Resolution 2022-32177 RESOLUTION NO. 2022-32177 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO INVITATION TO BID (ITB) NO. 2022-214- WG PUBLIC-PRIVATE PARTNERSHIPS (P3) CONSULTING SERVICES; PREQUALIFYING THE INITIAL POOL OF CONSULTANTS: ARUP US, INC., CBRE, INC., THE CONCOURSE GROUP, LLC, ERNST & YOUNG INFRASTRUCTURE ADVISORS, LLC, FRASCA & ASSOCIATES, LLC, IMG REBEL ADVISORY, INC., JACOBS ENGINEERING GROUP INC., JONES LANG LASALLE AMERICAS, INC., KPMG LLP, LAMBERT ADVISORY LLC, REDEVELOPMENT MANAGEMENT ASSOCIATES, LLC, AND WALKER CONSULTANTS, INC.; AND FURTHER AUTHORIZING THE CITY MANAGER TO KEEP THE ITB OPEN FOR THE PURPOSE OF PREQUALIFYING ADDITIONAL CONSULTANTS, AND DELEGATING THE AUTHORITY TO THE CITY MANAGER TO ADD CONSULTANTS TO THE POOL PROVIDED THAT ANY SUCH CONSULTANT MEET THE REQUIREMENTS OF THE ITB. WHEREAS, Section 255.065, Florida Statutes, allows private entities to submit unsolicited proposals to public entities for the development or improvement of public facilities and infrastructure; and WHEREAS, the City of Miami Beach, Florida (the "City") recognizes that properly structured public-private partnerships ("P3") may promote the development of City assets, encourage efficiencies and innovation in design, construction, operations, and maintenance, and yield sources of revenue or other financial benefits to the City; and WHEREAS, to better evaluate unsolicited proposals, the City seeks firms with strong qualifications and proven experience providing consulting services to public entities on public- private partnership ("P3") projects; and WHEREAS, services may include but are not limited to feasibility studies, cost-benefit analysis, life cycle costs analysis, potential public benefits, maximizing revenue, and other Consultant services regarding unsolicited and competing proposals received by the City; and WHEREAS, in anticipation of future unsolicited proposals, the City sought applications from highly qualified P3 consulting firms who wish to be included in a pool of prequalified firms from which the City may select from to assist with any subsequent P3 projects; and WHEREAS, the City reserves the right to utilize any prequalified firm on any development project to which the City is a party; and WHEREAS, on February 23, 2022, the Administration issued ITB 2022-214-WG Prequalification Pool for Public-Private Partnerships (P3) Consulting Services; and WHEREAS, on March 30, 2022, the City received a total of fourteen (14) applications from Arup US, Inc., Blue Rose Capital Advisors, LLC, CBRE, Inc., The Concourse Group, LLC, Corrosion Probe, Inc., Ernst & Young Infrastructure Advisors, LLC, Frasca & Associates, LLC, IMG Rebel Advisory, Inc., Jacobs Engineering Group Inc., Jones Lang LaSalle Americas, Inc., KPMG LLP, Lambert Advisory LLC, Redevelopment Management Associates, LLC, and Walker Consultants, Inc.; and WHEREAS, Arup US, Inc.., CBRE, Inc., The Concourse Group, LLC, Ernst & Young Infrastructure Advisors, LLC, Frasca & Associates, LLC, IMG Rebel Advisory, Inc., Jacobs Engineering Group Inc., Jones Lang LaSalle Americas, Inc., KPMG LLP, Lambert Advisory LLC, Redevelopment Management Associates, LLC, and Walker Consultants, Inc., have been deemed responsive, responsible bidders meeting all terms and conditions of the ITB and are recommended for award; and WHEREAS, the applications submitted by Blue Rose Capital Advisors, LLC, and Corrosion Probe, Inc., were rejected for failing to produce sufficient evidence of the minimum •experience requirements; and WHEREAS, both firms may resubmit their applications at a later date to be reconsidered for later addition to the pool; and WHEREAS, the City Manager concurs with City staff that it is in the best interest of the City to have a.pool of prequalified consultants from which the City may select from to assist with any P3 project resulting from an unsolicited or competing proposal; and WHEREAS, . the City reserves the 'right to utilize any prequalified firm on any development project to which the City is a party; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City :Manager, pursuant to Invitation to.Bid (ITB).2022-214-WG, to establish a pool of consultants from which the City may select to assist with any P3 project and approve the initial pool of qualified consultants: Arup US, Inc., CBRE, Inc., The Concourse Group, LLC, Ernst& Young Infrastructure Advisors, LLC, Frasca & Associates, LLC, IMG Rebel Advisory,, Inc., Jacobs Engineering Group Inc:, Jones Lang LaSalle Americas, Inc., KPMG LLP, Lambert Advisory LLC,:Redevelopment Management Associates, LLC, and Walker Consultants, Inc., 'and further authorize the City Manager to keep the ITB open for the purpose of prequalifying consultants and delegate to the City Manager the authority to add consultants to the pool, provided such consultants meet the requirements of the ITB. RECOMMENDATION It is recommended that the Mayor and City Commission approve the Resolution authorizing the Administration to establish a pool of prequalified firms available to assist the City with any public- private partnership (P3)proposal that may be received. The Resolutions authorizes the initial pool of prequalified firms:Arup US, Inc., CBRE, Inc., The Concourse Group, LLC, Ernst& • Young Infrastructure Advisors, LLC, Frasca&Associates, LLC, I MG Rebel Advisory, Inc., Jacobs Engineering Group, Inc., Jones