Resolution 2022-32195 RESOLUTION NO. 2022-32195 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DECLARING JUNE 26, 2022 AS THE "MARRIAGE EQUALITY DAY" IN THE CITY OF MIAMI BEACH. WHEREAS, on June 26, 2015, in a landmark Supreme Court decision Obergefell v. Hodges, marriage equality became the law of the land and granted same-sex couples in all 50 states the fundamental right to marry under the U.S. Constitution; and WHEREAS, the road to nationwide marriage equality was a long one, spanning decades of resistance and history and culminating in victory in June 2015; and WHEREAS, throughout the long fight for marriage equality, the City of Miami Beach was at the forefront of promoting marriage equality; and WHEREAS, in 2004, the Mayor and City Commission adopted an ordinance creating a domestic-partnership registry giving unmarried couples, including same- sex couples, with legal rights including hospital visitation, participation in healthcare decisions and emergency medical notification; and WHEREAS, in 2013, the Mayor and City Commission adopted Ordinance No. 2013-3803, which provided tax equity to City employees with domestic partners, including same-sex couples who were in domestic partnerships and were being taxed on the payments they make on their health insurance benefits; and WHEREAS, many of the City's employees, residents, and visitors are same-sex couples and the landmark victory in Obergefell has dramatically changed the course of their lives and their families' lives; and WHEREAS, continued acknowledgement and support of the fundamental right to same-sex marriage has become more important than ever, in light of the Supreme Court's draft opinion overruling Roe v. Wade, which was leaked to Politico and revealed to the public on May 2, 2022; and WHEREAS, in the leaked decision, Justice Alito narrowly interpreted what constitutes a fundamental right, repeatedly referencing to the idea that any right not mentioned in the Constitution must be"deeply rooted in this Nation's history and tradition" to be recognized; and WHEREAS, the Supreme Court's apparent willingness to overturn high-profile precedents has alarmed many legal experts, as well as the LGBTQ community about the status and longevity of a recently established fundamental right to same-sex marriage; and WHEREAS, as follows, the Mayor and City Commission wish to reaffirm their commitment to marriage equality and wish to declare June 26, 2022 as the "Marriage Equality Day" in the City of Miami Beach. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby declare June 26, 2022 as the "Marriage Equality Day" in the City of Miami Beach.
