3,839,318.48 and NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. This analysis is required to verify safety and adequacy of large type vehicles traffic from and to every intersection along the corridor. An Auto Turn analysis design documentation report will be prepared and submitted to FDOT for review and approval. 3. Conducting Intersection Sight Triangle Analysis and updating the design variation accordingly. 4. Submitting and following up with FDOT through design variation review and approval process. 5. Coordinating Target Speed with FDOT. 6. Coordination Posted Speed with FDOT. 7. Updating the bike lane design variation accordingly. 8. Submitting and following up with FDOT through design variation review and approval process. 9. Submitting a Green Pavement Memo for approval. 10. Updating typical section package. 11. Submitting and following up with FDOT through typical section package review and approval process. 12. Conducting spread analysis to assess ponding at consecutive runs. 13. Computing the maximum consecutive run without openings. 14. Preparing Traffic Control analysis and plans. 15. Preparing quantities for Traffic Control Plans. 16. To complete the scope of this amendment, we are requesting $68,500.00. The anticipated scope may include the Zicla bus bay Vectorial module but does not include any physical alternations or additions to the bus bays. Any revision to the roadway elements will be considered out of scope. Please keep in mind that this is a new product that will require extensive coordination with FDOT and manufacturer among research for different aspects of the design. As listed above,we anticipate multiple coordination meetings with FDOT and respective reviewers. Our staff hour estimate was broken down and detailed in the attached Exhibit A for your use.
