Historic Preservation Board Recommendation -Setback Regulations for Public
and Semi-Public Buildings.
At their July 12, 2022 meeting, the Historic Preservation Board reviewed and approved an application
for a Certificate of Appropriateness for the construction of a new school located within the R-PS2 Zoning
district. This included the approval of variances to reduce the minimum required interior side setbacks.
Based on the proposed use of the property, the minimum interior side setbacks for this project wou ld
have been 50 feet if the variances had not been granted.
Specificall y, section 142-1131 (d) of the Land Development Regulations of the City Code provides for a
minimum interior side yard setback of 50 feet for schoo ls , libraries, religious institutions, and other public
buildings and private structures which are publicly used for meetings in residential districts. Following
the review of the application, the Board passed a separate motion urging the Mayor and City
Commission to consider amending this section of the Land Development Regulations to reduce the
minimum 50'-0" interior side setback requirements for such uses .