Lang LaSalle Americas, Inc., KPMG LLP, Lambert Advisory, LLC, Redevelopment Management Associates, LLC,and Walker Consultants, Inc. The Resolution also authorizes the Administration to keep the ITB open to prequalify additional firmsand delegates to the City Manager the authority to add firms to the pool, provided such firms meet the requirements of the ITB, or remove firms for non-performance. This solicitation is currently under the cone of silence. BACKGROUND/HISTORY Section 255.065, Florida Statutes, allows public entities to partner with private entitities for the development or improvement of public facilities and infrastructure.The recognizes that properly structured P3 may: promote the development of City assets; encourage efficiencies and innovation in design,construction, and operations;and yield sources of revenue or other financial benefits to the City. In order to properly evaluate any P3 proposal,the City may require assistance from firms with expertise and proven experience in providing consulting services to public entities for these types of projects that have varying complexities and analysis requirements. Services may include but are not limited to:feasibility studies,cost benefit analysis, life cycle costs analysis, potential public benefits, maximizing revenue types and amounts, and other services required during the consideration of a P3 proposal. Page 39 of 1232 In anticipation of future needs,the City sought applications from consulting firms who wish to be included in a pool of prequalified firms from which the City may select a firm to assist with any P3 project. While it is anticipated that the majority of the services will be required as a result of P3 proposals received,the City reserved the right in the solicitation to utilize any prequalified firm on any development project to which the City is a party. ANALYSIS On February 23, 2022,the Administration issued ITB 2022-214-WG for Public-Private Partnerships (P3)Consulting Services. ITB responses were due and received on March 30, 2022. The City received applications from the following fourteen firms:Amp US, Inc., Blue Rose Capital Advisors, LLC, CBRE, Inc., The Concourse Group, LLC, Corrosion Probe, Inc., Ernst&Young Infrastructure Advisors, LLC, Frasca&Associates, LLC, I MG Rebel Advisory, Inc., Jacobs Engineering Group Inc., Jones Lang LaSalle Americas, Inc., KPMG LLP, Lambert Advisory LLC, Redevelopment Management Associates, LLC, and Walker Consultants, Inc. However,the proposals received from Blue Rose Capital Advisors, LLC, and Corrosion Probe, Inc.failed to meet the minimum experience requirements established in the solicitation and, therefore, could not be considered at this time. However, the firms have been advised that they may resubmit their applications at a later date to be considered in a subsequent addition of firms to the pool. ' Representatives from the Economic Development Department,the Facilities and Fleet Management Department and the Procurement Department found that the following bidders demonstrated the required level of experience, in various disciplines, and meet the requirements of the solicitation for prequalification:Amp US, Inc., CBRE, Inc., The Concourse Group, LLC, Ernst&Young Infrastructure Advisors, LLC, Frasca&Associates, LLC, I MG Rebel Advisory, Inc., Jacobs Engineering Group Inc., Jones Lang LaSalle Americas, Inc., KPMG LLP, LambertAdvisoryLLC, Redevelopment Management Associates, LLC, and Walker Consultants, Inc. Accordingly,these firms are recommended to be approved as the initial pool of prequalified firms. SUPPORTING SURVEY DATA Not Applicable FINANCIAL INFORMATION There is no fiscal impact at this time.When services are required,the prequalified firms will be invited to submit qualifications relative to the project for which the services are needed,scope of work and cost proposals. The firm offering the best combination of qualifications, scope and cost will be engaged.Any task order that is greater than$100,000 will require prior City Commission approval. However, I concur with staff that it is in the best interest of the City to proactively develop the pool of prequalified firms from which the City may seek assistance in the event such assistance would be needed for any future P3 project. The firms recommended to be approved as the initial pool appear to be well qualified and are subject matter experts in various fields which will be useful to the City as it evaluates any future P3 project. Accordingly, I recommend that the Mayor and City Commission of the City of Miami Beach, Florida, approve the Resolution, accepting the recommendation of the City Manager, pursuant to Invitation to Bid (ITB) No.2022-214-WG,to approve the initial pool of prequalified firms: Arup US, Inc., CBRE, Inc., The Concourse Group, LLC, Ernst&Young Infrastructure Advisors, LLC, Frasca&Associates, LLC, I MG Rebel Advisory, Inc., Jacobs Engineering Group Inc., Jones Lang LaSalle Americas, Inc., KPMG LLP, Lambert Advisory LLC, Redevelopment Management Associates, LLC, and Walker Consultants, Inc.; and authorizing the City Manager to keep the ITB open for the purpose of prequalifying additional firms that may apply;further, delegating to the City Manager the authority to add firms to the pool, provided such firms meet the requirements of the ITB,or remove any prequalified firm for non- performance.
