SUBJECT: August 23, 2022 Special Election Information Airing on MBTV
On April 6, 2022, Governor Ron Desantis signed into law HB 921, which amended Florida Statute
106.113, effective July 1, 2022, to broadly prohibit the use of public funds by local governments
for any communication sent to electors concerning an issue, referendum, or amendment,
including any state question, that is subject to a vote of the electors. The new law applies to any
communication initiated by a local government, "irrespective of whether the communication is
limited to factual information ." On May 26, 2022, City Attorney Rafael A. Paz issued LTC # 206-
2022 opining that the limited exceptions in the statute would permit the City to continue to publish
the text of the ballot questions themselves in communications such as the MB Magazine, along
with a link to the City Clerk website, where voters may access the underlying resolutions and
related agenda materials officially approved by the City Commission. City Attorney Paz further
opined that the City may also continue to publish basic general fact-based elections-related
information, such as information concerning deadlines for Voter Registration; Early Voting
locations, hours, and dates; Vote-by-Mail deadlines; and Election Day hours.
In compliance with the City Attorney's legal opinion, factual information relating to the City's
August 23, 2022 Special Election will air on MBTVas follows:
Mondays 5:00 a.m. 9:00 a.m. 1 :30 p.m. 8:00 p.m .
Tuesdays 1:00 a.m . 6:00 a.m. 2:00 p.m. 9:00 p.m.
Wednesdays 2:30 a.m. 6:00 a.m. 1 :00 p.m. 8:00 p.m.
Thursdays 3:00 a .m. 8:30 a.m. 2:00 p.m. 9:00 p.m.
Fridays 2:30 a.m. 6:30 a.m. 3:00 p.m. 9:00 p.m.
Saturdays 3:00 a.m. 8:30 a.m. 3:00 p.m. 9:00 p.m.
Sundays 2:30 a.m. 9:00 a.m. 2:00 p.m. 6:30 p.m.
The program will be transmitted via Breezeline Cable channel 660, AT&T U-verse channel 99,
Hotwire Communications channel 395, and ROKU device on PEG.TV channel. The video began
broadcasting on Saturday, July 23, 2022 and will continue broadcasting until Election Day,
Tuesday, August 23, 2022. The program broadcasts in both English and Spanish and runs for
approximately 21 minutes. (English: 9 minutes and Spanish: 12 minutes .). To view the
